[DISCARDED] Repeal Digital Network Defence

The World Assembly,

Noting that protecting digital devices from hacking and cyberterrorism is important and should be covered by World Assembly legislation; but

Observing that “Digital Network Defense” is a flawed and poorly written resolution with overreaching mandates that do more harm than good;

Dismayed at the overly broad and problematic definition of cyberattack, which includes stealing online banking information, which while criminal should not be considered as harmful as hacking into military databases with sensitive information;

Annoyed that "Digital Network Defence" mandates that all cyberattacks are criminalised, ignoring governments that may wish to impose civil penalties instead of criminal penalties for certain crimes (especially since the aforementioned broad definition of cyberattack includes much pettier crimes not requiring criminal justice), an utter disregard for nations' judicial systems,

Distressed that governments are forbidden from monitoring networks belonging to foreign non-governmental entities that may pose a serious threat to the security of that nation, or monitoring digital devices not connected to any digital network but could be used in cyberterrorism, jeopardising national security;

Concerned by the total lack of respect for personal privacy by “Digital Network Defense”, codifying the right of member nations to monitor their citizens’ digital footprint and allowing them to easily justify such an invasion of privacy by saying it was to monitor digital security threats, and by blocking future legislation from restricting their ability to do so; and

Concluding that “Digital Network Defense” should not continue to be enforced by this Assembly and should be replaced with a resolution of superior quality; hereby

Repeals “Digital Network Defense”.


Be as harsh as necessary in criticising this. Also the title is not a typo, it is a correction.

Out of character wise, that link (for me) directs people to a post by Glen-Rhodes, unless it was a typographical error and you meant why I linked to a post in the drafting thread, it was because there are some ideas for what to write in a replacement for anyone that wishes to do so.

OOC: Weird, about 25% of the time I click that, it puts me at the Sandaguo post you probably meant, and the rest at one of the last two posts on the thread (Tinfect's and mine). These errors normally only happen on Tuesdays when they do the forum backup saves or something... :eyebrow:

I never said "no better", I said "much better". Given the character limitations on proposals, it is very difficult to fully legislate the topic. DND does the job.

Incensed that member nations are required to prosecute those who commit cyberattacks to the “the fullest extent of the law”, which prohibits courts from granting leniency or clemency to said perpetrators, an utter disregard for national judicial systems;


Could someone clarify if this is an honest interpretation?

Prosecution is not the same as sentencing. While in the real world 'prosecute to the fullest extent of the law' is really just PR speak for 'We prosecutors are serious!', I'd suggest 'charge them with every crime we think they committed' to be the meaning. Even in such a situation, courts can offer leniency or clemency by taking into account extenuating circumstances.

I also wouldn't impact to NatSov, but rather, impact to a harm to justice.

Distraught that “Digital Network Defense” designates cyberattacks as violent crimes under WA law, which as a result of the resolution “Preventing the Execution of Innocents”, permits member nations to execute those who commit cyberattacks even if the cyberattack was not physically violent;



Make sure to update this accordingly now that DPB is in place, and also once MDPB is adopted as well if it does pass. Though I'm sure you already know that :p

While the intent is good, this is an easily abusable loophole as it means governments get to monitor all non-governmental entities' networks with no exception, including NGOs, despite the fact they don't pose any terroristic threat. An example case of this sort of situation is if a government monitors the network of an NGO which serves a humanitarian/environmental cause in another nation which that government hates / is enemies with / wants to weaken for unjust reasons, in order to hinder all chances for that nation to receive aid in humanitarian and environmental matters.

Though, NGOs might probably be covered by a previously passed GAR, meaning they may not be concerned by the definition of "non-governmental entities" here, and if so then there's no need to change that line.
