Are there any limitations on freedom of speech? The only nation-wide limitation is that being a nuisance or a jihadist is not allowed, but many strange laws in certain cities can lead to you being arrested (then again, it's illegal to get a fish drunk in Zagreb.). Quite INFAMOUSLY, the nation is well-known for encouraging hate speech within the borders of the Tornado Queendom. However, they don't care about hate speech outside the country.

Does your nation's constitution protect freedom of speech? Yes, but also states that the right may not be exercised against the interests of the society or the state.
Does your nation's government respect its citizens freedom of speech? No (see below).
Are there any limitations on freedom of speech? Constitutionally, the right might not be exercised against the interests of society or the state or if the right is useed to infringe on other citizens' rights. From a legal point of view, there are multiple, overlapping laws that criminalize almost all forms of dissent. Many of these laws are redundant and serve no other purpose than to intimidate the population and stack punishments in case of dissent. Punitive psychiatry is also used.
Are citizens allowed to criticize the government and voice their opinions freely without fear of government retribution? Mild forms of dissent and criticism of official policy (those that do not criticize the socialist system or the Communist Party themselves) are tolerated. Any other forms of dissent are brutally supressed, mostly using the legal tools previously mentioned. Surveillance by political police (the KGB) is rampant. Potential repercussions for political offenses include loss and denial of employment (and unemployment is illegal), prison terms, labor camp terms, forced internment in psychiatric institutions (after being diagnosed with non-existing psychiatric conditions), forced disappearence, forced internal exile or execution.

Postby The Land of the Ephyral » Tue Sep 03, 2019 4:08 am

Does your nation's constitution protect freedom of speech? | In short, no. The Ephyral constitution is not a single codified document but rather an uncodified collection of statutes, legal precedent, the social perception of 'ancestral custom', and the Artalos Code, a founding document of law establishing the rights and duties of the citizens of the Senate and Freeborn Landholders of Ephyra. Freedom of speech does not as a specific clause or provision exist anywhere within the constitutional framework of the Freehold. There is however an indirect assumption through ancestral custom and the legal status of citizenship of possession of a liberty to speak unless status or law insists otherwise.

This concept, translated best as political or public (the public sphere is largely held as the political sphere in Ephyral culture) liberty, is a trait assumed on the part of citizens of the Freehold of Ephyra rooted in the fundamental idea of the integrity of their bodies as individuals leading to their autonomy and independence of mind. This mastery of the self includes the use of the mouth, and the words that leave it. In essence, despite no law, statute, or provision in the Artalos Code enshrining speech as an inalienable right, it manifests itself through the inviolability of a citizens personal liberty exercised in the public sphere.

Does your nation's government respect its citizens freedom of speech? | Through the means of this liberty, yes. A citizen can bring to trial any who attempts to infringe upon that liberty through silencing them, typically through physical force.

Are there any limitations on freedom of speech? | Yes. Speech uttered which is intended to cause public panic with no actual threat present is prohibited, a direct threat of violence against an individual, especially women, children, and elected officials of the state is prohibited, and speech which on religious analysis may be regarded as an attack upon the divine peace between the Ephyral and the gods is regarded as a crime of atheism.

However, the greater limitation on speech occurs by status of the speaker, not the content of the words. Political or public liberty enshrines as mentioned the physical integrity of the citizen, protecting them from abuse or from compulsion. This concept is tied to the ability to govern oneself, therefore voluntary subjection of one's body to others is considered a waiving of this liberty. Legally, this concept manifests as disenfranchisement as a result for certain crimes or behaviours which demonstrate this lack of self-governorship, and expulsion from the political liberty necessary for participation. However, this political liberty only exists in the first place for a small group. Adult male citizens. These disenfranchised citizens alongside non-citizens, i.e holders of the Lykosian rights, foreigners and their descendants, provincial subjects, and most totally slaves (who are subject to total nonperson-hood), are without political liberty as well as other rights and protections. They can be subject to corporal punishment, and crimes against their body are of less significance (still weighed on a scale and subject to the weight of other legal concepts). The consequence for speech however is that as these groups lack political liberty, they are also not able to bring anyone to trial for an act which a citizen could cite as violating his liberty for silencing him.

In a middle-ground of this sit women, who by the receptive nature of their sex inherently forfeit any claim to political liberty and mastery of the self. Unlike non-citizens, they cannot be subject to corporal punishment and crimes against their bodies are held most severely due to the laws regarding female guardianship and their citizen status beyond the concept of liberty. However, in the public sphere, a woman's voice is simply irrelevant.

Are citizens allowed to criticize the government and voice their opinions freely without fear of government retribution? | Whilst such criticism and opinions are not supported by direct force in violation of the sacrosanct process of elections, and do not contain within them threats of violence against the elected officials, no retribution will come for this criticism.

Does your nation's constitution protect freedom of speech? Shalotte has no formal constitution. Technically speaking, the word of the Domnaeni is final, and no laws can supersede her authority. A constitution, even one penned and passed by a Domnaeni personally, would therefore be superfluous. That said, Shalotte has a strong tradition of political engagement, and in practice the Domnaeni has devolved most of her legislative powers 'in trust' to the Gaeltyn, which historically has not interfered in the free speech of Shalottes.

Does your nation's government respect its citizens freedom of speech? Yes, it does, and a Living Right Commission as well as an independent judiciary ensure that the potential for abuse is minimal.

However, only Parliament may by law impose temporary restrictions, and only as it deems necessary in the interest of the security of the Federal Republic or any part thereof, friendly relations with other countries, public order and restrictions designed to protect the privileges of Parliament or of any Legislative Assembly or to provide against contempt of court, defamation, or incitement to any offence.
