[DRAFT] Resolution- Access to Emergency Medical Care Abroad

Believing that individuals possess an inalienable right to seek medical care of their own accord and at their own expense, should a medical emergency arise while traveling or working abroad,

Understanding that medical treatment is a complex issue and requires great care, and that health-care needs can be difficult to adequately treat without the proper resources, technology, training and expertise,

Understanding that there are risks involved in receiving medical services, elective or not, in other countries,

Understanding that individuals may require medical care due to a unforseen medical emergency, such as an injury or illness,

Respecting the rights of nations to not have to cover the costs of individuals seeking to abuse this legislation by partaking in medical tourism,

Acknowledging that soldiers and enemy combatants would not be covered under this legislation beyond what is already provided under the laws of war,

The General Assembly hereby:

1: Allows Member Nations to Deny Or Restrict treatment for what are deemed to be preexisting conditions for the purpose of limiting the abuse of this legislation and discouraging medical tourism,

2: Affirms the ability of member nations to set their own policies and restrictions regarding the acceptance or non-acceptance of non-resident patients, and further declares that no member nation is required by this measure to provide medical care to non-resident medical patients above any requirements previously imposed by the General Assembly,

3: Requires that member nations respect the rights of all patients and their legal representatives,

4: Prohibits member nations from taking legal action against citizens or permanent residents as relating to them seeking emergency medical treatments or operations abroad, as long as General Assembly resolutions have not been violated,

5: Declares that patients seeking medical care or treatment under this act are financially responsible for any costs not compensated by existing laws in their home nation, and that such travel and payment must be arranged by the person(s) seeking treatment, or by their legal guardians or representation,

6: States that member nations are not obligated to cover future medical costs for conditions that arise after and directly result from medical treatments or operations sought at private expense by the patient under this measure,

7: Notes that member nations are not prohibited from assisting in defraying the financial cost associated with citizens or permanent residents seeking medical care under this measure,

8: Requires that patients be treated until such a time that they can be safely transported back to their nation of origin, all costs associated with patient transport to be covered by the individual or nation of origin,

9: Declares that soldiers/enemy combatants, engaged in offensive or defensive operations will not be covered under this legislation, and that all care associated with wounded military personnel shall be determined by the international laws of armed conflict and not the Access To Emergency Care Abroad Legislation.

Proposed solution to the failed "freedom to seek medical care" resolution.

I could rewrite the entre legislation, however this was an atttempt to bridge the best parts of the original legislation while addressing the issues that had it repealed.
