[DRAFT] [Replacement] Protections for Non-Person Creatures

In a smaller side-room of the WA building, the lady ambassador from Sobaira began work on improving her skills with proposals for the WA. She started with her ideas on a replacement for a proposal that was the target of a repeal, thinking it would give her a suitable handicap to get the hang of writing resolutions. This said, she presented her most recent drafts, as there were now two of them that approached the topic in different ways:

Added another alternative option after thinking of the case where consumption isn't reasonable after a NPC dies as a result of an otherwise cruel act.

RECOGNIZING that persons are not the only creatures capable of feeling pain;

ABHORRING the cruelty of causing unnecessary and excessive pain, stress, or fear to any creature, person or not;

UNDERSTANDING that non-person creatures lack sufficient means to protect themselves from said cruelty, and;

WANTING to protect these non-person creatures from said cruelty,

the World Assembly hereby:

  1. DEFINES a "Non-Person Creature" (NPC) for the purposes of this resolution as a living creature that lacks person-hood and the associated rights, but is otherwise capable of acting of its own volition and capable of feeling pain, stress, and/or fear;

  2. DEFINES a "greater end" for the purposes of this resolution as a result of an action that does one of the following:
    1. Fulfils a long-standing, nationally recognized, cultural or traditional behaviour,
    2. Provides a material good for trade or consumption that has a reasonable attempt to be used as such,
    3. Does not significantly decrease the quality of life, or would significantly increase the quality of life of the NPC(s) to whom the act that this greater end applied,
    4. Secures the well-being of a person or NPC, or multiple thereof,
    5. Furthers science, grants knowledge, or promotes progress,
    6. Protects a person's, state's, or organization's livelihood, home, or belongings,
    7. Protects the environment from an invasive species,
    8. Permits a person to not have to perform an act that would put them in danger of serious harm in such a case where the NPC is reasonably trained, handled, and capable of performing it, or,
    9. Fulfils a function as permitted by international law;
  3. DEFINES a "cruel act" for the purposes of this resolution as either:
    1. An action that intentionally makes a NPC experience excessive pain, stress, and/or fear; or intentionally decreases the health of a NPC, and isn't done towards a greater end,
    2. A lack of action that makes a NPC that is under one's responsibility, authority, or ownership experience excessive pain, stress, and/or fear; or suffers a decrease in health in a way that isn't towards a greater end when one has reasonable means and ability to have performed that action;
  4. PROHIBITS AND FORBIDS performing a cruel act;

  5. ENCOURAGES member nations, who have through 2.a. exceptions granted, to evaluate alternate ways of performing the cultural act that would not negatively impact NPCs as it would in its current state;

  6. REQUIRES member nations, who have through 2.a. exceptions granted, to:
    1. Enforce on persons whom when performing an otherwise cruel act that the NPC survives, to make a reasonable effort to improve the well-being of the NPC back to before the act was performed,
    2. Enforce on persons whom when performing an otherwise cruel act that the NPC does not survive, to use as much of the NPC's body for consumption as reasonably possible or otherwise treat the remains in a respectful manner;
  7. ENCOURAGES member nations to take reasonable steps to prevent persons with a history of performing cruel acts from gaining or maintaining authority, responsibility, or ownership of NPCs while there is reasonable belief that said person will continue to perform cruel acts.

    2. One's personal satisfaction at the act when it is not also part of a long standing cultural tradition that has at least national recognition;
  4. PROHIBITS AND FORBIDS performing a cruel act;

  5. REQUIRES persons who during their ownership, authority, or responsibility over NPC(s) employ said NPC(s) in some occupation to provide the NPC(s) with training, handling, and support as is reasonably within their means to reduce dangers to said NPC(s);

