[ABANDONED] Non-Discrimination Omnibus

Non-Discrimination Omnibus
A resolution to improve worldwide human sapient and civil rights.
Category: Civil Rights
Strength: Mild
Proposed by: Tinhampton

Aware that GA#499 "Access to Abortion" and GA#598 "Access to Euthanasia Services" forbid some forms of legal and economic discrimination against certain categories of people, and

Convinced that it would be highly beneficial to forbid such discrimination against all inhabitants of member states...

The General Assembly hereby enacts as follows.
  1. Definition: In this resolution, "participating in legal activity" means carrying out, seeking to carry out, or being subject to any activity that was not illegal when it occurred.
  2. Non-criminalisation: Members shall not prosecute anyone simply for participating in legal activity.
  3. Fair treatment: Members must treat all of their inhabitants equally under law, and shall not deprive any inhabitant of such equal treatment for participating in legal activity.
  4. Tax equality: Where two inhabitants of a member state have the same income, that member must not tax the income of one of those inhabitants more or less than that of the other because they are (or have been) participating in legal activity.

refetencing them in the preamble is fine, it’s only when the policy in the proposal relies on the prior resolution when it is house of cards

Well, you see, if you do 'minor duplication' and make past resolutions useless ex post facto, you can rack up more badges by repealing them.

The snark is rich coming from someone who literally wrote the book on "badge hunting."

And what does that even mean? Tin has authored 20 resolutions, and yet still only has two badges on their profile page -- the exact same number as you. No matter how many you write, you still only get two on your page. What does she stand to gain from authoring a few more resolutions, if she should want to? Why are you assuming her intent for this proposal was to use it as a stepping stone for more potential proposals?

You already are 27 resolutions ahead of Tin; I'm not sure why are you feeling threatened and feel the need to lash out at one of the assembly's most active authors like this. It's extremely unbecoming of a GA Secretariat and should call into question your judgment.



As for the proposal itself, I would recommend trimming it down a bit.

I do not support the repeal of 35 or 79 and will not be pursuing repeal of either in the event that this passes. Article c is a novel provision not present in any previous resolution.

This resolution is intended as a labour-saving device. Accesses to Abortion, Life-Ending Services and Euthanasia Services all contain clauses on non-criminalisation, equal treatment and tax discrimination (as does Apatosaurus's draft Convention on Paid Leave). I believe those provisions to be sensible enough that they deserve their own resolution to apply in all *exclusions apply times and situations, rather than have to be thrown into every third non-repeal from now until the end of time.

I also apologise to the squirrel but I can't exactly find anything much to chop when I'm already at 800 characters :P

OOC: The third section is a contradiction of GAR#17. Two people on the same income with different circumstances paying different amount of taxes is not discriminatory and is a fairly basic aspect of modern progressive taxation systems.

I would leave the determination of what exactly is or is not discriminatory the Assembly. The preamble clause asserting that some discrimination exists is, in my view, sufficient to pass GA 17's bar. (Without having to exploit plurals.)

"What would count as 'same income' and "same income tax" per clause C? If two persons have the same income in nominal terms, but one earned it through their work while the other leeched it off of society through stock-brokering or being a patent troll, do those qualify as 'same income'? Are purely passive incomes from dividends, interests, or rent to be held as equal to contributing to society through your work? Furthermore, if the tax amount has to be equal, what about societies that use deductibles to induce some behaviour, such as union dues, saving up for a pension, or rebates from investing in energy savings?"

Anderson: Income means income accrued over a given time period; I honestly never expected to agree with you about the legitimacy of different sources of income. I also don't see this affecting the kind of tax reliefs you describe, but do let me know if it does - thanks.
For the time being, a new Omnibus with four articles, including a definition clause, has been posted. Is this any better or worse than the previous iteration?
