Common use Nation name: China
Government type: Democratic republic
Economic system: Free-market economy, with some public sector
Head of State: Kao Tsi-jen (President)
Head of Government: Lee Hsiao (Prime Minister)

Do you have democracy? Yes.
Are your Nation's leaders elected by vote? The President is indirectly elected, the Prime Minister is appointed by the President ceremonially, but is responsible to the directly elected legislature.
Is the legislature an independent branch of government? Yes.
Do the people elect representatives to a legislature? Yes.
Are there two or more parties in your legislature? Yes.
Are elections open to all? Open to all eligible electors, which exclude minors and the mentally unsound.

Does your nation have:
Freedom of speech? Yes.
Freedom of thought? Yes.
Freedom of association? Yes.
Freedom of the press? Yes.
Freedom of religious expression? No -- this is part of freedom of speech.
Freedom of assembly? Yes.
Freedom to protest? There is a right to communicate with executive, legislative, and judicial agencies for redress of grievances.
Right to bear arms? No.
Right to a trial by jury? Trial is by bench, though a system of juries is being introduced.
Innocent until proven guilty? Yes.
Right to a fair and speedy trial? Fair, yes. Speedy, only to the extent that nobody is using the judicial system as a prison for a victim.
Right to have legal representation in trial? Yes.
Equal protection under the law? Yes.
Equal gender rights? Yes.
Right to privacy? Yes.
LGBT rights? Not explicitly protected. The Constitution states that "all other freedoms and liberties are protected, except as regulated for a great and demonstrable national interest otherwise," as a blanket provision. LGBT rights are covered by this article.
Right to nationality? Yes; ius san(guin)is and ius solis exist in parallel to eliminate statelessness.
Equal rights independent of race/ethnicity? Race is not recognized in legislation. Ethnicities, defined on a cultural/linguistic basis, are protected. Minorities are given especial concessions.

Are hard drugs legal? No.
Are porn and Prostituition legal? Technically, no. But the legislations stipulating penalties for production of pornography and prostitution (at least not in the open) have become disused.
Is internet, radio and/or TV allowed? Yes.
Do your nation uses the Death Penalty? No.
Does your nation prohibits Interracial Marriage/Relationship? No.
Is the internet, radio and/or TV in your country accesible to everyone, also for people outside of your country? Yes, but as a matter of fact, China has a computer standard that's largely incompatible with most foreign networks, so adapters must be used if the Internet is to be accessed; these adapters are government-subsidized.
Your nation Average Tax Rate? 32%, progressive for the rich, to a limit of 75%, before deductions.
Are private industries legal? Yes.
Is gambling legal? Technically no. But nobody actually cares about this.

Do you have any question about CAFRI? No. :p
IC Title: the Republic of China | MT | Factbooks | the only democratic China on NS
The duty of the state is to prevent danger, not to punish it after it has happened. Rescind the 2nd Amendment, today.

LGBT rights? I guess so, but they are not really categorised in this way, a marriage has always been the legally or formally recognized union of 2 people, as partners in a relationship, and the religions have always accepted this, because everyone is not categorised like this. Everyone accepts LGBT, and they are not seen any differently by the people than a normal straight couple, so LGBT rights aren't needed to be enshrined into law as such, because they were always there.
Right to nationality? Yes
Equal rights independent of race/ethnicity? Again, we don't categorise people by race or ethnicity, so yes I guess

Do your nation uses the Death Penalty? No
Does your nation prohibits Interracial Marriage/Relationship? No, people aren't identified in this way
Is the internet, radio and/or TV in your country accessible to everyone, also for people outside of your country? Yes, the terrestrial channels are. Postby Imperium Sidhicum » Tue Jan 19, 2016 4:24 pm

Full Nation name:Imperium of Sidhae
Common use Nation name: the Imperium
Government type: monarchy/stratocracy
Economic system: planned economy, some private enterprise allowed
Head of State: the Empress
Head of Government: the Empress

Do you have democracy? To some degree. Officials of the civil administration are elected democratically, military officials attaining their office by promotion or appointment. Every Imperial world and a number of prominent organizations have representatives in the General Assembly, who are for the most part democratically elected (with the aforementioned exception of military officials). The final say in all government affairs, however, belongs to the Empress.

Are your Nation's leaders elected by vote? Technically yes, the monarch is elected for life according to the Statutes. In practice, however, the Imperium is yet to experience elections of a national leader, the Empress having attained her office in result of a lengthy civil war.

