[DRAFT] Basic Rights of Sophont Beings

The World Assembly,

Noticing the new state of the General Assembly, effectively abrogating all passed resolutions in an effort to renew the institution and the now blank state of International Law,

Firmly asserting the existence of the dignity of sophont beings and believing that they are possessors of fundamental freedoms and natural rights, relative to their cognitive capacities and logical reasoning, rendering them able to make decisions for themselves and giving them intrinsic worth.

Appalled and frightened by the disastrous treatment and violence inflicted on its citizens by some malevolent nations across the world, including, but not limited to mass murder of political opponents and minorities, discrimination or control of citizens, whether through slavery or propaganda.

Recognizing and acknowledging the imperative and immediate need for new and appropriate legislation to protect the afore-mentioned rights,

Convinced that providing a proper declaration will benefit in the establishment and knowledge of such rights,

Declares a sophont being to be any form of intelligence that demonstrates the capacity of self-awareness, the faculty of abstract reasoning, that can make an informed judgement and that has established a society with others of its kind.

And promulgates the following Declaration:

Article 1. That all sophont beings are entitled to receive the rights presented below unconditionally, and that these rights are irrevocably vested upon them. All sophont beings hereby receive personhood.

Article 2. That while they are different from one another, they hold the same value and are formally equal before law.

Article 3. That all sophont beings have the inalienable right to think without restrictions and to have a free, independent opinion that has not been forced upon said being.

Article 4. That all sophont beings have the right to express their opinions publicly, provided it does not cause sensible ‎harm to any individual, group or encourage hateful actions.

Article 5. That all sophont beings have the right to freely discuss between them and to assemble in groups provided it does not aim to cause turmoil, will cause disrupt or harm the security of individuals.

Article 6. That no sophont being may be forced to perform or undergo any actions contrary to his conscience, unless such obligations are established on a lawful basis in the context of legal punishment or are intended to protect a sophont being who is not in capacity of making an unbiased and informed judgement.

Article 7. That all sophont beings have the right to a basic education so that they may understand the world and gain valuable knowledge.

Article 8. That no sophont being shall be limited in his freedom of movement, provided they are not trespassing another’s property or entering a forbidden area. Member-states may only prevent people from entering areas for privacy, security or environmental concerns. Freedom of movement may be revoked as a form of penal sentence or if it is done to protect the safety of individuals.

Article 9. No sophont being may undergo discriminatory treatment based on ethnicity, religion, social class, sex, gender, bodily characteristics or sexual orientation.

Article 10. No sophont being may be unlawfully punished. [this is subject to change, please do not adress in your feedback]

Article 11. No sophont being may be the property of another person.


The World Assembly,

Article 9. No one may undergo humiliating treatment or be unjustly punished.


I’m open to all suggestions, as this is a vast topic. This a starting draft and I’ll heavily rely on feedback.

Additionally, when the drafting period ends, someone would need to endorse me so that I may submit the proposal.

I think it should be 'Basic Rights of Humankind' and to replace 'men' with 'people' because the World Assembly can have non-human sentients iirc.

Since the World Assembly has non-human folks, I think that the proposal should be changed to the Rights of Sapient Individuals and drop all wording of humans. Also, is this a reference to France's Declaration of The Rights of Man?

This is a personal preference / nitpick, but I think GA resolutions (past the initial one, it made sense in Daybreak) should endeavor to avoid referencing the old one when possible.

For example, World Assembly Governance Standards makes note of its status as a recently formed international body and the mostly blank slate without talking about the old GA:

Excluding me, there have been sixteen replies to this thread. Two of them have been you. One of them was a quick patch proposed by Malatonius that you acted upon. One of them was retracted. Twelve of them have either called you out for using the word "men" in your title and throughout your proposal, or called out the suggestion that this proposal should discuss humankind instead. You have literally received two pieces of feedback, in almost a page's worth of discussion on what I am sure you expect to be a grand statement of fundamental rights, that are something other than "your proposal is androcentric" or "your proposal is anthropocentric."

I do think that the rights listed in your proposal are good and should be protected. However, the approach has historically been to write one resolution per right, rather than an overarching bill of individual rights, as WA resolutions are binding and there is more legislative value in going into more depth for each right, compared to just passing one overarching resolution that can have oodles of interpretations.

What does "subject to another" mean? I think this can work but you'd have to unpack it a bit more, make your definition a bit clearer. Does this refer to a leader governing their citizens?

Article 8. That no men shall be limited in his freedom of movement.


There's no qualifications here unlike the other clauses, so this would affect e.g. prisons

I think these are pretty good but I don't necessarily agree with Articles 4 and 5 and think those matters would be better left up to the individual nations to do as they see fit.

And what do you mean by "freedom of movement"?

Using the word "Declaration" might cause confusion. OOC:especially because the Security Council has Declarations, and member states are not obligated to follow these...

Unconditionally, right. You realize that these rights could clash with one another? You'd need to make some conditions for that...

And the second part, absolutely not. Military service, contract obligations...

Banning thought crimes is a good idea.

So, basically, noise? This is too narrow. There are a couple of good reasons to ban people from expressing their opinions publicly:
  • Noise that disrupts military stealth operations
  • Banning spies, undercover police officers from unnecessarily revealing themselves

Article 5. That all men have the right to freely discuss between them and to assemble in groups provided it does not pose a threat to national or international security.
We could say that any dissent threatens national security... and dictators believe it, so they can do that in good faith, too. However, this doesn't allow preventing assemblies for public safety(crowd crushes, dangerous locations), crimes(assembling around a politician to block them from reaching a destination, for example)...
Article 6. That no man may be forced to perform any actions contrary to his conscience, unless such obligations are established on a lawful basis in the context of legal punishment or action.
What is this supposed to protect?

Article 7. That all men have the right to a basic education to understand our world and gain valuable knowledge.
Impossible. Some people are mentally incapable of understanding their world.
Article 8. That no men shall be limited in his freedom of movement.
Absolutely not. There are tons of reasons to restrict this. Criminals, criminal suspects, witnesses, military service, duty to care for minors, quarantines, court hearings, immigration enforcement, national security, performance of legal contractual obligations,...
Article 9. No one may undergo humiliating treatment or be unjustly punished.
This could be interpreted in any number of ways. Which punishments are unjust? Something that someone finds to be humiliating(for example, being subjected to legitimate searches, being convicted in a court of law) might still need to be done.



Generally, this is an omnibus legislation that is best split up into one law for each right, with all the exceptions necessary, instead of this...

Thank you all. I’m gonna work on a second draft, and I’m definitely changing that “men” part. I’m also gonna re-word a lot of things as some sentence can have multiple meanings and be interpreted differently.

P.S. Old Hope, your commentary was very instructive, and I’ll try to address some wording mistakes you highlighted.

Sapient means wise, or especially intelligent. Sophont means having human-like intelligence. Sapient is not "far more well known." Neither of these terms is used outside of NS with any frequency approaching common recognition, and 95% of the people who understood its use in the GA are gone.

You're not going to claw your way to relevance by being insufferably and passive-aggressively contrarian. Learn how to convey an opinion without the condescension.