  6. ENCOURAGES member nations to:
    1. Enforce on persons whom when performing an otherwise cruel act that the NPC survives, to make a reasonable effort to improve the well-being of the NPC back to before the act was performed, or,
    2. Enforce on persons whom when performing an otherwise cruel act that the NPC does not survive, to use as much of the NPC's body for consumption as reasonably possible or otherwise treat the remains in a respectful manner;
  7. ENCOURAGES member nations to take steps to prevent persons with a history of performing cruel acts from gaining or maintaining authority, responsibility, or ownership of NPCs while there is reasonable belief that said person will continue to perform cruel acts;

  8. ENCOURAGES member nations with long-standing nationally recognized cultural traditions which offer exception and make acts only otherwise cruel to evaluate alternate ways of performing the cultural act that would not negatively impact NPCs as it would in its current state.


To those who would pay her mind and give her time, she spoke, "Thank you, honourable ambassadors, for your time with going over with me this to be my first... if even not of in the case of pushing it, at least, proposal. I apologise for mistakes that may be of the grammar or spelling, this language is not my first. I am open to all input, suggestions, and criticisms. This, so to say, replacement proposal, has been drafted with being of improving on another resolution, and to be addressing issues brought up about it that opponents felt the honourable legislator unable or unwilling to address."

She then clarified, "While I am of writing this, I am not of wanting to push it forth while the aforementioned honourable legislator is still of working on their proposal, barring something in overwhelming support from those who would have been of opponents to their proposal. This is primarily for me to be practising the writing of proposals for this august body, not to be of usurping the efforts of another."

On a desk topped with cluttered documents to the side she kept notes on older drafts, as well as the older drafts themselves, for those who would wish to look over them.

A second approach is drafted, more lenient, essentially forces nations to define NPC abuse themselves, but then make their NPC abuse laws internationally public through PRO-NPC. A better approach? Maybe. Sobaira would much rather it not come to this, but it is... here.

UPON FURTHER INSPECTION, redrafting and a B2 is needed. It feels that this does too little. Which... is kind of the point, but this feels poorly written and unsatisfying. Even for practice in awkward not in favour stuff, may as well do it better and better.

UNDERSTANDING that international legislation on this subject is difficult due to differing moralities, cultures, ethics, et cetera, and;

WANTING to cut bureaucratic red tape and put an end to the resolution/repeal cycle that follows this topic,

the World Assembly hereby:

  1. DEFINES a "Non-Person Creature" (NPC) for the purposes of this resolution as a living creature that lacks person-hood and the associated rights, but is otherwise capable of acting of its own volition and capable of feeling pain, stress, and/or fear;

  2. DEFINES a "good cause" as an intent behind an action that the member state explicitly espouses as permitted with regards to being performed on a NPC, including functions permitted by international law.

  3. DEFINES a "cruel act" for the purposes of this resolution as either:
    1. An action that intentionally makes a NPC experience excessive pain, stress, and/or fear; or intentionally decreases the health of a NPC, done without good cause,
    2. A lack of action that makes a NPC that is under one's responsibility, authority, or ownership experience excessive pain, stress, and/or fear; or suffers a decrease in health in a way that is without good cause when one has reasonable means and ability to have performed that action;
  4. PROHIBITS AND FORBIDS performing a cruel act;

  5. ESTABLISHES the "Protections and Regulations Organization for NPCs" (PRO-NPC);

  6. TASKS PRO-NPC with the following duties:
    1. Create an up to date depository for laws of member nations directly related to NPCs, specifically on what the member nation constitutes as a 'good cause',
    2. Make publicly and easily available the laws so gathered, and,
    3. Establish systems and create tools to help persons with browsing the depository to find specific laws therein;
  7. REQUIRES members nations to be cooperative with sharing their relevant legislation with PRO-NPC;

  8. REQUIRES member nations to not block access to the information made available by PRO-NPC;

  9. ENCOURAGES member nations who define one or more good causes solely or primarily on cultural reasons to evaluate alternate ways of performing the cultural act that would not negatively impact NPCs as it would in its current state;

  10. ENCOURAGES member nations to:
    1. Enforce on persons whom when performing an otherwise cruel act that the NPC survives, to make a reasonable effort to improve the well-being of the NPC back to before the act was performed, or,
    2. Enforce on persons whom when performing an otherwise cruel act that the NPC does not survive, to use as much of the NPC's body for consumption as reasonably possible or otherwise treat the remains in a respectful manner;
  11. ENCOURAGES member nations to take steps to prevent persons with a history of performing cruel acts from gaining or maintaining authority, responsibility, or ownership of NPCs while there is reasonable belief that said person will continue to perform cruel acts.

