The World Assembly,
Knowing that corporal punishment is a vital part of child education,
Horrified by the lack of discipline in many children not subjected to corporal punishment,
Knowing that without discipline, people do not accept necessary sacrifices for the good of the society, such as environmental legislation,
Shocked to discover that some member states ban corporal punishment,
Knowing corporal punishment to be effective only when legally adminstered, and socially accepted, and not in excess,
Wary of the side effects of corporal punishment when used excessively,
Wishing to protect children and adults against excessive or unnecessary corporal punishment,
Defining corporal punishment as the use of physical force for educational reasons,
Mandates member states:
-to allow legal guardians of people under the age of majority to subject the person they are guardian to to corporal punishment under the following conditions:
1. The person subjected to punishment has done one of the offenses in 2a, 2b, 2c, or 2d
2a.They willingly destroyed property of other people or attacked other living sentinent or sapient beings without acting in defense of themselves or other sapient beings,
2b. They negligently caused injury to other sentinent or sapient beings,
2c They did an act that would be classified as a crime for every adult,
2d They refused to leave an area or stop an action whilst being in grave danger of serious bodily injury or death.
3. They were able to or should normally have been able to understand that what they were doing was wrong if the punishment was administered due to 2a, 2b or 2c.
4. The punishment must be very unlikely to cause long-term physical effects.
5. The punishment for one reason must be administered in a single time frame.
6. The person to be subjected to corporal punishment was not subjected to corporal punishment very recently.
- to ban any person from administering corporal punishment not following the above conditions.
- to ban any person except legal guardians of a person from administering corporal punishment only fulfilling 2d, and not 2a, 2b and 2c.
Clarifies that this does not outlaw the necessary use of force to coerce people into compliance with the law by preventing them from doing illegal acts.
