Porn actually takes its copyright very seriously
Many sites even have clauses when you sign up for them saying that if you share paid content you’ll have your account deleted and face possible legal action

Pornhub absolutely can be blamed. It's their website, they decide who can upload what videos. They could limit uploads to verified performers and companies.

It would destroy the very foundation of Pornhub and cause a crisis in the porn market as people search for a new site for their homemade porn to be uploaded.
The problem with Pornhub isn't in their company or their idea, but rather inevitability of letting people upload homemade porn resulting in some piracy. However I argue that that right should be held sacrosanct for uploaders, however I do believe a team or bots could be made to analyze if things were pirated.

Look up the Safe Harbour Law. As long as PornHub is trying to do something about it, the company can't be held responsible.
Someone else mentioned how porn sites take piracy very seriously too.
