[Draft] "Restrictions On Voluntary Assisted Death"

There is already a proposition for a replacement euthanasia bill, however, I believe that we can both further improve the human rights delivered by the bill and restrict the process as to stop abuse without affecting national sovereignty.

DISTRESSED by the number of terminally ill patients which needlessly suffer pain due to the restriction of voluntary euthanasia.

MANDATES that all WA-member nations allow those with a terminal illness to request to undertake the process of voluntary euthanasia and have it administered.

1. Definitions:
A) The administration of lethal medication to end a person's life after the prescription of a qualified physician and consent of the person in question is termed "voluntary euthanasia".
B) An irreversible illness which has been medically confirmed, preferably beyond reasonable doubt, and will result in death is termed a "terminal illness".

2. Any patient which requests the administration of euthanasia must be an adult free from mental instability or mental illness.

3. Prior to administering lethal medication, the administering physician must confirm the diagnosis of the patient's status as terminally ill and must reaffirm the patient's consent. This consent must be collected and preserved prior to death. If the patient is unable to issue this consent, it may be reaffirmed through documents such as an advance healthcare directive.

4. A physician has the right to refuse to assist with the process of euthanasia with no fines levied against them.

5. Any nation may elect to further, but not completely, restrict the accessibility of euthanasia services providing that their legislation is in accordance with this resolution.

At least in the emergency medical field, an individual who is suffering distracting pain is not considered a reliable patient for a number of things, one of which being accurate determination of mental state, which would fall under mental instability. By that definition, this precludes those who suffer debilitation painful terminal illness from receiving euthanasia. Besides, it would be easy to determine individuals facing a terminal illness to be mentally unstable, by virtue of the stress of facing one's morality.

Guess what I'm trying to get at is that it has too large a loophole, as written. Nations could easily outlaw euthanasia should this pass in its current form.

This clause should be removed, as the World Assembly should not mandate that all member nations legalize euthanasia.

This clause should be removed, as the World Assembly should not mandate that all member nations legalize euthanasia.

Maybe remove it and put in a clause about not restricting travel for such purposes. We do agree with Auralia, though, that the WA shouldn't force nations to leagalise euthanasia if they don't want to.

Also, against. I feel that my nation can pass laws on it's own regarding euthanasia, thank you very much.

I probably won't submit it, then. There's already a decent proposal on euthanasia anyway.
