[DRAFT 2.4] Protecting Diplomatic Agents and Missions

Protecting Diplomatic Agents and Missions
Proposed by: Flydale North


The General Assembly,

Being a body of diplomacy and in its pursuit to engender a world based on mutual understanding and prosperity,

Endeavoring to protect diplomats and their missions as they build relationships around the world,

Upholding the principles behind Resolution 1 'Daybreak' and Resolution 2 'National Sovereignty',

Hereby, establishes the following provisions for diplomatic relations between member states of the World Assembly—

Defining Diplomatic Agents and Missions
  1. Diplomatic agents are persons empowered to communicate and negotiate on behalf of their sending nation to a receiving nation, including but not limited to heads of state and government, ministers, and ambassadors.
  2. Diplomatic missions are a group of diplomatic agents that are appointed on a permanent basis, empowered to represent and protect the sending nation's interests and its nationals, lawfully report the present state of the receiving nation, and promote and develop friendly relations between nations.
  3. Premises of diplomatic agents and missions are the buildings or parts of buildings, including the land upon which it stands, whether directly owned or not, used expressly for the residence or official business of diplomatic agents and missions.
Rights of Receiving and Sending Nations
  1. All receiving nations have the right to deny any diplomatic agent entrance into their country, and may at any time expel or declare any diplomatic agent persona non grata.
  2. All sending nations have the right of diplomatic immunity and personal inviolability for all diplomatic agents.
  3. Diplomatic immunity and personal inviolability rest with the diplomatic agent's sending nation, which may be waived by such anytime. This protection prevents receiving nations from arresting or otherwise detaining diplomatic agents for any reason. Any staff or family members who are nationals of the sending nation accompanying the diplomatic agent also have this protection. Any person with diplomatic immunity and personal inviolability may be detained if they pose a threat to themselves or others, subject to immediate review by the sending nation.
  4. The premises of diplomatic agents and missions are inviolable and cannot be entered by the receiving nation without permission from the sending nation. This protection remains even after relations between nations have been suspended.
  5. All receiving and sending nations reserve the right to resolve any ambiguities or omissions of this law between themselves, or until otherwise legislated by the General Assembly.
Freedoms and Expectations of Diplomatic Agents
  1. Diplomatic agents are free to communicate with their nation's government using coded messages, couriers, and diplomatic bags, which cannot be delayed, inspected, or otherwise tampered with.
  2. Diplomatic agents are free to move or travel without undue restrictions, subject to the receiving nation's laws.
  3. Diplomatic agents are expected to respect the laws of their host country and not interfere in its domestic affairs, nor conduct espionage.
  4. Diplomatic agents who have been declared persona non grata, or otherwise expelled, have forty-eight hours to leave a receiving country, unless they have been deemed a national security threat.
  5. The staff or family members who are nationals of the sending nation are subject to these expectations and responsibilities.
Responsibilities of Receiving Nations
  1. Receiving nations are responsible for protecting the premises of a diplomatic mission from trespass, damage, or disturbance, and for prosecuting or extraditing individuals who assault or otherwise unlawfully detain a diplomatic agent. This responsibility remains even after relations between nations have been suspended.

With these provisions, the General Assembly hopes to ensure the protection of diplomats as they build relationships across the world and work toward an era of mutual prosperity.

    No. It might be necessary to detain or arrest diplomatic agents if they pose a risk to certain people or the public. Criminal convictions are a different matter, of course.
  4. The property of diplomatic agents and missions, whether directly owned or otherwise, is inviolable and cannot be entered by the receiving nation without permission from the sending nation. This protection remains even after relations between nations have been suspended.
    I can think of a number of very legitimate reasons to do that, such as quarantine measures or other public safety issues.