Modified final 'ENCOURAGES' to also encourage stopping those who already have NPCs from keeping them. Also some grammar fixes.

Edit to some permissiveness to now permit confronting a NPC to protect the belongings of a state or organization where said protections were not present before.

Mostly just some formatting changes to make it read better. Also by splitting up conjoined clauses, future potential repeal attempts ( and general discussion ) will have an easier time addressing concerns as well.

Slight change in wording should make things less restrictive on butchering and similar; now if they fail to have a good used or traded they aren't breaking the resolution. They originally would have been. Oops.

Added another 'ENCOURAGES' section. May be too much to keep support if this becomes a proposal? May not be enough. Unsure if should be stronger or weaker means 'ENCOURAGES' is probably fine. Perhaps 'URGES' instead?

If the NPC was killed as part of the act, instead of improving its well-being the member nation IS REQUIRED to enforce the utilization of as much of the NPC's body for consumption as reasonably possible.

Threw back in older draft's inclusion of ENCOURAGES to shore it up a bit. Considering now reducing its strength, but haven't yet.

    3. Does not significantly decrease the quality of life of the NPC to whom the act that this greater end applied,
    4. Secures the well-being of a person or NPC,
    5. Furthers science, grants knowledge, or promotes progress,
    6. Protects one's livelihood, home, or belongings,
    7. Protects the environment from an invasive species,
    8. Permits a person to not have to perform an act that would put them in danger of serious harm, and,
    9. Fulfils a function as permitted by international law;
  3. DEFINES a "cruel act" for the purposes of this resolution as an act that intentionally makes a NPC experience excessive pain, stress, and/or fear; or intentionally decreases the health of a NPC, and isn't done towards a greater end;

  4. PROHIBITS AND FORBIDS performing a cruel act.

To those who would pay her mind and give her time, she spoke, "Thank you, honourable ambassadors, for your time with going over with me this to be my first... if even not of in the case of pushing it, at least, proposal. I apologise for mistakes that may be of the grammar or spelling, this language is not my first. I am open to all input, suggestions, and criticisms. This, so to say, replacement proposal, has been drafted with being of improving on another resolution, and to be addressing issues brought up about it that opponents felt the honourable legislator unable or unwilling to address."

She then clarified, "While I am of writing this, I am not of wanting to push it forth while the aforementioned honourable legislator is still of working on their proposal, barring something in overwhelming support from those who would have been of opponents to their proposal. This is primarily for me to be practising the writing of proposals for this august body, not to be of usurping the efforts of another."

"Honourable ambassador, I was of hoping that the level of changes would perhaps be in this enough to avoid the worry of plagiarism. If this is of too close to that proposal, then I would be having question; how different does a proposal need to be to be of covering the same idea as another in as of fanciful replacement? I am not quite sure of this, it feels as though there are only so many ways to, er... so to say, skin a cat, yes?" she made a small grin at her choice of idiom, to bring in some levity even if she didn't quite get the idiom right.

Just a personal nitpick with it though: I never much liked proposals which in one section set up some nice goody-two-shoes stuff and in the next section clarified that it did not apply to: [a, b, c, d, e, f, g, h, i, j, k, l, m, n, o, p, q, r, s, t, u, v, w, x, y, and z]. You may as well build a wall, keep knocking holes in it until it is no longer a wall, but due to the first section, still call it one.

