Can be considered a crime but are not a recognised defence, unless such words were of a personal nature, in which case it may reduce the severety of the crime but not wipe it out entirely.

Problem is, they could be called back to work at literally any point.

Either they stay with the coastguard and wait on tender hooks for the deal that could happen without much warning, or they could leave, find another job (doubtful btw), and when the deal is made suddenly the coast guard is severely understaffed.
