[RP] Malicious Compliance Thread

Hello everyone!

As you might know, you now need to have adopted at least 75% of passed GA resolutions to have WA voting rights. Keeping that in mind, I was thinking of adopting some resolutions I don't fully agree with, and using some loopholes or differing interpretations to technically comply with the resolution, while violating its actual intention (or at least some of its intentions if not all). I was thinking of posting those loopholes or differing interpretations here too, and hear others' thoughts on them.

Considering the advice I received from some people, I am creating this new thread where ANYONE can post their acts of malicious compliance for the sake of staying above the threshold and retaining their voting rights. Real-world countries are no strangers to such antics, so we can have some of it in the game too! I think it would be fun to analyse resolutions and figure out loopholes so as to evade their intention while technically complying with the text. Everyone is free to post here, but I request you to keep it on-topic.

Eliminating Slavery and Trafficking of Persons may seem like it prohibits forced prison labor, but in fact...

“Forced labour” is a system of labour which is forced upon a natural person under threat of harm or penalty and against the will of the labourer, excluding the following cases:

National service applying to a large fraction of the national population, using conscription based on objective factors, and limited in period to at most half of an individual's life expectancy;

Dire and particular circumstances, where not working significantly risks danger to others;
Meraud only criminalizes actions that harm another individual's life and property. Work camps provide restitution towards victims. If criminals did not make amends, that would significantly endanger the population as justice would be nonexistent.

If the labourer agrees with informed and prior consent to labour for a fixed and finite term or quantity;
Any Meraudian citizen knows Meraudian law (passing a competency test is required to become a citizen). All prison labor has a fixed and finite quantity... 200% of the value of the damages.

Well, dear ambassador, I wish to challenge you on your second point! I'd say that merely being aware of the consequences of the actions is not equivalent to affirmative consent. I find this somewhat analogous to the debate regarding the morality of abortion, where people argue that simply being aware of the potential consequences of intercourse does not amount to affirmative consent to hosting the foetus in the body. While I myself am quite conflicted on the topic, I agree with this point that mere awareness of consequences does not amount to affirmative consent to those consequences.

Your first point is obviously a stretch, and people may argue that there are more ways to impart justice than penal labour, or that failure to provide restitution is not obviously a danger to the population. But I guess you could just define "justice" or "danger" for your nation such that these things are non-negotiable aspects of them! Which is what this thread is for, differing interpretations of resolutions, so I welcome it!

Having said that, I myself would like to make a case for this. While I agree with all other points of GA#4 (Eliminating Slavery and Trafficking of Persons), the only thing I dislike about it is that it prohibits penal labour... or at least intends to. But I think Kshemarashtram is justified in continuing with the practice of penal labour on grounds of clause 2(a).

2. “Forced labour” is a system of labour which is forced upon a natural person under threat of harm or penalty and against the will of the labourer, excluding the following cases:

a. National service applying to a large fraction of the national population, using conscription based on objective factors, and limited in period to at most half of an individual's life expectancy;
I would argue that penal labour is indeed applicable to a "large fraction" of the Kshemarashtrian population, that is to say, ALL of the national population. Now, don't freak out, bear with me. The Kshemarashtrian criminal law applies to every citizen of Kshemarashtram. Any citizen who commits a qualifying offense may be conscripted into penal labour. So, the scheme is indeed applicable to a "large fraction" of the national population, although only very few people would be actually serving at a given point of time. The conscription will indeed be based on objective factors, i.e. the criminal status of the concerned individual and the kind of offense he has committed. And we will make sure to limit it to at most half of the individual's life expectancy; that's a requirement we agree to comply to.

b. Dire and particular circumstances, where not working significantly risks danger to others;

c. If the labourer agrees with informed and prior consent to labour for a fixed and finite term or quantity;

So while the given definition of forced labour seems to include penal labour, the clause explicitly excludes part (a), and by defining penal labour in line with that segment, I believe Kshemarashtram is justified in continuing its penal labour system even after adopting this resolution. Let me know if anyone has any challenges. If not, Kshemarashtram shall adopt this resolution!

Edit: Since no objections were raised for two days, Kshemarashtram has now adopted this resolution, and nevertheless continues its penal labour system on grounds of the aforementioned arguments.

Rasht is a city in north of Iran.
