Adopting the following declaration as a precedent for further resolutions in the year 2020:

I. GUIDING PRINCIPLES


Defining the developing world as a country with a less developed industrial base and a low Human Development Index (HDI) relative to other member-states of the Consortium;

Recognizes that, in addition to separate responsibilities to individual societies, the nations of this alliance have a collective responsibility to uphold the principles of national dignity and respect for sovereignty on an international level - a duty therefore to all the world's people, especially the most vulnerable and, in particular, the children of the world, to whom the future belongs;

Reaffirms our commitment to the purposes and principles of The Consortium Proclamation, which has proved timeless and universal; their relevance and capacity to inspire have increased, as nations and peoples have become increasingly interconnected and interdependent;

Believes that the central challenge we face today is to ensure that globalization becomes a positive force for all the world's people, for while globalization offers great opportunities, at present its benefits are very unevenly shared, while its costs are unevenly distributed;

Recognizes that developing countries and countries with economies in transition face special difficulties in responding to this central challenge, thus, only through broad and sustained efforts to create a shared future, based upon our common humanity in all its diversity, can globalization be made fully inclusive and equitable; with efforts that must include policies and measures, at the global level, which correspond to the needs of developing countries and economies in transition and are formulated and implemented with their effective participation;

Details the following areas as fields of developmental priority for the Common Year 2020 to be faithfully executed by members of the Srivijayan Consortium in line with its commitments as a geopolitical alliance;

II. COMPREHENSIVE ECONOMIC COOPERATION


Affirming clause 3 of the Consortium Proclamation "endeavor[ing] to accelerate [our] economic development through close cooperation upon a basis of reciprocity and to promote thereby the general prosperity of [our] region";

Agreeing to negotiate expeditiously in order to establish, strengthen and enhance economic co-operation through the following areas of improvement:
  1. progressive elimination of tariffs and non-tariff barriers in substantially all trade in goods;
  2. progressive liberalisation of trade in services with substantial sectoral coverage;
  3. establishment of an open and competitive investment regime that facilitates and promotes investment within the Asian Irredenta;
  4. provision of special and differential treatment and flexibility to newer TSC Member States;
  5. provision of flexibility to the Parties in respective ongoing trade negotiations to address their sensitive areas in the goods, services and investment sectors with such flexibility to be
  6. negotiated and mutually agreed based on the principle of reciprocity and mutual benefits;
  7. establishment of effective trade and investment facilitation measures, including, but not limited to, simplification of customs procedures and development of mutual recognition arrangements;
  8. expansion of economic co-operation in areas as may be mutually agreed between the Parties that will complement the deepening of trade and investment links between the Parties and
  9. formulation of action plans and programmes in order to implement the agreed sectors/areas of cooperation; and
  10. establishment of appropriate mechanisms for the purposes of effective implementation of aforementioned principles;

III. PROTECTION OF COMMON ENVIRONMENT


Understanding considerable effort must be made to free all of humanity, and above all our children and grandchildren, from the threat of living on a planet irredeemably spoilt by human activities, and whose resources would no longer be sufficient for their needs;

Resolving therefore to adopt in all our environmental actions a new ethic of conservation and stewardship and, as first steps, hoping this Irredenta will strive:
  1. To make every effort to ensure the entry into force of withstanding international environmental protocols, and to embark on the required reduction in emissions of greenhouse gases;
  2. To intensify our collective efforts for the management, conservation and sustainable development of all types of forests;
  3. To stop the unsustainable exploitation of water resources by developing water management strategies at the regional, national and local levels, which promote both equitable access and adequate supplies;
  4. To intensify cooperation to reduce the number and effects of natural and man-made disasters;
  5. To ensure free access to information on the human genome sequence for the benefit of virological research;

IV. ENSURING SOVEREIGNTY FOR THE DEVELOPING WORLD


Striving to assist citizens of the developing world in their struggle for lasting peace, poverty eradication and sustainable development, thereby bringing undeveloped and underdeveloped countries into the mainstream of the world economy;

Adopting agendas in line with this thereby:
  1. To give full support to the political and institutional structures of emerging governments in developing countries;
  2. To encourage and sustain regional and subregional mechanisms for preventing conflict and promoting political stability, and to ensure a reliable flow of resources for peacekeeping operations in the Third World;
  3. To take special measures to address the challenges of poverty eradication and sustainable development in Africa, including debt cancellation, improved market access, enhanced Official Development Assistance and increased flows of Foreign Direct Investment, as well as transfers of technology; and
  4. To help developing countries build up its capacity to tackle the spread of the HIV/AIDS pandemic and other infectious diseases.

