[DRAFT] Model Laws

Please do correct me if I am wrong, but it appears that no resolution to date addresses the problem of ensuring that member-states pass laws that effectively meet the obligations a resolution may impose on them. I have found some that talk about enforcement and investigation, but it appears we may have a bit of a blind spot in the area of empowering nations to get the law-making process right the first time.

Proposed by Ainslie

The World Assembly,
Acknowledging the a consensus belief that a need for better measures to address WA non-compliance is necessary,
Noting that there are some member-states who for varying reasons may not be able to readily undertake the costly and prolonged process of law reform at the same pace as resolutions are passed by this Assembly,
Recognising the need to improve the ease at which member-states can effectively draft and ratify laws in order to comply with resolutions of this Assembly, the World Assembly hereby enacts the following:
  1. The World Assembly Compliance Commission (WACC) shall be tasked with creating model laws that national governments of member-states can use as a reference when designing laws that ratify resolutions passed by this Assembly.
  2. These model laws shall be considered as best practice and as representative of a full implementation of the resolution at hand.
  3. Further, these model laws must offer clear and detailed provisions that allow member-states, if they wish, to immediately incorporate into domestic law in order to fully comply with enacted resolutions.
  4. Where appropriate, the WACC shall collaborate with other relevant international agencies to improve the quality, accuracy and effectiveness of these documents.
  5. Whilst model laws are not to circumvent or supercede existing processes member-states undertake in order to ensure domestic laws comply with resolutions by this assembly, the Independent Adjudicative Office (IAO) is empowered to use them as a comparison to what is best practice ratification of a particular resolution.
  6. Model laws are to be released and circulated by the WACC to member-states no later than when the voting stage for a particular resolution begins.


As always, any suggestions and pointers are appreciated, as well as the in-character responses of any member-states who have formed opinions on this topic. I do ask that players use quotation marks (As they normally do) when speaking through their characters just so we all know what is IC and OOC. I also wanted to ask a question:

Do we think giving WACC the power to do this is sufficient, or should there be some sort of sub-agency created that is purely dedicated to drafting these model laws.

Someone can (again) thwap me if I’m wrong, but no. The World Assembly Compliance Commission (WACC) already does the job of your resolution and was established in GA #399 (linked above).

Unless there’s a specific section my brain has skipped over, #390 seems to skirt around the territory of this proposal for model laws but doesn’t directly address it.

I read through it and still can't find a comfortable category for this - I guess legal reform is probably the closest to it? Considering the original WACC resolution seemed directed towards war crimes and this is more concerned with helping nations effectively ratify resolutions, it does not seem right to put international security down for this.

Legal reform imposes costs on the legal industry. There was a case on this previously, had something to do with law enforcement. Check the GenSec catalogue.

In the absence of any other relevant category, legal reform seems to be the best, unless you have another suggestion? After all, this effects the broader legal industry in the sense that public sector lawyers' lives would be made a lot easier by the passage of this resolution. Further, it improves access to justice by ensuring clarity and encouraging the proper passage of domestic law which incorporates international law.

I believe Regulation is aimed at employment laws or something along those lines.

OOC: The Legal Reform AoE has been stated to have the net effect of making it easier for people to sue other people, suppressing the legal industry (lawyers mostly). It's badly named.

Ooc: it doesn't make it easier to sue. It regulates the legal industry and the legal system. Sometimes that means increasing causes of action. Sometimes it means closing some. That has no suppressive impact on legal representation.

Legal reform is well named. Legal reform. Reform of legal systems. Stop making things harder for new players.
