ACTIVITY: Freedom of Navigation Concerns

Resultant from the Convention for Stability, Armament and Liberation (COSTAL) Oceanic Accords, the aforementioned national shipping authorities have, in opposition to international law and norms, declared ownership over extended stretches of the common ocean. All mariners, including New Hayesalian registered ships, are warned by the New Hayesalian Government that the aforementioned nations can and will attempt to enforce national laws in what were previously international waters. Official government position is that these waters are considered international waters, but from a practical perspective, merchant vessels should be cautious with regard to their conduct.

Charts should be referenced with the following distances from a low-tide coastal baseline being considered the claimed areas:
- Territorial Waters, up to 40 nautical miles (international norm and standard is 12 nautical miles.)
- Contiguous Zones and their relevant jurisdictional restrictions have been replaced by territorial waters in the relevant claim. This claim extends to the full 40 nautical miles, wheereas international norm is an additional 12 nautical mile zone.
- Exclusive Economic Zone claims remained unchanged, to 200 nautical mile limit.

The claimant states have also expressed their belief in the ability to enforce the following actions in the extended claimant zone:

- The right to define and enforce laws over territorial waters.
- The right to stop and search any vessel that enters territorial waters.
- The right to exclusive commercial use of EEZ waters
- The right of unarmed and entirely civilian vessels to travel unharmed across all international waters

The New Hayesalian Government believes that these new claims represent a fundamental danger and destabilising force for international shipping. The New Hayesalian Government will condemn and respond to any attempted stop, seizure, or boarding of a New Hayesalian-flagged vessel under this new legal regime conducted in a manner contrary to established international laws and norms.

Mariners are advised to ensure their general activities are legal in the waters they are sailing in. Bearing in mind this destabilising accord, we advise shipowners to make necessary plans and arrangements to, insofar as possible, reduce the risk of negative interactions with the aforementioned states, on matters including carried cargo, makeup of crew and passengers (and ensuring their legal permission and safety, noting that otherwise illegal persecution and discrimination is commonplace in some nations,) and relevant taxes, charges, and fees. The legality of special seagoing activities, such as cable-laying, prospecting, fishing, or research, should be referenced against the laws of the foreign nation's territorial seas.

The Registry

All types of vessels, from pleasure yachts to oil rigs, including vessels under construction, may be registered, provided that, inter alia, they are wholly owned by legally constituted corporate bodies or entities irrespective of nationality, or by New Hayesalian citizens and permanent residents.

The formation of a New Hayesalian Maritime Industry Company is a straightforward operation; there are no nationality requirements as to both the shareholders and directors, and a number of laws and regulations regarding the formation of businesses in New Hayesalia do not apply to Maritime Industry Companies (MICs).

There are neither trading restrictions nor age restrictions on the registration of ships. However:

Ships of 10 years and over, but under 15 years, must pass an inspection by an authorised flag state inspector before or within a month of provisional registration; and

Ships of 15 years and over are required to pass an inspection by an authorised flag state inspector prior to being provisionally registered. As a rule trading ships of 25 years and over are not registered.

The procedure for the registration of a vessel is relatively straightforward. Provisional registration, which in terms of the law has the same effect as the so-called permanent registration, can be effected very quickly. A vessel is first registered provisionally under the New Hayesalian flag for six months (extendable for a further period, or periods not exceeding in the aggregate six months) during which period all documentation needs to be finalised. This includes, in particular, evidence of ownership and of cancellation of former registry. Authority to operate still remains linked to conformity with the relative manning, safety and pollution prevention international standards.

The requirements of registration are as follows:
  • Completed application by owner or authorised representative, including if needed an application for change of name of the vessel.
  • Proof of qualification to own a New Hayesalian ship; in the case of an MIC this is the document of incorporation.
  • Appointment of a resident agent, if the owner is not normally resident in New Hayesalia.
  • Declaration of ownership made in front of the Registrar by the owner or the authorised representative.
  • Evidence of seaworthiness; in the case of trading ships, confirmation of class with a recognised organisation, and information of the ship's statutory certification including Company ISM compliance.
  • Where applicable, request for the Registry to authorise the appropriate recognised classification society to issue the ship’s and the Company statutory certificates.
  • Declaration of Maritime Labour Compliance (DMLC) - Section A. This document will be sighted and witnessed by the Maritime and Seaman's Union (MSU).
  • Where applicable, application for Minimum Safe Manning Certificate.
  • Previous bill of sale, or builder's certificate in the name of the applicant.
  • Payment of initial registration fees and annual tonnage tax.
  • Safety of Life At Sea Act 2009 statement of compliance.
  • Certificate of Survey and a copy of the International Tonnage Certificate issued by an approved surveyor of ships.
  • Evidence that the vessel has been marked in accordance with law.
  • Application for Ship Radio Station Licence

The registry of a Maltese ship may be closed at the request of the owners provided all liabilities and obligations in respect of the ship towards the Greater Island Kingdom of New Hayesalia have been fulfilled and the consent of all registered mortgagees is produced.

Cancellation of registry by the Registry for non-compliance with the provisions of the law may also be effected after adequate time has been given to the owners to regularise matters and for the financiers to take the necessary action to protect their interests.

Official government position is that these waters are considered international waters, and the airspace above them remains the same, for the purposes of international freedom of aviation, but from a practical perspective, aircraft should be cautious with regard to their conduct.

Charts should be referenced with the following distances from a low-tide coastal baseline being considered the claimed areas:
- Territorial Waters and airspace above, up to 40 nautical miles (international norm and standard is 12 nautical miles.)
