Introduction:

Parties involved in this treaty - or alliance - reaffirm their stance and faith in the purposes and principles of mutual collaboration and the desire for support for other member-states. The MCA, dedicated and determined to hold mutual respect and benefits between participating nations within the alliance's jurisdiction, to affirming of safety, security, stability, and collective defense to strive for a common goal; therefore agrees to the Mochovian Cooperative Accord's constitution.

PREAMBLE

WE as an independent entity, we are all part of the alliance, each and every member of whom is bound by an agreement to the other's needs. Therefore, we are all in this together. The Accords will do their best to support one another in any way possible, including supporting our own communities. We strive to maintain harmony within ourselves and seek to ensure that our communities prosper and flourish, even if the conditions set before us may not appear ideal in some circumstances.


AS per ratification, this constitution shall hold the main framework for the Mochovian Cooperative Accords, which will solidify this organization's establishment to continue with goals in mind. These principles have been written and framed into the very fabric of this document, and have come to be known as the "Mochovian Cooperative Accords". This document has been explicitly drafted and unanimously to reflect and clarify the core principles of the agreement between the two founding nations, Mochua and Conovia, respectively.

THIS DECLARATION should serve as a reminder and assurance that while these ideals may sound attractive, they have little practicality unless we work towards our aims together, which means working through each other’s weaknesses and shortcomings. For example, the Accords may seem like an impossible goal given the fact that the two nations have only just met, but we can be certain that there will be times when we must make hard choices and compromises, no matter how difficult it may seem. However, we cannot deny the opportunity presented to us to reach out beyond our borders, in a peaceful setting where we can discuss and develop our differences as fellow citizens. It is of utmost importance that cooperation, mutual understanding, and trust are fostered among us. We cannot afford to allow mistrustful tongues to wag or to cause division and chaos within ourselves, or we may risk ending in isolation and hostility.

COMMITING, we all deserve at least one chance to achieve what we desire, so long as we keep our eyes peeled for signs that the other party may share those same ambitions. Our objective is not simply to reach an agreement between us, but rather to establish an understanding between us that serves both our mutual benefit and the greater good. In a world of uncertainty, we need allies who will guide us forward. We need to learn from each other. And above all, we need to work together to find common ground amongst the many peoples we face across different borders in pursuit of a single goal. So, let us work hard, work smart, and bring to this day a better future. Let us strive to bring about peace and prosperity.
Let us embrace the challenges that lie ahead! We are stronger together than apart!

Mochovian Cooperative Accord's Charter

Chapter 1: Purpose And Principles

Article 1: Purpose
The purposes of the MCA are:

Section 1.) To improve mutual cooperation and uphold the peace between two factions being harbored in the Mochovian Cooperative Accords through promoting political, security, and economic cooperation.

Section 2.) To create a market between member-states that is stable, competitive, and prosperous to amplify and promote economic resilience by reducing trade barriers and taxes to ensure there is free flow of goods, capital, investments, services, and free movement of businesses and industries within the Mochovian Cooperative Accords.

Section 3.) To enhance and secure the sustainable development of well-being, and the livelihood of citizens under the guidance of the Mochovian Cooperative Accords by providing them with equal access to opportunities for human development, social welfare, and basic resources needed to improve the basic life of an inhabitant.

Section 4.) To ensure that the member-states share commitment and responsibility in enhancing the faction's peace, security, and prosperity.

Section 5.) To assure all member-states will get fair treatment and respect regardless of ideologies and political ideas they hold.


Article 2: Principles

Section 1.) In accordance with Article 1 MCA and its respective members are expected to adhere to the fundamental purposes, and principles contained in agreements, declarations, conventions, concords and treaties, and any other instruments of the MCA.

Section 2.) All members of the MCA are expected to act in accordance with the following principles:

ㅤa) respect the sovereignty, equality, territorial integrity, and identity of MCA member-states.

ㅤb) reliance on diplomatic and peaceful settlements of disputes between two member-states.

ㅤc) non-interference with other MCA member-states internal affairs.

ㅤd) consulting matters on matters that are affecting the common interest of the MCA.

ㅤe) nonaggression with other member states.

ㅤf) maintaining good relations with each other and working together harmoniously to achieve objectives.

Chapter 2: Security

Article 3: Mutual Defense

Section 1.) All member-states shall agree that an armed attack or a conflict on a state within the MCA's jurisdiction, it may be deemed to use armed forces and shall commence and exercise a large-scale military and collective self-defense operation against the opposite party.

Section 2.) In accordance with Section 1, Article 3 and to ensure that such functions may continue to exist, all participating members are required to spend a minimum of 2% of their GDP to ensure that the performance of militaries within the coalition may continue to prosper the defense agreement and collective capabilities to resist an armed attack.

Section 3.) To ensure that military capabilities are not hindered whilst also improving member resilience to attacks, all member-states are required to commit to a unified military exercise every 5 years to test combat capabilities and enhance the combat readiness of forces within the MCA.

