Harold's gaze turned to Zallini who nodded back at him, signalling that the criteria had been reached. The Chamber returned to normal with the Serjeant-at-Arms unlocking the doors, signalling to the room that a vote had been reached.

He turned back to the Commission and spoke, "The Commission has reached a two thirds majority, with eight ayes. This Commission moves to pass this resolution for implementation." With that, Harold smiled, he had just witnessed his first vote and passing of a resolution as Secretary General.

Entemont chuckled to himself at Zallini's conduct. Ol' Alder taught him well.. Standing up with a parchment in his paper, he said, "Mr. Chairman, per my assurances that I gave to this Commission, I present the High Ordinance for this house's consideration." One of his aides took a photocopied version of the amendment and handed it to Zallini, who promptly had it stored away and projected on the Commission's screens.

RESOLUTION TO AMEND THE COOPERATIVE UNION TREATY OF COVENTRY
Ratified on September 2017 by the Nations of the Cooperative Union



For the purposes of providing an administrative structure to our Union, we the Nations of the Cooperative Union hereby declare to adhere to the following provisions:



§1 - The High Ordinance:

    [Article 4]The tasks entrusted to the Union shall be carried out by the following institutions:

    1. an ASSEMBLY [COOPERATIVE PARLIAMENT],
    2. a COUNCIL,
    3. a COMMISSION,
    4. a SECRETARIAT,
    5. a COURT OF JUSTICE.

    [Article 4] Strike Clause 2 — "The Council and the Commission shall be assisted by an economic and Social Committee acting in an advisory capacity."

    [Article 5 (Add new Article; Move all Down)]
    1. The Assembly [Cooperative Parliament] shall be a co-legislative body, alongside the Commission, charged with voting upon proposals, in the form of resolutions, submitted by their delegate pool, and voting upon passed Commission resolutions. Member-states may send a proportional quantity of delegates to the Assembly, with one delegate equivalent to one-hundred thousand citizens. Population disputes are to be resolved by the Assembly's Executive Secretariat. The Chair of the Assembly shall be the Deputy Secretary-General of the Cooperative Union.
    2. The Commission shall be a co-legislative body, alongside the Assembly [Cooperative Parliament], charged with voting upon proposals, in the form of resolutions, submitted by their delegate pool, and voting upon passed Assembly [Cooperative Parliament] resolutions. Member-states may send only one delegate to the Commission; the Chair of the Commission shall be the Secretary-General of the Cooperative Union.
    3. The Council shall be a non-binding deliberative body, charged with working alongside the Secretariat to set the agenda for the Union's legislatures, debate complex geopolitical issues outside of the Commission and Assembly [Cooperative Parliament], make proposal recommendations to the legislatures, and invite non-member-state delegations to participate at their discretion. The Council shall consist of all member-states' leaders or their designates, and will meet twice a year in a Summit hosted by a CU member-state.
    4. The Court of Justice shall be a judicial body, charged with working alongside the Commission and Assembly Parliamentarians to interpret CU law, ensure universal application of said laws, and settle legal disputes between member-states, CU institutions, and any lawsuits brought up by private persons or corporate entities against a CU or CU-affiliated institution. The Court shall be composed of nine magistrates, appointed by the Secretary-General and confirmed by the Commission via a simple majority, and may serve a singular annum term. Unexpected vacancies in the Court may be resolved by the Secretary-General appointing a new magistrate to fulfill the term of the magistrate who is incapable of fulfilling their duties, due either to death, incarceration, severely debilitating/mentally-degenerative disease, or other such incapacitating cause.
    5. The Secretariat shall be the administrative body of the Cooperative Union, charged with overseeing any and all CU humanitarian, economic, social, peacekeeping, etc. operations, setting the agenda for the Union's legislatures alongside the Council, and representing the Union-at-large in public and diplomatic forums. The head of the Secretariat shall be the Secretary-General of the Cooperative Union, elected in the Commission — the Secretary-General may appoint a Deputy Secretary-General and Secretary-General pro tempore at their discretion.

We see this resolution in its entirety to be favourable to the course of the CU. We have no further questions regarding this matter, but eagerly wait for debate surrounding it.

Harold was handed a copy of the resolution, the freshly printed paper feeling good in his hands. He was old fashioned in some respects as his tablet laid stationary on the desk. He read through the document and spoke up after the Ahnslen delegate, "Wait no longer," he joked, "I move this Commission to a debate on Resolution 06. The debate shall last for 24 hours."

"Now N-" He stopped himself. He could no longer take part in the debate and he had to stop before he broke the rules of his impartiality. Rejecting any thoughts on bias, he observed the delegates and made his bets on who would say what.

The Parliamentarian looked up at the top of the Dais and nudged the Chairman's still figure, whispering, "We can begin the vote now."