Freedoms and Expectations of Diplomatic Agents
  1. Diplomatic agents are free to communicate with their nation's government using coded messages, couriers, and diplomatic bags, which cannot be delayed, inspected, or otherwise tampered with.
    Again, quarantines and similar measures would be rendered ineffective by such provisions.
  2. Diplomatic agents are free to move or travel without undue restrictions, subject to the receiving nation's laws.
  3. Diplomatic agents are expected to respect the laws of their host country and not interfere in its domestic affairs, nor conduct espionage.
  4. Diplomatic agents who have been declared persona non grata, or otherwise expelled, have forty-eight hours to leave a receiving country, unless they have been deemed a national security threat.
Responsibilities of Receiving Nations
  1. Receiving nations are responsible for protecting the property of a diplomatic mission from trespass, damage, or disturbance, and for prosecuting or extraditing individuals who assault or otherwise unlawfully detain a diplomatic agent. This responsibility remains even after relations between nations have been suspended.
    Damages due to legitimate reasons(fire prevention, quarantine and more), or due to actions of diplomatic staff should not have to be prevented by the receiving nation.
With these provisions, the General Assembly endeavors to protect diplomats and their missions as they build relationships around the world and work toward an era of mutual prosperity.
With these provisions, General Assembly nations only have two reasonable choices:
  • Do not accept diplomatic relations.
  • Do not ratify this proposal if it becomes law.
That's what would really happen.

This has not been changed for quarantine purposes. Diplomatic bags could be a disease vector, for example.

Generally, these protections would cause us to have no diplomatic relations with non-member nations or nations not adopting this resolution, as they could abuse the provisions in this proposal with no repercussions.

After some consideration, I do not accept your premise. This proposal is meant to set down the foundation for protecting diplomatic agents and their missions. The World Assembly may choose to further legislate on this in the future, specifically regarding pandemics.

A month is a long time, especially since I spent time working on this before I published it. Additionally, as I said, the timeline is tentative. This proposal won't be submitted to the General Assembly until I'm sure it's ready.

I'll go into more detail in the morning. Until then, I have a few preliminary thoughts.
Upholding the principles behind Resolution 1 'Daybreak' and Resolution 2 'National Sovereignty',

I'm flattered, but it would be better to explain how the proposal upholds those "principles," even in cursory terms, particularly given the topic. States conducting diplomacy with each other is a natural extension of their sovereignty, and thus a GA resolution protecting their ability to do so would in effect protect an aspect of national sovereignty. You shouldn't have any trouble coming up with something, and it'll make the preamble sound way less generic too. ;)

  1. Diplomatic agents are persons empowered to communicate and negotiate on behalf of their sending nation to a receiving nation, including but not limited to heads of state and government, ministers, and ambassadors.
  2. Diplomatic missions are a group of diplomatic agents that are appointed on a permanent basis, empowered to represent and protect the sending nation's interests and its nationals, lawfully report the present state of the receiving nation, and promote and develop friendly relations between nations.
  3. Premises of diplomatic agents and missions are the buildings or parts of buildings, including the land upon which it stands, whether directly owned or not, used expressly for the residence or official business of diplomatic agents and missions.

These definitions seem both unnecessarily detailed and perhaps unnecessary. I don't see the point of clarification such as "including but not limited to heads of state and government, ministers, and ambassadors" and "appointed on a permanent basis." I also see problems with clarification such as "persons empowered to communicate and negotiate on behalf of their sending nation to a receiving nation" and "a group of diplomatic agents that are appointed on a permanent basis." Because the proposal's protections only apply to agents and missions meeting its definitions, they wouldn't apply to diplomats charged with communication but not negotiation, or support staff empowered to do neither, or missions consisting of a single ambassador, or an acting ambassador appointed pending a permanent replacement.

There are numerous minor issues that need to be ironed out as well. For example, clause 4 of Freedoms and Expectations would waive the requirement to leave rather than require national security threats to leave immediately, which when combined with Rights of Receiving clause 4 would effectively make national security threats unremovable by host nations.

This isn't a bad draft by any means, and the topic's important but it could definitely use some work. I'd even go so far as to suggest splitting the proposal into one covering the sovereign right of nations to conduct diplomacy with each other including terminating diplomatic relations and missions, and one covering diplomatic immunity.