Is the legislature an independent branch of government? Technically yes, the cabinet of Ministers who do much of the actual day-to-day governance and the General Assembly being two separate entities. In practice, however, no law can pass into effect without the monarch's approval, the monarch can also issue laws by decree, and ministers also partake in General Assembly sessions, somewhat blurring the distinction between the legislative and executive branches.

Do the people elect representatives to a legislature? Yes, most General Assembly representatives are in fact elected.

Are there two or more parties in your legislature(how many)? No. The very notion of political parties or political plurality is anathematic to Sidh politics and ways. Political parties by definition imply representation of a particular ideology or interest group rather than serve the interests of the nation as whole regardless of their number, which contradicts the Sidh cornerstone principle of national unity in all things and especially politics.

Are elections open to all? Elections and other political processes are open to full citizens, who have earned the privilege through a minimum of three years military service. Any Sidh who desires to partake in politics or make a career in the government apparatus is free to enlist and prove his worthiness of deciding the future of the nation through risking his life in service of the fatherland.

Does your nation have:
Freedom of speech? Sure. Imperial citizens enjoy considerable personal freedom when it comes to expressing themselves. Restrictions apply to incitement to commit a crime - which includes promotion of unpatriotic and un-Sidh ideas and views.
Freedom of thought? Of course. Citizens may think what they want - as long as they keep the unpatriotic and un-Sidh part of their thoughts to themselves.
Freedom of association? Associating with known traitors and enemies of the Imperium is strictly forbidden. Associating with known defeatists, enemy sympathizers and political dissidents is not illegal, but unwise if one wishes to make a career.
Freedom of the press? All media is owned by the state, so there's no need for censorship - undesirable views and ideas aren't even held, let alone published, by anyone employed in media outlets.
Freedom of religious expression? Sidh society has long rejected such obsolete superstitions, and even if it wasn't the case, religions would not be tolerated by the Imperial authorities as divisive and contrary to the official ideology.
Freedom of assembly? Sure, as long as such assembly isn't held for the purpose of committing a crime (including political crimes).
Freedom to protest? As long as these protests are kept civilized and do not devolve into riots, Imperial citizens are free to express their concerns. However, given the general culture of conformism and discipline, Sidhae don't usually make a habit of questioning authorities or protesting against their decisions.
Right to bear arms? To a Sidh, bearing arms isn't a right - it is a duty. Every Sidh is required by law to learn at least basic military skills and proficiency with firearms. Most, however, do not own any personal weapons out of a simple lack of necessity.
Right to a trial by jury? No. A single justicar or a collegy of three justicars can judge cases more effectively than a jury.
Innocent until proven guilty? Yes.
Right to a fair and speedy trial? Yes.
Right to have legal representation in trial? No, at least in criminal cases. A citizen suspected of a crime will not normally be arrested until the authorities have accumulated a damning amount of evidence of his guilt, so whenever a Sidh is brought before a court of law, he is virtually assured to be convicted. Legal representation is reserved for civil cases, where the purpose is to resolve legal disputes rather than punish breaches of the law.
Equal protection under the law? As far as Sidhae are concerned, yes. Non-Sidhae aren't considered Imperial citizens and have no legal protections whatsoever asides from informal agreements and customary rules.
Equal gender rights? Gender equality is so self-evident in Sidh society that it isn't even given a special mention in Imperial laws.
Right to privacy? Technically yes, though it doesn't keep the authorities from discreetly keeping tabs on everyone, a fact that is common knowledge and deemed self-evident. Privacy isn't deemed very important by Sidhae whose culture evolved in the cramped quarters of starships and habitation modules of early space colonies, and was later reinforced by army barracks and hive-like residential areas of Imperium's cities.
LGBT rights? Sidh society rejects the notion of individual sexual preferences being something that merits special legal status or protection. Nobody cares what one sleeps with, as long as it is kept discreet, and the authorities do not deem it their responsibility to avert consequences of one's personal indiscretion.
Right to nationality? A resident of the Imperium either is a Sidh, or is not, there being no recognized nationalities other than Sidh.
Equal rights independent of race/ethnicity? As a common saying goes, there are Sidhae, and everyone else. Those within the "everyone else" group have no legal rights whatsoever. While that doesn't necessarily mean they are mercilessly abused and oppressed by Sidhae, fact remains that the Imperial laws extend their protections and privilges only to Sidhae, and a small number of exempt outsiders, such as diplomatic dignitaries, foreign merchants and "honorary Sidhae", outsiders who have earned the status through contributions to the Imperium and Sidh society.

