Semi-Legal in the Principality of Dushan. There are some loopholes in Marriage legislation which do allow People of the same Sex to marry, given they're finding somebody who's going to perform the official civil ceremony which is not really a problem as some Munticipalities have specialized into offering that Service.

While there are no specific laws against same sex marriages, it is just something that is discouraged by the elders and so the people don't do it.

Marriage between any two individuals is perfectly legal. In fact, the only thing that is not okay is polygamy - there was an attempt to make it as legal as any other marriage, but it proved to be too troublesome.

Same sex marriage is de facto legal - there's never been any specific law passed for or against it, nor any cultural reason to discriminate against same-sex couples.

As The Republic of The Highlands was founded on Christian doctrine, its constitution criminalizes exploitative and demeaning sexual behaviours since these practices contradict God's purpose for us all. A marriage between two men or two women is, therefore, a criminal act.

Same sex marriage has never been illegal in the Arthurian Federation. No law has ever explicitly abolished or denied it. However, it only became legally protected in 852 A.R. (1762 AD) when the Marriage Act was passed through the Alting. This act, jointly proposed by all cantons, was designed to bring different marriage laws across the federation into line with one another. Part of this involved legally recognising the right of same sex couples to marry with equal rights as their fellow citizens. It did not rule for adoption, which remained unregulated apart from the separate cantonal laws which attempted to improve conditions for orphans, not to determine who could become their guardians or parents.

Prior to the Marriage Act, same sex relationships and liaisons were commonly accepted and practised by up to 15% of the population (based on historical evidence, mainly from literature and contemporary newspaper articles). These relationships were expected to be limited to one's youth, however. Because the Arthurian Isles were fairly inhospitable, the duty of siring a child was taken seriously as a means of securing the country's future. With that came the attendant expectation of marriage, though extramarital children were not frowned upon. In this atmosphere, to continue a same sex relationship past one's youth was considered frivolous or decadent. Same sex relationships were confined to the late teens and early twenties. There were, however, still some noted same sex marriages and by the beginning of the 9th century A.R. (the 18th century AD) they were becoming more common in the growing cities. It was also not unheard of for men or women to marry in order to birth a child while keeping a same sex partner outside of that marriage. This practice was less common because while same sex relations were not frowned upon, extramarital ones were (though again, they were not illegal). By the time of the Marriage Act, the population of the Arthurian Isles had been growing at a fast enough pace for society to look less unkindly upon same sex marriages, hence their inclusion in the Marriage Act.

Same sex adoption was only provided for in 1072 A.R. (1982 AD) by an amendment to the Adoption Act of 1069 A.R. (1979 AD). The Adoption Act had been the first time that the rights and duties of foster parents had been regulated for at the federal level and was arrived at because of a consensus amongst the cantons that family rights had to be equal across the Federation. The initial act had not mentioned what gender, gender identity or sexual orientation the parents or guardians of orphans had to be. This led to one adoption agency rejecting a non-binary man and his husband from adopting because their systems could not provide for that specific identity. The case was taken to court and the judges found in favour of the couple. Subsequently, the Folkting and the Landting amended the Adoption Act as required.

Fertilisation rights were granted before any IVF techniques had been introduced to the Arthurian Federation. By the In Vitro Fertilisation Act of 1069 A.R. (1979 AD) (the same year that the Adoption Act was first passed), the Alting hoped to regulate what they imagined would become an important process of reproduction. Their prediction proved correct, and the initial act conformed with gender identity and sexual orientation provisions already found in the Marriage Act from 852 A.R. (1762 AD). From the start of IVF in Arthuria, same sex couples were therefore entitled to the same legal rights as their fellow citizens.

I'm not sure what to say about my nation exactly. I subscribe to the controversial historical views of John Boswell. His thesis is that the early Christian Church was neutral on homosexuality and that during the early middle ages there was a thriving gay culture in (Christian and pagan) Europe. Even at one point, there was a sort of blessing for same sex couples called athelphopoesis. Not until the 11th century do we really see homosexuality being massively persecuted. So it is true during the high middle ages and onwards, homosexuals were persecuted even to the point of being punished with execution for their love. But not all of European history post-theodosius was like that, as so many think. My plan is to either say Nioya maintained it's gay culture or that homosexuality was never persecuted. I'm not sure how to fit gay marriage into that history.

Timeline:
2003 - The Court of Final Appeal decides that a terminally ill man can marry his longtime partner despite the Precinct Registrar objecting because there is no law defining marriage or prohibiting it therefore it is constitutional

2003 - South Buneh Precinct Registrar changes marriage license applications to be genderless

2004 - Central Buneh and East Precincts change marriage license applications to be genderless

2008 - Legislators representing Kawungam Precinct introduce constitutional amendment to define marriage as between man and woman. Bill does not get passed by necessary 3/4ths vote; however, meets the 50+1% requirement to pass as resolution of government position.

2009 - Court of Final Appeal rules that as same-sex marriage is not unconstitutional but the government position is to not allow it, then the precincts must allow Civil Unions equalized to marriage.

Since the 1994 revisions of our law to eliminate unnecessary sex-specific language, our marriage law makes no distinction as to the sexes of those marrying. Any two people able to swear a binding oath may marry, and all marriages are treated the same under law.

Marriage is between two people by definition, but the law does not require a marriage to exclude other marriages, so it is lawful for a person to be married to more than one other person, of any sex, if the specific marriage oaths they swore allow for it.

A referenda legalised it in 2002. 64.9% supported it, while 35.1% opposed it, with record turnout.

One of the six members of the National Council, Natalia La Blanc, is openly lesbian, having married her significant other in the Vanir Islands in 2014.

Historically, Hangrettya has native religions that treat homosexual love very naturally. In the Bhionist religion, they believe the gods Boh and Hai conceived a homosexual son named Boóhai who sowed the Earth with life and love.

Since 2010 homosexual marriage is legal in every place in country and adoption has been legalized recently. In Hangrettya we are all comrades of the revolution, it does not matter what you go to bed, as long as it is between consenting adults.

Legal and fairly common, though we are a very large nation so its seeming regularity may just be proportional to our population's size.

The State Religion of the Empire, Luciellanism, does not define marriage at all, while Imperial Law simply states it is the union of two peoples emotionally connected. As a practice it is as old as the Imperial peoples, predating the current Empire and the current political states entirely.

Surprisingly despite heavy restriction of many civil liberties in Dres Van, same-sex marriage and all merits to it have been legal since immemorial. By legal it means there are no laws condemning or prohibiting such act. It only became publicly acknowledged when the new Prince came to power. Perhaps having a gay head of state in a semi-totalitarian government is a wishful thinking. :rofl:
