Fair Trial Act

Proposed by: Morlago

The World Assembly;

Appalled by the fact that even now the inhabitants of WA nations do not have the right to a fair trial, due to the fact that Resolution #3 "The Right to a Fair Trial" and Resolution #13 "Fair Criminal Trial" have both been repealed and subsequently struck null and void

Defining:
a) inhabitiants of a nation as every sentient being that lives and/or has been allowed and recognised to claim that nation as its nationality
b) fair trial as:
i) a trial which may or may not contain criminal content that is open to the public
ii) a trial which may or may not contain criminal content in which both the prosecuting and the defending side have legal advisors
iii) a trial which may or may not contain criminal content in which there is a jury, people who have no relationship with the defendant him/herself and vote on the verdict of the defendant
iv) a trial which may or may not contain criminal content in which there is a judge, who passes the verdict according to the vote(s) of the jury
c) legal advisors as lawyers that have been recognised by the government of his/her nation

Hereby;

Mandates all WA nations to give its inhabitants the right to a fair trial
Mandates all WA nations to, when necessary, prosecute its inhabitants with a fair trial
Mandates all WA nations to allow inhabitants of other WA nations to stay at their nation if the inhabitants of other WA nations are being prosecuted without a fair trial
Mandates all WA nation inhabitants to refuse the orders, if given, to prosecute other inhabitants of WA nations without a fair trial
Mandates all WA nation to prosecute people who give orders of and/or encourage and/or execute prosecutions without a fair trial

Regrettably the original resolution has to be repeal first before submitting the next one, then again it needs to be able to stand independent of other resolutions so I don't have to go round looking for them, only to find that it is repealed.

Ah yes... Resolution #37 "Fairness in Criminal trials", but what if the trial was not of a criminal act? ;)

Fair Non-criminal Trial Act


Category: Human Rights

Proposed by: Morlago

The World Assembly;

Appalled by the fact that even now the inhabitants of WA nations do not have the right to a fair non-criminal trial, due to the fact that Resolution #3 "The Right to a Fair Trial"have been repealed and subsequently struck null and void

Defining:
a) inhabitiants of a nation as every sentient being that lives and/or has been allowed and recognised to claim that nation as its nationality
b) fair non-criminal trial as a trial which does not contain criminal content that is open to the public, and that both the prosecuting and defending sides (if they exist) have legal advisors (to advise them on legal matters while the trial is open) and legal judges (to decide the verdict of the defending side)
c) legal advisors as lawyers that have been recognized by the government of his/her nation
d) legal judges as judges and a set of people, known as the jury, that have been recognized by the government of his/her nation

Examples of non-criminal trial act:
Insurance claim dispute (the prosecuting side cannot claim insurance due to offense of contract rules, but is unwilling to submit, and therefore sues the company. The company has done nothing wrong, and therefore it is a non-criminal trial)
Social welfare claim (an inhabitant of a WA nation may need to go through a trial/hearing to claim money for social welfare in its nation, and since no criminal act is involved, it is a non-criminal trial)

Hereby;

Mandates all WA nations to give its inhabitants the right to a fair trial
Mandates all WA nations to, when necessary, prosecute its inhabitants with a fair trial
Mandates all WA nations to allow inhabitants of other WA nations to stay at their nation if the inhabitants of other WA nations are being prosecuted without a fair trial
Mandates all WA nation inhabitants to refuse the orders, if given, to prosecute other inhabitants of WA nations without a fair trial
Mandates all WA nation to prosecute people who give orders of and/or encourage and/or execute prosecutions without a fair trial

You're talking about civil trials. CIVIL TRIALS. At least do us the favor of knowing what you're talking about before you try to wreck global diplomacy with poorly-thought out proposals.

This propasal is quite useless in its current form and should be disregarded by all other WA nations.
