[PASSED] Military Death Penalty Ban

Postby Qvait » Sat Jan 30, 2021 8:43 pm

It's my first time drafting a resolution, so I'm open to suggestions on this.

Recognizing the utility of GA#535 "Death Penalty Ban" in abolishing its application under most circumstances,

Concerned that the remaining applications of the death penalty are injurious and inhumane to people who are sentenced to death for crimes they may not have even committed,

Convinced that the death penalty is a draconian judicial punishment often used in the name of revenge and wrongfully rationalized as justice,

Appalled that exceptions can be made in the application of the death penalty,

Confident that alternative sentencing exists to produce fair and effective justice for victims of heinous crimes,

Determined to discontinue all remaining uses of the death penalty,

The World Assembly hereby,
  1. Abolishes the death penalty for all crimes under the purview of military law;
  2. Prohibits states from deporting persons to states that may seek the application of the death penalty against them;
  3. In regards to Article 2, an exception shall be provided for receiving states that enter into a lawful, written contract that assures the extraditing state that the persons in question shall not receive the death penalty.

OOC: I did, but my region and perhaps others are not voting against that proposal on principle, which is why I believe that another resolution with a similar effect stands a chance at passing.

Despite your efforts, Ambassador, a Resolution that does exactly the same thing as one that is currently failing will not pass. In our opinion, it is a waste of the World Assembly's valuable time.

The rationale that the South Pacific provided in their Against vote on the proposal at vote is that it was too short with weaker writing. I disagree with your assessment of this proposal.

How is this different than protect sapient life? You would need some incredibly good arguments to convince the opposition to change their minds.

It doesn't contain a possible loophole allowing people to be deported solely for crimes that do not warrant capital punishment before tacking on charges that do warrant such after the fact. :P

Stretching it too far with this. You’re not gonna get overwhelming results in your favor should this ever reach quorum.

"Just a minor fix I'd like to suggest, Ambassador. Start off Article 3 with 'In regards to Article 2', just to make things a bit more clear. Otherwise, this draft continues to enjoy my nation's full support, and we'd like to see this submitted soon."

After some thought and some valuable insight from Ambassador Notokiwa we have reversed our position. Stevanastardustia is in favor of this resolution.

In case our original position needs any review you may find a record below:

I see no reason to glorify the military like this.

Stevanastardustia is opposed to this on the grounds that it suggests the idea that the military is somehow of a higher caste then civilians. We believe it undermines the effort to ban the death penalty entirely and cannot support it.

Notokiwa: I suggest reconsidering, Ambassador (she glances around confusedly) - er. I can't quite seem to make you out, Ambassador.

Notokiwa: Regardless. Please understand that standing World Assembly legislation already allows nation's to provide exceptions to the existing death penalty ban in the event of military tribunal. That legislation is what glorifies the military. If anything, Ambassador... (she guesses) Jay? - their draft is meant to plug that hole. So in fact, the Military Death Penalty Ban proposes removing an exception. In other words, it would bring the military down to the same level as civilians, the very opposite of glorifying.

Ambassador Notokiwa brings up a valid point and we believe it merits some consideration.

The nation of Stevanastardustia will consider this issue and revisit our previous position after some deliberation.
