[DRAFT] Repeal "Chemical Weapons Accord"

OOC Preface; I always considered myself friends with Douria and with Chester Pearson back in the day so I lodged very little objection to this at the time despite reservations, considering the position of both of those authors these days and the time that has elapsed I think the time is right.

IC Preface; I have always admired the intent but not all of the content of this particular piece of legislation and I think the time is right to strike it from the books. I accept many Ambassadors may want to see an adequate replacement for it and I will categorically state right now that I am NOT the right author to tackle such a monumental task, so I welcome anyone who wishes to. The draft will be here and ready regardless.

Repeal Chemical Weapons Accord

Esteemed members of the World Assembly;

Acknowledging ​the undeniably important intent and objective of World Assembly resolution #272,

Recognizing the fact that this legislation has sat on the books of this august assembly since 2013 and has undeniably been of benefit to nations great and small,

Perplexed by the duality of a legislation that decries Chemical Weapons whilst " believing that small scale tactical defensive usage of these weapons is sometimes vital to the survival of smaller nations,",

Lamenting the flaws of this otherwise grand and decisive legislation, beginning first and foremost with the definitions of the act, which in an attempt to be as all encompassing as practicable, classify a chemical weapon as ""any substance that is used with the intention of causing death or severe harm to sapient beings, a habitable area or to the environment solely through the toxic chemical properties of such agent".

Highlighting that in order to subvert this legislation, one only has to design a Chemical Weapon that does not solely rely on the chemical properties of such agent to bring about the mass destruction of an environment or genocide of sapient beings.

Observing that clause 1 and 2 effectively negate each other in their actions or requirement of inaction as the case may be,

Noting that clause 3 is not only vague in its composition but potentially at direct odds with any future legislation owing to its presumptive granting of indefinite permission,

Frustrated by the needless micromanagement and possibly duplicitous content contained within Clause 6 when Clause 5 sufficiently addresses the issue of aggressive actors,

Shocked by the first mentioned function of the established WACWC which is obliged to share the chemical library of same to any nation that requests it whether a hostile agent or otherwise,

Hereby deems the Chemical Weapons Accord, Resolution #272, unfit for purpose and accordingly repeals same.

There should be no restriction on the use of chemical weapons when their application carefully avoids civilians or inflicts damage in a manner inconsistent with the goal to immediately kill or wound combatants, such as deliberately causing birth defects. The proposal should reflect this.

If repealed, I would intend to draft a proposal allowing for offensive use of chemical weapons that comport with extant laws of war protecting civilians and the environment."

Apologies SP, when you say the concept but not the draft, do you mean the original resolution, or this current proposal?

The key word in the definition is solely. It's not the reliance, it's the sole reliance that allows a possible non-compliance clause.

"Additionally, we cannot support this without some form of a replacement, either by the Delegation submitting this or some other."


That's not unreasonable, however I do not feel I could do a replacement justice and as such cannot offer one.

The Grand Holy Empire of Bestelesnia agrees with this delgation's points, for the basic mechanism for chemical weapons is in exploiting its chemical properties for causing either direct or indirect damage to civilians, nature or, mainly, enemy troops.
On the other hand, we also cannot support a repeal for a legislation of this magnitude without a replacement.
On the other hand, although we agree with the "observing", "frustrated" and "shocked" clauses, we don't see or understand the mentioned problem on the "noting" clause.
