[DRAFT #1] Right to Disconnect

Postby Tinhampton » Thu Jun 03, 2021 5:48 pm

Character count: 546
Word count: 90
ICly yet another proposal about workers' rights by Alexander Smith, Tinhamptonian Delegate-Ambassador to the World Assembly.

OOC:
  • With regards to this, this, and this.
  • This will only be proposed upon the passage of Employee Rights, which will only be proposed upon the passage of Repeal "Protected Working Leave," which will only be proposed upon the passage of two unrelated proposals - so expect this to be submitted a few weeks from now at best, many months from now at worst.
  • You may have noticed that this resolution does not prohibit employers from contacting employees when they are not working, only from requiring those employees to respond while out of office. This is deliberate.

Right to Disconnect
A resolution to improve worldwide human sapient and civil rights.
Category: Civil Rights
Strength: Mild
Proposed by: Tinhampton

Whereas all workers in member states should be able to enjoy a sensible work-life balance, the General Assembly hereby:
  1. defines the right to disconnect as the right of an employee not to work (nor respond to any work-related communications) when they are not expected or contracted to be working,
  2. declares that everyone who works in any member state has the right to disconnect, and
  3. forbids employers and member states from punishing anyone simply because they are realising, or wish to realise, their right to disconnect.

"I have absolutely no idea where to begin with this, Mr. Smith," says Ogenbond. "What is this actually meant to address? Surely an employer that genuinely needs to maintain communication with their employee at all hours would simply address this by declaring all hours to be expected work hours?"
I want to improve.

Smith: All proposals - except those drafted by the Refugi and maybe a few others - are "only... one sentence." The word "expected" may be changed to the word "required" in a future draft; my intention with this proposal is to include all members of the workforce, including those on zero-hour contracts.

If you have a zero hours contract.... surely that means employers suddenly have no right to contact you?

OOC: Not entirely certain why even Tintin would think that it'd benefit workers to have all their contracts changed to include "you are on-call at all times"?

This one really has to take the cake. Now the WA is trying to enforce provincial labor laws?