Recognizing that the West is not the sole enforcers of imperialism;

Reaffirming the national sovereignty of the member states of the Srivijayan Consortium;

Acknowledging the existence of consensual unions between nations;

Concerned that there may be nations subjected to imperialism within the very borders of and by member states of the Srivijayan Consortium;

Believing that the lack of action towards such forms of imperialism will contribute to a negative image of the Srivijayan Consortium as hypocritical;

Hoping to recognize and support the sovereignty of all occupied nations and undo the influence and effects of imperialism everywhere;

Hereby,
  • Forms the National Recognition Committee to debate and consider international recognition and support of communities as nations.
  • Defines a nation as a community united by culture, language, history, religion, and ideology.
  • Creates a process for the National Recognition Committee to follow in determining whether or not a certain community warrants recognition as a nation and/or support from the Srivijayan Consortium, which is as follows:
    • Proposals: the Committee votes upon community to discuss and determine validity as a nation, which must fulfill at least three of the five qualities of a nation(common language, culture, history, religion, and ideology)
    • Review of Proposal: the Committee reviews and discusses the validity of proposed community as a nation.
    • Voting Procedures: if the Committee recognizes proposed community as a nation, voting procedures among members of the nation will be conducted to determine whether or not they desire sovereignty.

We would like to clear up the term 'imperialism' here in all its vagueness. As with the Iranian Representative has said, we feel a bit of unease with the unwanted byproducts that the passing of this resolution would bring to our nations and to the rest of the globe. While we issue our full support, we would prefer that a clause were to be added to define the term 'imperialism' being thrown around to clarify our intentions and to solidify our thoughts. It is only right to ensure that we are clear on what we are agreeing to, and what we are fighting against."

Reaffirming a commitment to C.R#3, Article IV calling upon member-states of the Srivijayan Consortium "to assist citizens of the developing world in their struggle for lasting peace, poverty eradication and sustainable development, thereby bringing undeveloped and underdeveloped countries into the mainstream of the world economy";

Acknowledging the existence of consensual unions between nations;

Concerned that there may be nations subjected to imperialism within the very borders of and by member states of the Srivijayan Consortium;

Believing that the lack of action towards such forms of imperialism will contribute to a negative image of the Srivijayan Consortium as hypocritical;

Hoping to recognize and support the sovereignty of all occupied nations and undo the influence and effects of imperialism everywhere;

  • Forms the National Recognition Committee to debate and consider international recognition and support of communities as nations;
  • Proposes the submission of an envoy from each member of the First and Second Committees of the Asian Irredenta to participate in said committee;
  • Creates a process for the National Recognition Committee to follow in determining whether or not a certain community warrants recognition as a nation and/or support from the Srivijayan Consortium, which is as follows:
    • Proposals: The Committee votes upon community to discuss and determine validity as a nation, which must fulfill at least three of the five qualities of a nation (common language, culture, history, religion, and ideology)
    • Review of Proposal: The Committee reviews and discusses the validity of proposed community as a nation;
    • Voting Procedures: If the Committee recognizes proposed community as a nation, a plebiscite among members of the nation will be conducted to determine whether or not they desire sovereignty;
    • Conclusion: If the members of the nation desire sovereignty, their host state will be encouraged to offer them independence or autonomy. If the members of the nation wish to retain citizenship within their host state, no further action will be taken.

The Asian Irredenta,

Recalling that the Consortium Proclamation adopts the generally accepted principles of international law as part of the law of the land, and adheres to the policy of peace, equality, justice, freedom, cooperation and amity with all nations;

Observing the inadequacies of status quo multilateral agreements regarding the hindrance of the spread of transnational criminal organizations and individuals;

Recognizing that the suppression of crime is the concern not only of the estate where it is committed but also of any other state to which the criminal may have escaped, because it saps the foundation of social life and is an outrage upon humanity at large, and it is in the interest of civilized communities that crimes should not go unpunished;

Recommending that the Asian Irredenta give its advice and consent to the ratification thereof as set forth in this report and the accompanying resolution of ratification;

Defining
    (a) “Extradition” as the removal of an accused from a country with the object of placing him at the disposal of foreign authorities to enable the requesting state or government to hold him in connection with any criminal investigation directed against him or the execution of a penalty imposed on him under the penal or criminal law of the requesting state or government,
    (b) "Extradition Treaty or Convention" — an extradition agreement between two or more foreign states or governments,
    (c) "Accused" — the person who is, or is suspected of being, within the territorial jurisdiction of the nations of the Srivijayan Consortium, and whose extradition has been requested by a foreign state or government,
    (d) "Requesting State or Government" — the foreign state or government from which the request for extradition has emanated,
    (e) "Foreign Diplomat" — any authorized diplomatic representative of the requesting state or government and recognized as such by the government possessing an accused in custody;

