Anyway, that isn't a loophole: If the government contracts with that private firm for the purpose, and keeps the contract running instead of ending it when it discovers torture is being used, then obviously there is government approval for the torture... which makes it illegal under WA law.

And who said the government had contracted them? What if the government simply decided to privatize criminal justice? Stepped away entirely.

And even if they terminate the contract... what's to stop the next contractor from doing the same? It's really an issue of "As long as you keep it quiet it's legal." Which is rather... reprehensible.