The time was a little late, but the Commission was utterly silent and Harold was fast getting bored, wanting something to come of it. He prayed for something like a huge debate to occur akin to that of the League which was undergoing a very large and personal debate according to his colleagues. Alas, this resolution wasn't really a controversial, nor life-changing one, more of a conformation if anything, so Harold nodded in defeat. When he was nudged, he sighed and spoke once more, "I move the Commission to a voting period on Resolution 06. Voting shall last for a minimum of twenty-four hours or until a 2/3 majority has been reached."

Harold promised himself he would laugh if someone voted against this.

Harold looked at his watch, the voting had been rather under-attended and he was slightly concerned. Nonetheless, he spoke into his microphone, "I believe that the criteria has been reached, we have waited long enough. With six ayes and no nays, this Commission moves to pass this resolution for implementation."

With that, Harold shuffled his documents and took out a piece of paper titled, 'Notice of Nomination'. Truth be told, he had spent the night before his inauguration as Secretary-General to write nominations, and he had written the Magistrate nominations last. He had gotten frustrated and had considered just writing them on post-it notes, but he felt that would have been rather inappropriate. He could just imagine the headlines, 'Hobo-Harold uses Post-its for CU Documents'. Smirking at the thought, he cleared his throat and spoke again into the microphone.

"Delegates, I present the nine nominations for the Magistrates of the Cooperative Union Court of Justice. All they require is a majority vote by the Commission. They are some of the greatest legal minds of the Cooperative Union and have each sworn an oath of total impartiality. I call this Commission to vote, voting shall last for a period of 24 hours or until a majority has been reached."

Entemont was nodding slowly at what the Chairman was saying, but suddenly got up as he moved to voting.

"Point of order, Mr. Chairman! Confirming appointments require debate — we need to ensure that these people will properly represent the CU in judicial proceedings and correctly interpret our resolutions, and blazing this house through with an immediate vote is unprecedented and counterproductive. If my colleagues do not wish debate for whatever reason, then they may invoke cloture at their discretion — however, the Chair does not have the authority to immediately move to voting procedures on any main motion without the invoking of cloture."

Harold's eyes grew wide. Dammit. He hoped that this would be his one and only mistake in his tenure as Secretary General. "I must apologise delegates. Honourable Delegate, you are most correct and I will retract my previous order. Delegates, I move this Commission into a debate which will last for 24 hours. We will then enter a voting period afterwards."

Harold felt like banging his head on the desk yet he held his gaze and waited for the debate to commence.

Nodding, Entemont straightened out his cuffs and took a piece of stationery from one of his aides. Making sure the Parliamentarian had it projected on all the CU screens, he said, "Honourable delegates, as much knowledge as the Secretary-General has on his nominees, I believe it would be most productive for them to appear before us for a period of questioning. Mr. Chairman, I request for this petition to be adopted without objection, with the writ issued and enforced post-haste."

COMES NOW Daniel B. Entemont, in his official capacity as the duly-elected Cooperative Union Commission Delegate of Tectonix, to petition the Office of the Chairperson for a writ of venire facias ad respondendum to summon the Magistrate-designates of the CU Court of Justice to the Commission chamber for the duration of debate.


A. Jurisdiction
  1. On the 7th of June, 2017, the Cooperative Union Select Committee on Admissions issued a legal summons to the "Dormill and Stiura Ambassador to the Cooperative Union," signed by the Chair of the Select Committee (Daniel B. Entemont) and the then-CU Commission Chairperson (Lucretia Silvania). The summons, which was archived on the 8th of June, 2017 by the Commission Parliamentarian (Daniel B. Entemont), and may be viewed here, was executed and fulfilled.

  2. The precedence set on the 7th of June, 2017 by the CU Select Committee on Admissions demonstrates that it is under the jurisdiction of the CU Commission Chairperson to authorise summons of non-CU-affiliated persons.


B. Petition Details
  1. The writ of venire facias ad respondendum shall summon all nine Magistrate-designates found under the Notice of Nomination submitted by CU Secretary-General Harold Aentyn on the 3rd of September, 2017. The Notice of Nomination, which was archived on the same date as its issuance by the Commission Parliamentarian (Michael G. Zallini), may be viewed here.

  2. The Magistrate-designates shall be sworn under oath by the Commission Chairperson — after this, they shall present themselves in the well of the Commission chamber for questioning by the present delegates of the Commission. The Magistrate-delegates reserve the right to remain silent — however, committing perjury will result in immediate disqualification from consideration by the Commission for the position of CU Court of Justice Magistrate.

  3. Upon completion of the questioning period, the Magistrate-designates shall leave the Commission well and reside in the gallery, awaiting the final vote on the Notice of Nomination by the Commission.


C. Reasons for Granting Petition
  1. Having the magistrate-designates present will enhance debate and the Commission's understanding of the nominees by allowing them to acquire the necessary primary sources, under oath.

  2. Establishing the precedence of the Commission proper issuing a writ of venire facias ad respondendum, better known as a legal summons, will ensure that such actions may be taken again in the future for whatever purpose deemed necessary.

  3. The act of having nominees present for their confirmation has been long-established in deliberative assemblies across the Isles, providing a circumstantial precedence.
