If the languaging in the original death penalty ban was not comprehensive enough, it shouldn't have been voted into place. We would propose a repeal of the original legislation and a resubmission with this included. We shouldn't need to process two individual and consecutive bills like this as it is procedurally subpar.

If you are going to RP that then you should probably RP your nation getting economically annihilated by punitive WA sanctions for noncompliance as well, like what happens with member nations that don't obey the WA-mandated allowance of abortions and the like.

Death Penalty Ban
Human Rights: Significant

The World Assembly,

Recognising that there is no convincing and statistically robust evidence that the death penalty deters crime,

Hoping to spend money currently dedicated to the substantial administrative and legal costs of pursuing death penalties on enforcement or rehabilitation programmes which actually do reduce crime,

Gravely concerned that even under stringent protocols death penalties are issued against people who are actually innocent of the crimes for which they are to be punished, and

Believing that the death penalty in its application and pursuit targets the mentally ill, socio-economically disadvantaged, and members of racial and cultural minorities, even when administered under facially neutral statutes, hereby enacts the following:

  1. The death penalty is abolished except for crimes under a military penal code committed during time of war.

  2. All sentences contravening section 1 must be commuted forthwith under procedures not inconsistent with World Assembly law.

  3. Member nations collectively may further restrict the use of or abolish the death penalty, section 1 notwithstanding.

Co-authored by Cretox State.

Does this Resolution not conflict with GA Resolution 487 section 2C, where it is stated that the state is allowed to administer the death penalty?

Still, the clause shouldn't exist at all even if it doesn't conflict since a Resolution has been passed making the point of capital punishment via lethal injection moot.

It's immaterial, it supersedes it without contradiction. Pointing it out is just quibbling over minutiae of no consequence.

Well, considering more then half the early votes came from just 10 major delegates, all in favor, and many people simply vote for whichever side is winning while violating GA 122...

The passage of overreaching, authoritarian, and national sovereignty-shredding proposals like this one are precisely the reason the World Assembly membership has been on a steady decline and noncompliance has been on the rise. Congrats, or something.

The WA makes proposals and resolutions that member states follow. Obviously, national sovereignty is not a principle of the WA. All of the GA proposals mess with national sovereignty because all of them have an operative clause.

Repeal the Ultimatum of Death Penalty Ban

Postby Hellenic Exusia » Fri Jan 29, 2021 9:49 am

"ATTENTION: THIS POST NO LONGER REPRESENTS THE VOICE OF THE HELLENIC EXUSIAN COUNCIL!!"

Opposed.

The Imperial council of Hellenic Exusia shall not remove and reform any penal laws since are part of the constitution of His majesty's people Empire of Hellenes. This unorthodox decision only brings chaos to our well regulated socioeconomic system. Additionally this decision directly intercepts and even violates the sovereignty as well as dismissing the internal devices of all nations participating to this glorious World Assembly.
Never the less we openly declare that Judgement will in other ways find those individuals if a preposterous law like this passes, this "BAN" will just be an inconvenience for the masterful machine that is our government. A law so absolute such as this will bring division amongst our Assembly, not justice.

The Imperial council hereby disproves greatly and stand against intervention to matters essential such as this to the sovereignty of a nation. The Empire of Hellenic Exusia calls for a repeal in defense of its national interests & sovereignty as a member of this World Assebly.
