[DRAFT] Peacekeeping Act

(First time writing a resolution, so it may be a fail draft)

Updates
Update 1: Eliminated the previous Resolution due to the Violation of the WA rules. Some specfic details are added. Major improvement is still not met.

Update 2: Added more details, however, major improvement being met is not yet determined

Update 3: Redefining Section E


The Democratic Federal Republic of Vietnam Empire is asking for the delgates of the World Assembly to support for resolution "Peacekeeping Act"

The World Assembly

International Security


RECOGNIZING that in the world, there is warfare going on, and innocents are being murdered/massacred. This is a War Crime

ALARMED that in World Assembly, there is no resolution upon Peacekeeping

ACKNOWLEDGING that WA does not and will not have a WA Peacekeepers/World Police/Army or anything militarily. However, nations can act as Peacekeepers themselves without having the WA involved in such ways that it will violates the Constitution of the WA.

DEEPLY CONCERNED the actions of armed factions (both sides of war) which threatens the security of the civilians of the nation under attack , the conduct of humanitarians operation by organizations in areas and the stability of those nations, which are hard to accomplish by factions disrupting the peace,

REAFFIRMING that any attempt at destabilization, disrupt the peace of civilians, halting humanitarian aids to unstable areas by violent means or lethal actions is unacceptable,

DETERMINED that factions can be either Anti-Government (within the nation), an attacking nation, or anyone who is a threat to the people

EMPHASIZING the need recognition of Nations' Peacekeepers to preserve the stabilization of the region, helping the civilians both refugees and displaced civilians of war to neutral sites, to stop from armed factions of recruiting children to war especially the nation under attack, and to escort & protect the flow of humanitarian aids,

DETERMINING that nations around the world who willingly volunteer as Peacekeeper Nations and their international peace for stablity around the world,

PROPOSING
the "Peacekeeping Act" to all Nations, that this will stop the true innocents being killed by factions both sides of war.

Therefore

1. MANDATES the following,

A) During Warfare between two or more factions, any nation who doesn't take sides (neutral) can and may act as a Peacekeeping Nations, if they wish to do so. This duty is completely voluntary to nations.

B) AUTHORIZING the Peacekeeping Nations, they have the power to:
i) Give Humanitarian Aid to the people
ii) Evacuate all citizens of the nation who are willingly to leave the war zone
iii) Send their own troops, Regiment-Battalion size only
iv) Give Medical treatment to civilians
v) Restore Law and Order as act
vi) May use lethal force on Civilians (look at Section E)

C) PROHIBITS the Peacekeeping Nation from doing the following
i) Cannot harm civilians, once they are under Peacekeepers hands
ii) Cannot steal/loot any items from the people of the nation.
iii) May not and will not use innocents as shields

D) NOTING to factions taking part of the war, they will not do the following
i) Kill innocent civilians
ii) Disrupt the Peacekeepers mission
iii) Killing Peacekeepers (unless they violated this resolution)
iv) Destroying a city/town/villages that have Peacekeepers and innocents present
v) Failing to follow (above) will be considered as a War Crime

E) ALLOWING Peacekeepers the authority to use lethal or non-lethal forces, if
i) Peacekeepers endangered of being killed from,
a) Attacking Guerrillas Fighters
b) Anti-War Activist's riot
c) Gangs/Mobs
d) To any other that is a threat to the Peacekeepers duties

F) thinking..

ALSO NOTING that Alliances around the world, this resolution, if passed, will not change anything to your Charter Declaration and/or within the Articles that deals with Peacekeeping. This Resolution is only basic rules for Peacekeeping; while Alliances have a more detailed and specific Peacekeeping rules for the Alliances,

ALSO AUTHORIZING for Nations around the world who won't participate the Peacekeeping but wishes to help can aid the process of Humanitarian Aids supplies and/or evacuating civilians by ship,

REQUIRES that the nation under attack by enemy factions should always help their own people, with or without Peacekeepers presence,

REQUIRES that the nation under attack must observe the Peacekeepers' duties and action so the following rules will not be violated

I believe your citing of previous resolutions may constitute a House of Cards violation, but a moderator would be better able to say so.

Also, I'm not sure what your proposal does that nations can't already do. Nations can already choose on their own to act as peacekeepers.

Also may i point out that war is war. Their will be yes, dare i say it.... Innocent casualties.

We object to both these clauses. We object to i) because irregular forces are not military, and as such can be considered "civilian". It is an item which has been proven by thorough investigation by our MoD to constitute a significant portion of "civilian" casualties during war as reporters and anti-war activists frequently cannot and will not recognize that non-military combatants are indeed legitimate targets. We object to ii) because to so thoroughly tie the hands of peacekeeping forces is to invite attack and to condemn them to death.

This is unenforceable, no matter how "feel-good" it may sound. Many para-military and military forces around the world have proven themselves willing to use civilians as shields for their staging areas and supply depots by placing them in populated areas. As that is not prohibited, these proposals serve as permission to do so, and to let them know they can do so in safety.

Until there is significant modification, we fear we cannot support this proposal overall.

We have updated and revised the resolution "Peacekeeping Act" and we also taking note to those who made a feedback on the work. We are hoping this is an improvement of the previous first draft of the resolution.