Can the police indefinitely detain people? Yes, provided there is a lawful reason to do so (such as when the detainee is known to pose a threat to the public safety).
Are the police and military essentially the same? The Urban Security is heavily militarized, to the point of having it's own military-grade armored vehicles and attack aircraft, and is fully capable of waging low-intensity warfare on it's own, but it is not the same institution as the military.
Do police require warrants? No. A search of premises can be carried out simply on grounds of suspicion. If no evidence of wrongdoing is found, however, the subject can file a complaint and the officer who authorized the search will receive a disciplinary punishment. The subject will also be compensated for any damages potentially resulting from an unjustified search. Warrants are likewise not required for surveillance, since surveillance is already omnipresent. Access to an individual's case file where his activities are recorded, however, is restricted on a need-to-know basis, meaning security officials cannot arbitrarily access surveillance information without presenting a valid cause.
Do police require probable cause? Yes, and this principle is observed very strictly. The common practice is to track suspects without intervention until enough evidence is accumulated to assure immediate conviction, even if it means letting one commit more crimes. Only when the official in charge of investigation gives a go-ahead will the arrest be made.
Is torture allowed? Yes, and is widely practiced as means of punishment. While it is illegal to torture a Sidh, a Sidh loses his status upon conviction of a crime for the duration of the punishment, thereby making it legal to subject convicted criminals to any torture their jailers may deem appropriate. Torture is not normally used to extract information, at least not by law enforcement or legal authorities, given it's ineffectiveness.
Is the judiciary an independent branch of government? No, the courts operate under supervision of Ministry of Justice.
Is slavery legal? Enslavement of non-Sidhae is legal, if not necessarily widespread.
Are soft drugs legal? No. Sidhae generally hold very negative opinions about addictive and mind-altering substances, and that is reflected in the law as well.
Are hard drugs legal? See above.
Are porn and Prostituition legal? It is legal in itself. However, partaking in or directly profiting from the sex industry in any form is considered disreputable and is thereby forbidden to Sidhae under penalty of losing their Sidh status. In other words, a Sidh may freely use porn and the services of prostitutes, but may not partake in the production or distribution of pornographic material or engage in prostitution.
Is internet, radio and/or TV allowed? Uh... why wouldn't it be? How else are the authorities supposed to indoctrinate inform the citizens?
Do your nation uses the Death Penalty? Outside military justice, no. Sidh legal system prefers other punishments, to which death is often coincidental, but not the desired result.
Does your nation prohibits Interracial Marriage/Relationship? Legally, such prohibition is extending to producing mixed-race offspring. Socially, dallying with members of inferior species is deemed both disgusting and as setting a poor example. Not that this taboo has kept many lacking in moral fibre and faith in state policies from pursuing such relationships anyway, but a Sidh of note who would openly acknowledge a relationship with a human would surely have his/her reputation ruined.
Is the internet, radio and/or TV in your country accesible to everyone, also for people outside of your country? Yes, except for outside access - both because most of Imperium's immediate neighbors are open enemies of the Imperium, and because providing media coverage on interstellar distances is somewhat technically problematic.
Your nation Average Tax Rate? 63%. Considering how housing, healthcare and education is free, and every citizen is entitled to rations of basic commodities which include three meals a day, the remaining 37% of the income is more than enough to live a comfortable life.
Are private industries legal? In principle, yes. Most major industries are, however, owned by the state, and any private enterprises are eventually merged into the state companies, their original owners either remaining as managers of their particular facility, or moving on to start up new enterprises that will in time experience the same fate. Sidh businessmen do not deem the eventual state takeovers to be something undesirable - they see themselves as pioneers, creating something new and useful for the nation and nurturing it until it can become of proper use.
Is gambling legal? No. Organized gambling is a blight upon any society, serving to enrich an unscrupulous few at the expense of the gullible many. While it wouldn't be a problem in itself, because of it's exploitative nature it cannot be tolerated in a society striving for unity.

Do you have any question about CAFRI? Truth be told, it seems like another one of those polls devised to pat the "good" liberal democratic capital nations on the back and shame the "evil" non-democratic non-capitalist nations.
Freedom doesn't mean being able to do as one please, but rather not to do as one doesn't please.

