[DRAFT] The Right To Organize And Collectively Bargain

The World Assembly hereby declares;

Article 1: The Rights of Workers
1) All employees shall have the right to organize, and no government shall infringe upon that right.
2) All employees shall have the right to a pension, so that once they retire, they do not starve.
3) All employees have the right to a living wage, in order to live a dignified life

Article 2: The Expectations of Employers
1) Multinational corporations will be required to reserve 50% of company board seats for women in order to further the goals of gender equality in the workplace
2) Employers will henceforth be barred from firing their employees without providing a good reason to government authorities
3) Employers shall henceforth be barred from racially discriminating against employees

OOC: Not a member of the WA, but shouldn't board seats be focused on skill, rather than what gender you are? I get that you are trying to further gender equality and that's good, but it could potentially be harmful to favor unskilled people over skilled ones merely because of a gender. (Not saying that one gender is intrinsically better, just referring to some possible situations)

Isn't there already a resolution that does this?

They wouldn't starve anyway, there's the Minimum Standards of Living resolution. "Dignified" is very much a matter of opinion, though.

You're banned from discriminating against people based on their gender. That means you can't favour women just because they're women. Also, there are more than just 2 genders, so a 50-50 split would be discriminatory anyway.

...why should they bother the government with it? Just have that rule exist and punish those that fire people willy-nilly.

3) Employers shall henceforth be barred from racially discriminating against employees

Already forbidden, like gender discrimination. Check out the Charter of Civil Rights resolution.

Also, GA resolutions can only affect the WA's member nations so placing requirements on Multinationals' board membership like that probably has to be limited to Multinationals whose head offices are in member nations.

OOC: I hate to do line by lines with broken up quotes. So, the following are comments on the draft, my comments in maroon, I guess, in character on the margins.

The World Assembly hereby declares;

Article 1: The Rights of Workers
1) All employees shall have the right to organize, and no government shall infringe upon that right. The World Assembly already has legislation guaranteeing the right to collectively bargain. I also don't think people understand the nature of collective bargaining. It isn't like the firm must deal with the union. Firms too have the ability to reject union proposals and hire other people. Strikes are not credible when there is reserve labour.

2) All employees shall have the right to a pension, so that once they retire, they do not starve. This doesn't mean anything in that I can give you a pension of 1 cent. Or, if the standard is non-starvation, a pension covering just that. Anyway, pension obligations are a strong reason why many formerly large firms are now unprofitable. Fundamentally, a pension is the equivalent of taking out a loan on payroll, can be discarded anyway in bankruptcy. In the end, this doesn't mean much.

3) All employees have the right to a living wage, in order to live a dignified life What is a living wage? And what about the effects on employment? What about the reduction in employment caused by those higher institutional wages and the increased number of unemployed? What about developing countries which rely on their labour surpluses to grow their economies?

Article 2: The Expectations of Employers
1) Multinational corporations will be required to reserve 50% of company board seats for women in order to further the goals of gender equality in the workplace This is a dreadful policy, for reasons already mentioned.

2) Employers will henceforth be barred from firing their employees without providing a good reason to government authorities Then they won't hire them, for fear of underperformance (or reduction in performance after becoming permanent. This is part of why many European countries have extremely high youth unemployment, which has significant impacts on youth savings and long-term jobs prospects.

3) Employers shall henceforth be barred from racially discriminating against employees They are already prohibited from doing so by GA 35 'Charter of Civil Rights'.

This person had just wrote this the day she joined. I'd advise her to improve her points on her legislation skills and really take the people's notes and criticism carefully. Or else, she'll probably have to abandon this.
