ID: crilland_1615210594

Repeal: “Gay Panic Defense Ban”
A resolution to repeal previously passed legislation.

Category: Repeal

Resolution: GA#542

Proposed by: Crilland

General Assembly Resolution #542 “Gay Panic defense Ban” (Category: Civil Rights; Strength: Mild) shall be struck out and rendered null and void.

Speaking of the past Law enacted, have any of you even tried to evade the law by being a male or female, trans or bi? yeah, no. so the ¨gay panic defense ban¨ doesnt really enact anything much, is offensive and stereotypical to the LGBTQ community,and assumes that they try to get out of crimes by sexual preference.
hereby this proposal repeals gay panic defense ban.

Approvals: 0

Honest mistake violation.

Text:

It is hereby proposed that the legislation called "Prohibition of Honor-Based Violence" be repealed without delay.

1. Whereas violence perpetrated against an individual by or at the direction of a relative or any other member of a community was defended, at a minimum, by the ability to implement retaliation of similar nature.

2. There are nations states who use severe and extreme measures to enforce, enact and otherwise demand loyalty respect and obedience from it's population regardless of how peaceful the WA and it's member states to include "honor based violence".

3. Whereas an example of this simple fact can be expressed in the motto "Live Free of Die" from New Hampshire.

4. Whereas individuals, relatives or any other member of a community may, at any time exist within and without the borders of other nation states.

5. With the prohibition of severe punishment that is equivalent to the acts perpetrated by offending states, nations or factions enacting such violence, the members and individuals of the WA become targets without the ability to defend themselves.

6. Prior to this prohibition, there has been a mutually assured destruction or at least the unknown threat of an equilateral punishment for bad behavior.

7. This legislation limits "prosecution" to a demand for remuneration, which can be scoffed at by any nonmember as they rape, pillage and plunder.

Therefore it is hereby put to vote that this legislation be repealed immediately so that our military defense and private security may protect our nations honor at least in theory by threat of equal retaliation.

We support peace and despise violence, however, some of our nations exist without borders and some without prisons under constant threat and attack without the ability to defend or retaliate in honor of our own belief system.

General Assembly Proposal
Title: Repeal: “Minimum Standard Of Living Act”
Category: Repeal
Resolution: GA #344
Author: US of-A

Text:

General Assembly Resolution #344 “Minimum Standard of Living Act” (Category: Social Justice; Strength: Strong) shall be struck out and rendered null and void.

The World Assembly,

Recognizing that everyone should have access to a certain standard,

However, GA Resolution #344 fails to understand:

1. Capitalism has lifted far more people out of poverty than welfare or foreign aid, which would have most likely been massively increased in most countries after GA Resolution #344 was passed, which would've increased tax loads, diminishing the effects of free markets to lift people out of poverty;

2. The implementation of a living wage, as mentioned in Resolution #344, would've hurt those it most sought to help, as an increase in wage prices would've displaced labor with work less valuable than the new restrictions, which would be people below the minimum standard of living;

3. The implementation of a standard of living would negatively impact countries with diverse regions and geographies, as the minimum standard of living would likely be different in these regions and geographies, resulting in an unaccounted for transfer of wealth from one region to the others, in the form of taxes;

4. In section 5, Resolution #344 states that only a partial minimum standard of living need be fulfilled, so even disregarding the flaws that are presented earlier in the bill, what it seeks to achieve wouldn't even be enforced by many member nations.

Hereby, the World Assembly repeals General Assembly Resolution #344, rendering it fully null and void, with all the powers vested in the General Assembly.

Approvals: 2 (Tinhampton, Cruciland)
ID: us_of-a_1615767597

Rule Broken: Honest Mistake (In section 4 of the repeal, it states "what it seeks to achieve wouldn't even be enforced by many member nations", when GA #344 actually states that it permits each member state to guarantee only a partial standard of living "to the extent that that member state deems practicable and appropriate while remaining consistent with the object and purpose of this resolution", which guarantees enforcement in almost every case.)

