[Passed] Repeal "Dignified End of Life Choices"

Postby The Dourian Embassy » Fri Dec 06, 2013 5:11 am

Original here: http://www.nationstates.net/page=WA_pas ... 1?start=53

The World Assembly,

Understanding that "Dignified End of Life Choices"(GA#54) attempts to provide euthanasia services to those who might reasonably seek them,

Realizing that Clause 5 reads: "This resolution shall not preclude a nation from enacting an assisted suicide law that is less or more restrictive than this resolution, so long as said law complies with Sections 4 (D) and 4 (E)",

Regretting that Clause 5 negates the bulk of the protections provided in the preceding clauses of GA#54, which opens up a whole host of concerns, which include:

* The patient in question will not be required to actually request the administration of lethal drugs,
* There is no need to ensure that a patient's request is voluntary, and
* Patients may be forbidden from rescinding a request for the administration of lethal drugs prior to their administration,

Believing that patients seeking euthanasia should be accorded greater protections than those accorded by this flawed resolution,

Encouraging the World Assembly to consider additional legislation on this subject,

Hereby repeals "Dignified End of Life Choices"(GA#54).

Co-authored by Mousebumples.

So uh, yeah. Mousey and I have been working on a repeal and replace for this, and she'll be posting the piece sometime later today.

Feedback is, as always, appreciated.

Edit: Replacement draft is available here: viewtopic.php?f=9&t=273982

"I sometimes wonder whether it's actually worth writing a repeal like this in legislativese. What does it really add? It makes the argument harder to read, if anything, and there's no need to break a repeal down into introductory/operative sections like a substantive resolution.

"Your first line has a couple of errors: an unneeded comma after "(GA#54)", and the adjective rather than adverb form of 'reasonable'."

Minor errors corrected, as well as a few changes based on a stylistic choice of mine. As for the legalese you speak of, which parts in particular are harder to read and/or understand?

I've corrected a few more problems(primarily where Mousey and my styles clashed in the text), and submitted this for a test run.

"While this is a better repeal argument for the resolution in question, we do not approve of the proposed replacement put forth by our regional delegate, which only offers such rights to the terminally ill. Until there exists a better replacement draft, we will not support any proposal to repeal the current law."

The current law already does almost nothing. If you disagree with that draft, I suggest you work on improving it, or barring that work on your own draft.

Ooc: I'm currently on my phone, and probably will be until Texas thaws, or I would :( Mouse is patient, I'll likely get a chance to give proper IC feedback before submission.

Well, I can't submit any quicker than the repeal passes, so you've got at least a week and a half or so, at minimum. Hopefully Texas thaws before then ...

Speaking of... this is at quorum, but I think it'll be almost 2 weeks before it goes to vote? I can't really tell for sure.

I think the replacement is highly debatable and has to be discussed more, but the reasons provided for the repeal are fully acceptable and objectively reasonable.

Firstaria will support the repeal.

Pleased immensely to be supporting this fine repeal.

Personally, if I were to support a "Dignified" end of life, it would be more like that famous Soylent Green docudrama; you know, some nice classical music, a nice surround 360 degree movie experience. And pleased to throw in the Tessadorian ambassador as well. Not to worry, I would never impose that on any other nation, not even my own.

OOC: For the record - my replacement is nowhere near submission ready. I've been hoping/trying to find time to get a new draft out, but RL/holidays have been conspiring against me. :P

Comments are still more than welcome, and I have no plans to rush submission. As it is, it would be a matter of weeks before it reached a vote - even if I were to theoretically submit the second this (hopefully) passes. I'd rather have good legislation that will stand the test of time rather than need to be repealed due to a shortcoming in the near future.

Maybe sometime this weekend, but otherwise, I'll work on that for after the holidays ...

Take your time, I mean it's not like someone is going to jump the queue with a horrid replacement (or one with opposite meaning) the moment the repeal passes.

And, if they do, I have every faith that I can campaign to get it either voted down or to get it repealed, if need be.

Hopefully won't be an issue, but ... we shall see. [/threadjack]

I, as World Assembly Delegate and Minister of Foreign Affairs of Europeia, votes FOR this resolution given a 4-0 vote in our internal poll. We agree with the arguments advanced in this repeal, and in particular find the implicit (and arguably illegal) optionality of the resolution highly damaging to its effect.
