[DRAFT #1] International Transport Safety (Part 1)

International Transport Safety (Part 1)

This Resolution is intended to be proposed after this WIP repeal effort is passed. You're welcome to read this one alone, but you're likely to miss some necessary context you would get from reading the repeal. Also, for now, the aforementioned Repeal motion will be referred to as General Assembly Resolution #TBD, which will be changed if/when it gets passed and is assigned a number.

The General Assembly,

Understanding that the international transport of both passengers & cargo is a necessary part of world trade,

Desiring international transportation systems to be consistent in their safety & reliability throughout the nations of the World Assembly,

Convinced that the international standardization of safety features, accident investigation and communications is the best means towards greater transport safety,

Seeking to reestablish in part the provisions proposed by Cobdenia in the now repealed GAR #34, with a specific focus on air travel regulation,

Seeking to fulfill the first of three obligations outlined in GRA #TBD to author three Resolutions that establish air, land, and sea travel regulations,

Hereby:

SECTION A: International Transport Safety Committee

1) Reestablishes the International Transport Safety Committee (ITSC)

2) Charges the ITSC to enact regulations pertaining to the safety, communications, markings & signals, distress signals, loading limits, emergency protocols, the provision of life saving equipment, mechanical inspection protocol, standards of accident investigation, and search & rescue procedures for international shipping, aviation, and railways

3) Further Authorizes the ITSC to set training and, where deemed necessary, experience requirements for internationally operating:
  • Cockpit Personnel, Flight Attendants and private pilots on aircraft
  • Masters, Deck & Navigation Officers, Chief Engineers & Engineering Officers, Stewards and Seamen on merchant vessels
  • Enginemen, Guards, and Brakemen on trains, and Signalmen & Station Staff on international railway lines
  • Maintenance Personnel & Officials involved in the upkeep & operation of transport systems
4) Declares that the ITSC undertake cost benefit analysis, feasibility & technological practicality studies, and other considerations before issuing regulations. Regulation will vary depending on the type, design & construction date of the aircraft, sea vessels, locomotives & rolling stock in question, as well the infrastructure surrounding such, and whether its use is classified as private or commercial

5) Mandates that all aircraft, seagoing vessels, trains & railway routes operating internationally, and their relevant infrastructures, conform to ITSC requirements, subject to exemptions in article 6. Nations may require transport based in their own countries to conform to higher standards

6) Authorizes the following exemptions to article 5:
  • Domestic transport need not comply with ITSC regulations
  • Military craft & related control systems operating in peacetime need only comply with communications directives in circumstances where a threat is posed to civilian craft. Military craft operating during in wartime or involved in military operations are exempted fully from ITSC regulations
  • Military airfields & naval dockyards operating in peacetimes, and domestic transport hubs, must also comply with communications, markings, emergency equipment requirements, and avail themselves to civilian transport in distress.
  • Transport of any kind is not bound to ITSC regulation when the crew, captain, or passengers of a vessel are in immediate danger, and when acting outside of ITSC regulations is necessary to protect them.
7) Reinforces the right of nations to suspend trade with other WA nations for politically motivated reasons, except in cases where doing so would violate another General Assembly Resolution or WA regulation.

SECTION B: Air Travel Regulations

The ITSC, in conjunction with the General Assembly, proclaims the following:

1) For the purposes of this Resolution,
  • The term 'aircraft' is to be defined as any mechanical or electronic device that is both capable of flight, and is designed to house a person or persons inside it. This does not include unmanned drones, which are to be regulated independently from aircraft.
  • The term 'Aircraft Operator' is to be defined as any individual who in any way controls the operation of an aircraft.
2) Any aircraft operator who wishes to fly in international airspace must obtain an Air Operator Certificate (AOC) produced by the ITSC, containing the following information:
  • the name and registered address of the AOC Holder,
  • the date of issue,
  • the types of aircraft authorized for use,
  • the approved areas of operation (assuming there are restrictions),
  • and an official ITSC stamp of authenticity.
3) With the exception of the ITSC stamp of authenticity, it is the responsibility of the aircraft operator to complete the AOC themselves. The ITSC stamp is the be added to the document (by an official ITSC representative) only if all of the following conditions have been met:
  • The ITSC has ensured that all of the information on the AOC is accurate and up to date.
  • The ITSC has performed a ten year background check on the individual, with the assistance and cooperation of the operator's nation of residence.
  • The operator's nation of residence has not objected to the recipient's approval, which it reserves the right to do for any reason.
  • The operator has completed a minimum 4-year training course on Air Travel and International Regulations administered by the ITSC, or another equivalent education program administered by a public or private educator.
4) Aircraft Operators, and by extension whichever nations or corporations are responsible for said operators' flights, are responsible for maintaining personnel records aboard every aircraft, ensuring that each aircraft contains enough capable crew to operate safely (to be determined on a case-by-case basis for individual vehicles), and making sure that each aircraft they operate is maintained in an airworthy condition.

5) Aircraft Operators are responsible for notifying WA nations when they plan to move through said nation's domestic airspace, unless the party or parties responsible for the flight have already done so prior.

SECTION C: Land and Sea Regulation Mandate

Aware that it has only fulfilled one of three requirements made by GRA #TBD, the General Assembly commits itself to authoring two more future resolutions focused on safety regulations related to Land and Sea Travel respectively.

If you want to write three resolutions, then write three resolutions - don't just give me/us one and then promise the other two at an indeterminate future date.

If the nation is classified as 'Anarchy' there still is a [strictly limited] national government... and those aren't "biker gangs", they're traditional cross-Clan 'Warrior Societies', generally respected rather than feared.