The General Assembly,

The growing racism and Islamophobia around the world amazes me. The Security Council must protect all human beings. These are the responsibilities of the Security Council and the General Assembly. Which he has failed to fulfill. We strongly condemn this and call on the Security Council to act in accordance with the law to reduce these crimes.

Thanks

For posterity- General Assembly Resolution #535 “Death Penalty Ban” (Category: Civil Rights; Strength: Significant) shall be struck out and rendered null and void.

General Assembly Resolution #535 “Death Penalty Ban” (Category: Civil Rights; Strength: Significant) shall be struck out and rendered null and void.

Noting that there is strong support for the Death Penalty in many WA member nations,

Further noting that it is the will of the World Assembly to promote the free democratic expression of ideas and ensure that the government responds to the will of the people,

Believing that forcing member nations to forsake the death penalty creates a contradiction with the democratic ideals of the World Assembly, whereby member nations are forced to ignore the will of their people,

Noting that the desire of the original proposal is to “spend money currently dedicated to the substantial administrative and legal costs of pursuing death penalties on enforcement or rehabilitation programmes”, but that the original proposal does not clarify what these programs are, how to implement them, or how to assess their effectiveness,

Believing that this ambiguity is detrimental to the functionality of the criminal justice system, especially in poor nations where the introduction of ineffective programs can severely drain the financial resources of the Justice Department,

Noting that the proposal believes the “[Application of the death penalty] targets the mentally ill, socio-economically disadvantaged, and members of racial and cultural minorities”,

Noting that most nations with the death penalty enforce stringint laws to prevent the execution of the mentally ill,

Believing that the issue of using the death penalty to target racial and cultural minorities and the socio-economically disadvantaged is part of a larger systemic issue of disparity in the justice departments of individual nations, and that the abolition of the death penalty does not directly mitigate this effect,

Noting that the original proposal wishes to prevent “death penalties [from being] issued against people who are actually innocent of the crimes for which they are to be punished”

Noting that the criminals who have been sentenced to death were convicted in a fair trial by a jury of their peers,

Further noting that substantial opportunity for appeal and stay of execution exists in nations with the death penalty,

Believing that this sufficiently mitigates the risk of false execution through ample opportunity to introduce reasonable doubt,

Hereby repeals General Assembly Resolution 535 “Death Penalty Ban”.

I believe the proposal Repeal: “Death Penalty Ban” has an honest mistake violation. This violation was originally brought up by Malashaan during internal WAA discussion in Europeia.
Noting that the criminals who have been sentenced to death were convicted in a fair trial by a jury of their peers.

GAR #37 "Fairness in Criminal Trials" states the following regarding jury trials:
COMMENDS to the consideration of member nations a jury of the accused's peers as such trial adjudicators;

Thus, since the use of jury trials is not required but merely suggested by GAR #37, the aforementioned clause from Repeal: “Death Penalty Ban” is untrue. Therefore I think the proposal should be flagged as illegal due to the honest mistake.

COMMENDS to the consideration of member nations a jury of the accused's peers as such trial adjudicators;

Thus, since the use of jury trials is not required but merely suggested by GAR #37, the aforementioned clause from Repeal: “Death Penalty Ban” is untrue. Therefore I think the proposal should be flagged as illegal due to the honest mistake.

Agree. I have marked it illegal in the queue accordingly.

Alright, thank you!

Scientific And Historical Protection Act

A resolution to promote funding and the development of education and the arts.

Category: Education and Creativity

Area of Effect: Educational

Proposed by: The greater buckeye union

History has shown us that the destruction or prohibition of information can lead to especially
bad outcomes. Knowing this we must set forward regulations ensuring that information is
Open and free to all

1A Historical or scientificInformation may not be destroyed in any capacity

2A Governments may not hide historical or scientific records from the public
(Excluding information that could harm or endanger their nation or it’s populace)

3A Information may not be altered for a countries benefit or reputation

No operative clause. Also numerous typos and it generally doesn't read like what is expected of a good WA resolution imo
edit: just realized this has already been reported 6 hours ago. Still should be changed
