Their hope is if it passes the Supreme Court will overturn the Obergefell decision that somehow the 14th amendment doesn't apply to LGBT people. A county clerk is a government employee. They cannot decide what law they will and will not enforce.

I am well aware of that; I don't think the plan will work.

What do you mean by somewhat agree? Do you mean you agree with the concept or what?

I believe that if this should be passed, it should only apply to those whose religion forbids homosexual acts. Others whose religion or lack thereof doesn't forbid homosexuality can do it.

Denying someone's feelings on the basis of religion is still fucked up. Especially when that religion has a "Believe or you will burn" penalty to it.

I guess asking. Or some kind of way to find someone's religious identification. I wanna say some kind of physical identification.

So basically this law would be completely unenforceable as well as oppressive. Got it.

Hmmm you maybe on to something. We should make all Muslims wear red crescents on their clothing so we can identify them.

The last time something like that done was pretty bad.

Yeah that last sentence was something I was thinking about, too. But:
1: Those badges weren't specifically what I was thinking about.
2: My intent is different.

Well then let me break it down for you. Unless we were to go full authoritarian and force people to start wearing badges based on their religion(remember what happened the last time a country did that?) this law would be unenforceable. Someone could just lie and say their atheist. And besides the government should not be doing this kind of stuff. If someone wants to follow parts of their religion and ignore others that is their business no one else's.

Intent and practice are not always aligned. Anything with labeling is usually a bad idea.

If you need laws like banning same sex marriage.....your faith is rather weak.

A Republican SCOTUS can revoke the previous ruling, although I doubt until Roberts is replaced they will. That they never have speaks volumes about their convictions on a personal level.
