The Nician declaration of the rights of sentient beings

Preamble:
The representatives of the Nician people being the senate and house of representatives, considering that ignorance, forgetting or contempt of the rights of sentient beings are the sole cause of public misfortune and of the corruption of governments, resolve to solemnly declare, the natural, inalienable and sacred rights of all sentient beings, so that this declaration may be constantly presented to all people to point out without pause their rights and duties; so that acts of legislative, executive and judicial power can be instantly compared with these rights and duties. It is also resolved that these rights and duties shall be upheld with the full force of law within the nation and protectorates of Novus Niciae.

Article I - All sentient beings are born and remain freemen. And that that this freedom can never be removed by any means.

Article II - The goal of any political organization is the conservation of the natural and inalienable rights of sentient beings. These rights are liberty, property, safety and resistance against oppression.

Article III - The principle of sovereignty resides entirely within the people of the nation. No body or individual can exert authority which does not solely emanate from this source.

Article IV - Liberty is defined is any act that does not harm others: Thus, the exercise of the natural rights of any sentient being can only have borders which assure other sentient beings these same rights. These borders can only be defined by law. It is also determined and reinforced by this article that no sentient being may hold any other sentient being in the bonds of slavery for any reason.

Article V - The law has the right to prohibit only actions that are harmful to society. Any action not prohibited by law can not be impeded and no individual can be ordered or compelled to perform any action not ordered by the law.

Article VI - The law is an expression of the general will. And thus all citizens have the right to contribute to its creation either personally or through their representatives in the legislature. With all citizens being equal in the eyes of public dignitaries, places and employments, according to their capacity and without distinction other than their individual virtues and talents.

Article VII - No sentient being can be accused, arrested nor detained but in the cases determined by the law, and only according to the forms and processed which it has prescribed. Those who solicit, dispatch, carry out or cause to be carry out arbitrary orders, must be punished; but any citizen summoned or arrested under the the terms of the lay must instantly obey or be rendered culpable by their resistance.

Article VIII - The law should only establish strictly and evidently necessary penalties, and that no individual can be punished by a law legislated after the offense was committed. Also no individual can be punished more than once for the same offense and that the penalties for offenses shall be publicly known beforehand.

Article IX - All sentient beings are presumed to be innocent of any accusation until their guilt is proven in a court of law. And thus by extension arrests of all sentient beings must only use the minimum amount of force needed to secure their capture.

Article X - No sentient being may be questioned about their personal or religious beliefs , except in cases where their practice may disturb public order.

Article XI - The free exchange of ideas is one of the most precious rights of sentient beings: and any citizen thus may speak, write, print or otherwise communicate any idea except in cases of communicating falsehoods with the intent of causing harm or distress to another sentient being.

Article XII - This guarantee of the rights of sentient beings necessitates a police force: this force is thus instituted for the benefit of all and not just for the utility of those who instituted it.

Article XIII - For the maintenance of this police force and for the expenditures of the administration , taxes may be collected, these taxes must be distributed equally amongst the populous.

Article XIV - Every citizen has the right to contribute either personally or through their representative to legislation that will determine the tax rate and the laws associated with taxation.

Article XV - Citizens have the right to request an accounting of the action of any public official and their administration and that this information must be accurate and freely and publicly available in a form and wording understandable to the individual making the request and that it can be produced on demand.

Article XVI - Religion shall play no role in politics in any form, All religions are viewed as being equal in the eyes of the law except in cases where the practice of these religions would cause a disturbance to the public order.

Article XVII - The Judiciary shall be appointed based solely on their merits and that judges and magistrates shall have fixed tenures of ten (10) years in their positions except in cases where they are guilty of abusing this power as determined by the law.

Article XVIII - Any society that does not make these guarantees available, nor where the separation of powers is evident, has not one bit of constitution.

Article XIX - Property being a sacred and inviolable right, thus no one can be deprived of private usage, if it is not when the publicly necessity, legally noted, evidently requires it and that in this case the individual shall receive just compensation for their property.

This species is outwardly similar to a baseline human with the following exceptions, GEMs have 6-7cm long cat ears and a tail that is 75cm long on average both these features are covered with fur that matches the hair color of the individual. GEMs also have a fine coat of fur on their shoulders, but this is usually shaved.
This species is entirely female, and is mostly not cross-fertile with baseline humans. No males have survived infancy in this type so far due to some genetic instabilities in the Y chromosome.
This species reproduces by parthenogenesis (Self cloning) with the correct hormone injections, fertility can sometimes be induced by coitus with a baseline human male or a male from another human variant race, although the resulting offspring would still be produced by parthenogenesis with some rare exceptions where a hybrid is produced, the success rate for this is about 0.25% of matings will result in a pregnancy and in 0.25% of pregnancies some genetic material from the father will be incorporated into the genome of the offspring. when the hormone injections are administered there is a 95% chance of a pregnancy.
This species gestates for 9 months and is born live, all offspring are clones of the mother.

Members of this species are typically enhanced with a biofilter implant and a neural socket computer interface.

Sociological data
This species is classified as trans-human. And fully human for the purposes of Nician law.
They have fully integrated into all levels of Nician society and there is widespread movement that is lobbying for a gene therapy treatment to convert baseline humans to this transhuman type. research for this process is well underway and as soon a stable male type of this species is created the process will be made publicly available.

UPDATE:
Following the successful birth of Ares Niciae, The first male GEM the process to convert the 60% of the baseline human population that wants to have GEM bodies is well underway and will be complete in 2 months.

201 CE = Emperor Casius was assassinated for appointing a goldfish as consul by the senate. The senate resolved to only allow the talented to rule. This was the beginnings of meritocracy in Niciae and thus began the First republic of Niciae
200 CE - 1000 CE = First republic era
1000 CE = Prophecies of the return of god fail to eventuate and religion loses its credibility, the church is officially separated from the state. and the first republic ends. And king markov former first citizen declares himself king
1000CE - 1500CE = The nician kingdom era.
1500CE - 1950CE= Niciae descends into civil war for 450 years as rival generals compete to be king over this time the power of the house of Markov diminishes and the power of the house of Johns rises. Massive technological developments arise from this conflict as the factions seek to outdo each other with technology. There are a many major battles in this war and the surface of Terra Niciae was devastated by the retreating Markov forces in a scorched earth campaign (please refer to the Nician civil war.(OOC: yet to be written))
1950 CE = King Charles Johns leads his armies into the capital of Niciae unopposed and is crowned king of Niciae.
1960 CE = King Charles Johns founds the second republic of Novus Niciae and hands over all power to the senate. He then sits for the exam for the office of prime minister and wins the office in the first examination.
12th of December 1973 CE = Anastasia Elizabeth Johns is born.
1st of January 1985 CE: The birth of the first GEM, Athena Niciae.
31st of December 1990: King Charles Johns dies, Queen Anastasia is crowned
12th of February 1991: Queen Anastasia Johns wins the examination for prime minister and is appointed prime minister like her father.
2000 CE: Y2K bug fails to cause any significant damage.
15th of May 2007 (or 0 NE) = A wormhole opens up near the L5 point that leads to the NS common universe. Scout ships are sent in to explore this strange new universe. New system of years is introduced naming this as year 0 of the new era (NE)
3 NE = Present day. A colony is established on an uninhabited pacific island on NS earth.
