If you force small employers to absorb more of the financial burden of paid leave - to avoid "incentivizing" them stop hiring once they reach a worker cap - all you do is create a larger class of small businesses that won't even be able to afford to hiring up to the cap.

One could make a policy where there isn't any cusp or cutoffs by phasing out the subsidies as an employer hires more employees.

What exactly is stopping developing nations from taxing their expatriates? It's done all the time in some nations. There's certainly nothing preventing it.

Never said that was the solution. In the replacement, it's less of a division between 49 and 50 and more of a scale, where the 50th worker makes businesses responsible for 1% of compensation, and each additional worker is 1% more.

You'd still run into the same problem. As you add employees and the subsidies get phased out, you'll hit a point where businesses determine they can't add anymore employees, because doing so would result in their subsidy being one step further phased out, and they could not profit from the additional employee.

But that employee "cap" varies, and the difference between one level and another isn't 0% to 100%, it's n% to n+1%. That isn't much of a barrier for a lot of businesses, while 0 to 100 is far harder to manage.
