RESOLUTION TO AMEND THE COOPERATIVE UNION TREATY OF COVENTRY
Ratified on September 2017 by the Nations of the Cooperative UnionFor the purposes of providing an administrative structure to our Union, we the Nations of the Cooperative Union hereby declare to adhere to the following provisions:§1 - The High Ordinance:
[Article 4]The tasks entrusted to the Union shall be carried out by the following institutions:
- an ASSEMBLY [COOPERATIVE PARLIAMENT],
- a COUNCIL,
- a COMMISSION,
- a SECRETARIAT,
- a COURT OF JUSTICE.
[Article 4] Strike Clause 2 — "The Council and the Commission shall be assisted by an economic and Social Committee acting in an advisory capacity."
[Article 5 (Add new Article; Move all Down)]
- The Assembly [Cooperative Parliament] shall be a co-legislative body, alongside the Commission, charged with voting upon proposals, in the form of resolutions, submitted by their delegate pool, and voting upon passed Commission resolutions. Member-states may send a proportional quantity of delegates to the Assembly, with one delegate equivalent to one-hundred thousand citizens. Population disputes are to be resolved by the Assembly's Executive Secretariat. The Chair of the Assembly shall be the Deputy Secretary-General of the Cooperative Union.
- The Commission shall be a co-legislative body, alongside the Assembly [Cooperative Parliament], charged with voting upon proposals, in the form of resolutions, submitted by their delegate pool, and voting upon passed Assembly [Cooperative Parliament] resolutions. Member-states may send only one delegate to the Commission; the Chair of the Commission shall be the Secretary-General of the Cooperative Union.
- The Council shall be a non-binding deliberative body, charged with working alongside the Secretariat to set the agenda for the Union's legislatures, debate complex geopolitical issues outside of the Commission and Assembly [Cooperative Parliament], make proposal recommendations to the legislatures, and invite non-member-state delegations to participate at their discretion. The Council shall consist of all member-states' leaders or their designates, and will meet twice a year in a Summit hosted by a CU member-state.
- The Court of Justice shall be a judicial body, charged with working alongside the Commission and Assembly Parliamentarians to interpret CU law, ensure universal application of said laws, and settle legal disputes between member-states, CU institutions, and any lawsuits brought up by private persons or corporate entities against a CU or CU-affiliated institution. The Court shall be composed of nine magistrates, appointed by the Secretary-General and confirmed by the Commission via a simple majority, and may serve a singular annum term. Unexpected vacancies in the Court may be resolved by the Secretary-General appointing a new magistrate to fulfill the term of the magistrate who is incapable of fulfilling their duties, due either to death, incarceration, severely debilitating/mentally-degenerative disease, or other such incapacitating cause.
- The Secretariat shall be the administrative body of the Cooperative Union, charged with overseeing any and all CU humanitarian, economic, social, peacekeeping, etc. operations, setting the agenda for the Union's legislatures alongside the Council, and representing the Union-at-large in public and diplomatic forums. The head of the Secretariat shall be the Secretary-General of the Cooperative Union, elected in the Commission — the Secretary-General may appoint a Deputy Secretary-General and Secretary-General pro tempore at their discretion.

Entemont, in his official capacity as the duly-elected Cooperative Union Commission Delegate of Tectonix, to petition the Office of the Chairperson for a writ of venire facias ad respondendum to summon the Magistrate-designates of the CU Court of Justice to the Commission chamber for the duration of debate.A. Jurisdiction
- On the 7th of June, 2017, the Cooperative Union Select Committee on Admissions issued a legal summons to the "Dormill and Stiura Ambassador to the Cooperative Union," signed by the Chair of the Select Committee (Daniel B. Entemont) and the then-CU Commission Chairperson (Lucretia Silvania). The summons, which was archived on the 8th of June, 2017 by the Commission Parliamentarian (Daniel B. Entemont), and may be viewed here, was executed and fulfilled.
- The precedence set on the 7th of June, 2017 by the CU Select Committee on Admissions demonstrates that it is under the jurisdiction of the CU Commission Chairperson to authorise summons of non-CU-affiliated persons.
B. Petition Details
- The writ of venire facias ad respondendum shall summon all nine Magistrate-designates found under the Notice of Nomination submitted by CU Secretary-General Harold Aentyn on the 3rd of September, 2017. The Notice of Nomination, which was archived on the same date as its issuance by the Commission Parliamentarian (Michael G. Zallini), may be viewed here.
- The Magistrate-designates shall be sworn under oath by the Commission Chairperson — after this, they shall present themselves in the well of the Commission chamber for questioning by the present delegates of the Commission. The Magistrate-delegates reserve the right to remain silent — however, committing perjury will result in immediate disqualification from consideration by the Commission for the position of CU Court of Justice Magistrate.
- Upon completion of the questioning period, the Magistrate-designates shall leave the Commission well and reside in the gallery, awaiting the final vote on the Notice of Nomination by the Commission.
C. Reasons for Granting Petition
- Having the magistrate-designates present will enhance debate and the Commission's understanding of the nominees by allowing them to acquire the necessary primary sources, under oath.
- Establishing the precedence of the Commission proper issuing a writ of venire facias ad respondendum, better known as a legal summons, will ensure that such actions may be taken again in the future for whatever purpose deemed necessary.
- The act of having nominees present for their confirmation has been long-established in deliberative assemblies across the Isles, providing a circumstantial precedence.
