[Draft #1] Right To A Fair Trial

The World Assembly,

Fully devoted to making the world a better place, and thus making its people fair and just, and noting that the world is inherently a cruel place,

Maintaining its efforts to have peace and justice for all,

Declares that every person, whether innocent or guilty as judged by the State, Nation, or Assembly, reserves the right to a fair trial,

Enacting as follows:

1. The definition and conditions of a fair trial are as follows:

a. a fair trial is a legal proceeding conducted justly, openly, and with strict respect for the rules, where an independent and impartial judge or jury treats all sides equally;

b. the trial being open meaning that it is open to public viewing;

c. the judge being impartial meaning that they must not have a bias against the defendant, and must not be convinced by bribes or political pressure to judge wrongly;

d. if a jury is present, it will contain a selection up to twelve individual peers, meaning that it must be people with no bias towards both the prosecution and the defense; and

e. if any of the above conditions are broken, that a mistrial should be enacted and the proceeding will reset with another selection of jurors.

2. Key rights will be held for the trial:

a. the prosecution and defense can bring both evidence and witnesses, in order to have the fullest picture possible;

b. the defendant cannot be forced to confess or blame themselves for what they are being tried on; and

c. both sides get a fair and equal chance to present their case.

3. If a fair trial is not enacted for the defendant, the proper fines will be pressed against the State, Nation, or Assembly, and in the case of the defendant being sentenced to death, and are executed before the fair trial is enacted, the State, Nation, or Assembly must pay the proper compensation to the family of the defendant.

If somebody raped another person, and is now on trial, I’m pretty sure the judge, while technically meant to be impartial, is going to dislike the defendant.


“ d. if a jury is present, it will contain a selection up to twelve individual peers, meaning that it must be people with no bias towards both the prosecution and the defense; and” first of all, why the And? Not necessary. Why exactly 12? Also, see my point above about zero bias.

If I have a particular thing that can force someone to tell the truth, why WOULDN'T I use it to tell if the defendant is lying or not? seems like a waste of an ability.

About draft 1:

The process MUST be open to the public, how you said. Also in case of divorce. Also if the judge Is and AI (we talk of that later.) No space for corruption, sorry.

There must be and AI judge and a human judge. Because also the AI might been programmed to be unpartial. The code of the AI must be disponible for the public.

You rightly said "IF a jury Is present". Well done.

And:

Fines and/or prison. Doesn't include the full arsenal of behaviour changing method that the state has,. Corporal punishment,.community service,.mandatory psychiatric holds and even execution exist.

Also,,criminal cases are not always initiated by the state but also by its subdivisions, like states and municipalities.

I think "Assembly" means "Whatever it's not a State", so also municipalities.
