Your Excellencies,

After arranging the necessary taxation powers, we would like to inquire whether the participating governments would agree with our judicial advice that the following is a tax, and is neither punitive nor a tariff; and is hence compatible with the first article of the RFTA?

1. It shall be considered that there is instituted in the Commonwealth and Confederacy a ‘Sin’ Tax, the “Special Anti-Discriminatory Subsidy or INiquity” Tax, or “Sad-Sin” Tax.

2. This tax shall be levied on all assets at the point of sale and/or on value added within the Commonwealth and Confederacy.

3. This tax shall be levied on and at the value or profits created by any and all subsidies by any reason or power whatever, implicit and/or explicit.

4. The States of the Confederacy or the Free Trade Zones between them shall exempt any portion of subsidies on any basis from this tax wherever:
(I) the States or Zones have legislated to allow, e.g. provide, that portion of these subsidies themselves, and
(II) this allowance, and access to it, is not prejudiced.

5. These powers may be further devolved.

6. Wherever the size of subsidies depend on foreign policy, e.g. automatic retaliation, the subsidies shall be assumed to be at the minimum consistent with this tax.

7. These taxes shall replace, in an equivalent manner, the equivalent tariffs (i)-(iv), with additional and equal effect to domestic and foreign entities.

We note these provisions are equally applicable against both foreign and domestic entities, although we note entities without unallowed subsidy would have no taxable subsidies. We further note these provisions require that the allowability of subsidies could not be prejudiced, e.g. on the basis of national origin.
