As the WAD for the Federation of Fictitious States all the way back on N-Day¹ (April 2017), I had to make myself a regional officer just to set up the regional faction. So no, founders and WADs are not (from my experience) automatically entitled to create factions by virtue of their positions. Could be wrong, though - might have been ironed out since then.