She nodded slowly, "Honourable ambassador, while I can be of understanding the 'nitpick', it is of feeling that the context of an action are important for the legality of it. It is of feeling as of, so to say, a necessary evil, to include of such things with legislation such as these. An inherent problem with... 'Moral Decency' in particular, I am thinking, too is that of wanting to establish a base wall. I am agreeing, that it will not be as of large wall without exceptions, but maybe is best to not have wall that large."

She paused for a moment, and thought of what she had just said, lightly drumming her fingers on a desk, "Maybe there is way to make right size wall without having to be of building it large and tearing it down to good size. I will be of looking into how to be doing that. Thank you very much, honourable ambassador, for your input and your time. I am of great appreciation for it."

And with that, she began to attempt to work a way out to address the issue with less clutter. There had to be a way, right?

The present draft is decidedly less protective of animals than the version I proposed, if for no other reason than it allows animal bloodsports and other "cultural" practices of animal cruelty and violence. My delegation would have a hard time supporting that.

I feel that in light of the present text here (fourth draft) - which essentially prohibits causing pain, stress, or fear except where doing so confers some benefit - this may be only a "mild" proposal.

"Honourable legislator, your time and cooperation with my practices being here are of great appreciation," she made a formal gesture from Sobaira, not entirely dissimilar to a bow, as a sign of respect. "You are not of being wrong with your conclusion, it is weaker than your proposal, a regrettable state if it were to be put up as proper of proposals. I am hoping that it does not come to that; a fixed version of your proposal is desirable by myself and my nation over this. But, in the unlikely feeling but possible case where there is of problem getting your new proposal through... this is of being better than nothing."

"Strength violation, however, hrm..." she pondered and looked at the draft. She felt it stronger than her older drafts if only for the explicit part of 'long-standing' cultural practices, making it still ban the creation of new cruel cultural practices as a means to get around... but that did still permit a variety of old cruelties. Perhaps she could include the 'ENCOURAGES' part from some of the first drafts? She drummed her fingers upon the desk, "I will be of seeing what I can do about that. Thank you again, honourable legislator, and best of the hopes that your stronger resolution becomes law."

We feel this is a fine draft that manages to work with the previous legislation's aims and apply them to the reality of the diverse and different nations within the WA.

We only have one (minor) issue, with this piece here:

Perhaps the good ambassador should change this to:

Does not significantly decrease the quality of life,or would significantly increase the quality of life of the NPC to whom the act that this greater end applied,


We feel this would more explicitly cover invasive acts of veterinary treatment. Taking your pet cat to the vets could be considered a cruel act, but afterwards, the cat would have a significantly better quality of life.
As an editor I seam to spend an awful lot of thyme going threw issues and checking that they're no oblivious errars. Its a tough job but someone's got too do it!

We feel this would more explicitly cover invasive acts of veterinary treatment. Taking your pet cat to the vets could be considered a cruel act, but afterwards, the cat would have a significantly better quality of life.

I would point out that allowing animal cruelty for "religious" reasons was one of the things that got the original animal abuse resolution repealed. viewtopic.php?p=9214497#p9214497

She took several long moments to recompose herself before speaking again, "Honourable legislators, ambassadors, and delegates. In light of recent legislation, an additional caveat is to be of found for the 'earliest' this could be possibly be pushed forward. I am not of any delusion to say that I would be of having an argument beyond one based primarily upon either emotions, ethics, or morals for why this would be of international note. There are small arguments that could be of made for minute parts within the larger proposal that you may have been finding possibly satisfactory, maybe, but I am not of believing that you would. It could be of satisfying most of the, how you say, 'animal rights crowd', saving up legislative time for other issues as no more would be for this," she said with a bit of a defeated shrug. "Now, I am of assuming you are thinking that maybe this is a poor argument, and you are perhaps right. While this would be of compromise, the more adamant activists and sovereigntists would both be of frustrated with this draft if it were to become law. That, and of the thought that maybe they will be giving up, or you are willing to keep up the fight against it even if they are not of said.