A fool sees religion as the truth. A smart man sees religion as a lie. A ruler sees religion as a useful tool.

The more God in one's mouth, the less in one's heart.

Full Nation name: The Commonwealth.
Common use Nation name: The Commonwealth.
Government type: Theoretically, a federal democratic republic; in practice a democratic confederation. Parliamentary democracy.
Economic system: Mixed economy with significant presence of state-run enterprises.
Head of State: First Councilor Marion Berkanjang Landis (Conservative Faction, elected 2299).
Head of Government: First Councilor Marion Berkanjang Landis.

Do you have democracy? Yes.
Are your Nation's leaders elected by vote? Yes - with the exception of one member state, the Suskind Institute, whose Chancellor is elected by the unelected Institute faculty. The Chancellor and faculty members are subject to democratic recall, however, and elections for those positions may be forced under the right circumstances, making them semi-democratic.
Is the legislature an independent branch of government? Yes - although as the Commonwealth is a parliamentary democracy the executive is not independent of the legislature.
Do the people elect representatives to a legislature? Yes.
Are there two or more parties in your legislature(how many)? While the status of parties at the federal level is somewhat nebulous, there exist two de facto parties in the Commonwealth Senate: the Radical Faction and the Conservative Faction.
Are elections open to all? To an extent. Some member worlds receive Commonwealth protection and allow the Commonwealth to manage their foreign affairs, but their citizens are not enfranchised. This is because these worlds are classified 'associated states'. Should they successfully transition to full subject-republic status, their citizens will be enfranchised.

Does your nation have:
Freedom of speech? Yes, with the exception that speech that directly orders others to commit crime is an offence.
Freedom of thought? Yes.
Freedom of association? Yes.
Freedom of the press? Yes.
Freedom of religious expression? To a degree. For example, it is forbidden to wear a burqa or niqab in public.
Freedom of assembly? Yes.
Freedom to protest? Yes.
Right to bear arms? Usually, no. Exceptions exist, mostly on Mescalero, which has large and enthusiastic native fauna, but even then, weaponry is heavily regulated in urban areas.
Right to a trial by jury? No. Commonwealth courts are based on the inquisitorial system. A trial by jury may be convened if it is considered impossible for the inquisitorial court to return a fair verdict, for any of a variety of specific reasons.
Innocent until proven guilty? Yes.
Right to a fair and speedy trial? Yes.
Right to have legal representation in trial? Yes.
Equal protection under the law? Yes.
Equal gender rights? Yes.
Right to privacy? Yes.
LGBT rights? Yes.
Right to nationality? Yes.
Equal rights independent of race/ethnicity? Yes.

Can the police indefinitely detain people? No.
Are the police and military essentially the same? Not at the federal level, nor in any subject republic except Suskind, which does not have a formal military; its police force, the Suskind Security Service, is designated to take on defence responsibilities should they ever arise. Since this will only happen if Suskind is directly attacked, however, it has not yet presented practical concerns.
Do police require warrants? Yes.
Do police require probable cause? Yes.
Is torture allowed? No.
Is the judiciary an independent branch of government? Yes.
Is slavery legal? No. Some forms of indentured servitude were legal in the Hadassahan Alliance until its Pact of Association with the Commonwealth, whereupon they were outlawed as a condition of the treaty.
Are soft drugs legal? Yes.
Are hard drugs legal? Yes, with the exception of (a) those drugs which are known to induce physical aggression in a statistically significant percentage of users, and (b) those drugs from which withdrawal has been known to cause death.
Are porn and Prostituition legal? Yes.
Is internet, radio and/or TV allowed? Yes.
Do your nation uses the Death Penalty? The Commonwealth Charter allows (but does not mandate) the death penalty for the crime of unlicensed trade in aurium, a compound which, if misused, has a destructive force per unit mass significantly exceeding that of an atom bomb. However, the Charter also forbids the death penalty for any other crime.
Does your nation prohibits Interracial Marriage/Relationship? No, although there do not yet exist laws concerning marriage between persons of different species.
Is the internet, radio and/or TV in your country accesible to everyone, also for people outside of your country? As far as is practically possible, yes.
Your nation Average Tax Rate? Very roughly, c. 20%, but due to the confederal nature of the Commonwealth the tax situation defies explanation in many respects.
Are private industries legal? Yes.
Is gambling legal? Yes.

Do you have any question about CAFRI? Not at this time.