Section 4.) The MCA and its member-states are required to regularly develop and maintain key infrastructures useful to the military, such as:

ㅤa) Rail networks and Road infrastructures

ㅤb) Communication Systems

ㅤc) Airfields and ports

ㅤd) Transport hubs

ㅤe) Buildings that house military equipment


Article 4: Threats to National Sovereignty

Section 1.) Member-states shall hold a meeting between all involved parties within the MCA if there are existing certain circumstances that their territorial integrity, political independence or security is deemed threatened by outside parties.

Section 2.) Member-states declaring hostility or a state of conflict with another party associated with the MCA shall receive punishments such as:

ㅤa) sanctions

ㅤb) termination of membership and economic agreements

Section 3.) Referring to Section 2, Article 4: Member-states are still obligated to end hostility via diplomatic means.

Chapter 3: Economic Agreements

Article 5: Trade Barriers

Section 1.) To fully commit to economic matters, all members are required to have a maximum amount of 10% taxes on all goods on other fellow parties associated with the MCA, and are required to have restrictions regarding matters on trade to be severely limited.

Section 2.) All companies from states that are involved in the MCA (excluding observers) are required to have a tax cut.

Section 3.) Member states shall be committed to actively implementing and promoting trade deals and programs exclusively to other nations within the MCA.

Article 6: Services

Section 1.) The MCA shall provide for the development and creation of infrastructure of member-states.

Section 2.) All citizens falling under the MCA shall receive education, and healthcare benefits to be paid by this organization.

Sections 3.) Workers and citizens under the MCA shall have fewer restrictions regarding free travel and shall have more benefits.

Chapter 4: Membership

Article 7: Admission of new members to the MCA

Section 1.) Admission shall be based on the following criteria:

ㅤa) followed the formatting of the membership application document

ㅤb) obligated to follow the MCA Charter and its articles

ㅤc) deposited its instrument of accession to the government of Mochua

ㅤa) approval by the Government of Mochua


Article 8: Retracting out of the MCA

Section 1.) If any nation wishes to leave the MCA, they must first:

ㅤa) cancel economic agreements

ㅤb) cancel military agreements

ㅤc) move said nation's military forces (if there is any) on MCA member-states to retreat back onto their native nation.

Section 2.) Member-states wishing to leave must be in the alliance for at least 1 month and must sign a 2-year nonaggression pact.


Article 9: Membership Status

Section 1.) Membership may be revoked if the nation has been caught violating the MCA charter.

Section 2.) Observers of the MCA do not receive the same benefits as members-states (such as being council members but may obtain benefits including:

ㅤa) participation within the council

ㅤb) various economic agreements and civil affairs.

Chapter 5: Structure

Article 10: Council

Section 1.) A council compromising of representatives from member-states shall vote and debate on resolutions.

Section 2.) Any legislation and amendments that is proposed must have at least 55% votes to be passed. However, before voting starts, the Council Minister must start a debate on the proposed draft until all member states have agreed to the document which is then sent to be voted on by the council.

Section 3.) Only 1 resolution can be voted at any given time. If the resolution stays on the table for too long (i.e 1 week) it shall be canceled and the next resolution will take its place.


Article 11: Chain of Command

Section 1.) A position called the "Council Minister" shall be made, and shall be elected via direct vote every 3 years. The objectives of the Council Minister is to:

ㅤa) promote and protect the interest of the MCA, including sending legislation for the council to vote on, starting meetings, and directing all civil affairs and agencies.

ㅤb) represent the MCA on the global stage

Section 2.) A Military Committee shall govern all military commands and make decisions regarding defense and military.

Section 3.) The MCA structure is as follows:

Council Minister ---> MCA Governing Council (consisting of representatives from member-states) --> Military Committee (composed of Defense Ministers from member-states) ---> Other instruments of the MCA

Chapter 6: Summits

Article 12: MCA Summits

Section 1.) MCA Summits shall comprise of the Head of States of member nations.

Section 2.) MCA Summits shall:

ㅤa) be the supreme decision-making body within the MCA.

ㅤb) provide and discuss guidance and take decisions on key issues pertaining to the objectives of the MCA, important matters and interests regarding member-states and all issues sent by the MCA Governing Council.

ㅤc) instruct the relevant representatives within the MCA Governing Council concerned, and address important issues regarding ASEAN within the political, social, security, and economic realms that cut across the MCA

ㅤd) address emergency situations affecting the MCA and its governing bodies by taking appropriate actions.

Section 3.) MCA Summit Meetings shall be:

ㅤa) held annually per year, and be hosted the member-state holding the Council Minister position.

ㅤb) held if there is an emergency situation affecting the MCA.

Chapter 7: General and Final Provisions

Article 13: Signature, Ratification, Depository and entry into force

Section 1.) This Charter shall be signed by all MCA member-states

Section 2.) The Charter shall be subject to ratification by all MCA member-states in accordance with their respective internal procedures.

Section 3.) This Charter shall enter into force immediately after the charter has been ratified.


Article 14: Amendments

Section 1.) Members wishing to amend a Constitution may only bring amendments into the document through vote and debate, regardless of whether the Amendment is supported by members. The amendment can also be amended prior to voting.

Section 2.) An Amendment shall enter into force on the fifth day following the ratification of the amendment.


Article 15: Review

Section 1.) This charter may be reviewed 5 years after its entry into force or as otherwise determined by MCA Summits.
