RECOGNIZING that persons are not the only creatures capable of feeling pain;
ABHORRING the cruelty of causing unnecessary and excessive pain, stress, or fear to any creature, person or not;
UNDERSTANDING that non-person creatures lack legal agency and rights to defend themselves from the aforementioned cruelty, and;
UNDERSTANDING that non-person creatures usually lack the understanding to contextualize the reasons for their pain, stress, or fear which may intensify those negative stimuli;
WANTING to protect these non-person creatures from said cruelty,
the World Assembly hereby:
- DEFINES Non-Person Creature (NPC) for the purposes of this resolution as a living creature that lacks person-hood and the associated rights, but is otherwise capable of acting of its own volition and capable of feeling pain, stress, and/or fear;
- PROHIBITS the intentional and malicious infliction of harm or abuse to NPCs, including but not limited to:
- causing physical trauma or severe pain,
- maiming or otherwise disfiguring its body or mind,
- torture over a short or prolonged period of time,
- sexual assault,
- directly causing death,
- placing into a situation wherein it will be at great risk of any of the above forms of harm, and,
- acts of cruelty as deemed appropriate by the respective nation but only within said nation and territories under the rule of said nation's government;
- FURTHER PROHIBITS cruelty towards an NPC that has through some form to be under a person's authority, whether it be as a pet, a stock animal, beast of burden, or otherwise. Cruelties here include but are not limited to:
- failing to give it edible food as necessary for it to maintain good health when one has the means to provide it,
- failing to give it potable water as necessary for it to maintain good health when one has the means to provide it,
- failing to give it the ability to exercise as necessary for it to maintain good health when one has the means to provide it,
- failing to give it a reasonably clean environment to live in when one has the means to provide such an environment,
- failing to give it a reasonably safe environment to live in when one has the means to provide such an environment,
- failing to give it access to reasonable medical care that is within one's means to provide it,
- acquiring authority over more NPCs when doing so would cause a real reduction in ones ability and access to the means to provide for any current NPCs under one's authority, and,
- again including all cruelties as indicated in 2;
- CLARIFIES that the following exceptions to acts that would otherwise be deemed prohibited for their cruelty to NPCs by this proposal are NOT PROHIBITED so long as the actions taken against the NPCs as otherwise exempted are not excessive for what is necessary and within the means of the persons performing the action:
- Veterinary medicine,
- Animal research,
- Animal husbandry as necessary to maintain a ranch, zoological garden, or similar,
- Hunting and fishing,
- Butchering or slaughtering for useful parts and food,
- Pest control,
- Protecting an environment from invasive NPCs,
- Self defence against an NPC,
- Utilization of properly trained and handled NPCs for potentially dangerous situations or occupations,
- Acts nationally recognized as holding significant cultural or traditional value within a nation that are endorsed by the respective nation's government, and,
- Acts internationally recognized as within the rights of a person to perform to an NPC;
- ENCOURAGES member nations who have nationally recognized traditional cultural practices that through 4.j. grant exception to 2. or 3. with regards to treatment of NPCs to evaluate possible alternatives to such practices, understanding they are under no onus to actually put these alternatives into action as per this resolution;
- REMINDS member nations that though exceptions exist in this resolution as per 4. that they are NOT RESTRICTED from bypassing certain exceptions and enforcing more strict rules for the protection of NPCs so long as these rules do not contradict international law.