Hereby,
  • Authorizes the Right to Provisional Arrest of an individual(s) within the bounds of a member-state's territory or within the jurisdiction of the New Palembang Police Force (NPPF) on behalf of a requesting state or government;
  • Establishes that any requesting state or government with which a member-state has entered into extradition treaty or convention, only when the relevant treaty or convention, remains in force, may request for the extradition of any accused who is or suspected of being in the territorial jurisdiction of the member-state with an accused in custody;
  • Establishes the requirement of the requesting state or government to procure and publicize, as well as officially submit to the sitting Magistrate-General of the Asian Irredenta, the decision or sentence imposed upon the accused by the court of the requesting state or government before any further extradition process can be made;
  • Further establishes that if within a period of twenty (20) days after the aforementioned provisional arrest of an individual(s) by a member-state or the New Palembang Police Force (NPPF) on behalf of a requesting state or government, the sitting Magistrate-General of the Asian Irredenta has not received the request for extradition and the documents mentioned previously, the accused be released from custody;
  • Establishes accordingly that all extradition negotiations between foreign diplomats of the Asian Irredenta be (1) made public, (2) held in New Palembang City by both the requesting state or government and the state or government in possession of an accused in custody;
  • Further establishes that if necessary, court proceedings of an accused transferred to the custody of a requesting state or government be held within the facilities of New Palembang City;
  • Authorizes the construction of an appropriate facility for the negotiation of extradition treaties and court proceedings of extradited individuals in New Palembang City, to be organized and jointly-funded by members of the Asian Irredenta at the earliest possible time;
  • Establishes that in the case of a successful extradition, articles found in the possession of the accused who has been arrested may be seized upon order of the court at the instance of the requesting state or government, and such articles shall be delivered to the foreign diplomat of the requesting state or government who shall issue the corresponding receipt therefor;
  • Establishes that, except when the relevant extradition treaty provides otherwise, all costs or expenses incurred in any extradition proceeding and in apprehending, securing and transmitting an accused shall be paid by the requesting state or government;
  • Agrees to synchronize existing Extradition Treaties or Conventions via lateral negotiations between legislative officials of member-states of the Asian Irredenta at the earliest possible date to ensure the fulfillment of the aforementioned clauses and affirm that there is no existing conflict of interest in extradition processes.

THE DELEGATE COMMITTEE OF THE PEOPLE'S FEDERATION OF PAN-ASIATIC STATES to Member-State Delegations of the Asian Irredenta of the Srivijayan Consortium in New Palembang City, on June 17th, 2020:

Recalling the ongoing ideological conflict between the Federal Republic of Nacrad and the People's Republic of Kongsi, the capture and subsequent occupation of the Kongsi city of Ji'an by armed forces of the Federal Republic of Nacrad at 1700 hours on the 15th of June, 2020, and the Federal Republic's continued ongoing invasion of the People's Republic of Kongsi despite objection from global entities such as the Pan-Asiatic States;

Considering the Pan-Asiatic States' and the Srivijayan Consortium's mandate to promote and protect human and people’s rights specifically in developing countries envisaged under Article 4 of Consortium Resolution #3 (The Srivijayan Consortium 2020 Development Commitment);

Cognizant of the mandate referenced in a communiqué adopted on October 6th, 2019 requesting the Asian Irredenta to undertake deeper in-depth investigations into absolutist states whose power remains held by [an] "empowered indigenous aristocracy";

Recalling that the diplomatic stance of the Pan-Asiatic States, as mandated by communiqué from its Secretary-General released May 23rd, 2020, has been pragmatic neutrality and non-intervention thus far, though firmly believing the Federal Republic of Nacrad to be one such power aforementioned;

Concerned that the war in its current state will manifest loss of life inflicted by either side beyond conventional warfare, in ways such as but not limited to, crimes against humanity, the unjustified killing of civillians, and intense destruction to the infrastructure of the People's Republic of Kongsi and the Federal Republic of Nacrad alike as part of both sides' commitments to guerilla warfare;

Equally concerned about the human rights situation and the loss of life and human suffering as well as the worsening humanitarian situation resulting in unabating displacement of people and the ensuing flow of refugees into neighboring countries due to the Nacrad-Kongsi conflict;

Taking into account the right of all peoples to peace and security guaranteed by the Consortium Proclamation and expressing its deep concern about the threat the current situation poses to the peace and security of the people of Nacrad, Kongsi, and neighboring countries;

Expressing its full support for the initiatives of Non-Government Organizations (NGOs) for mediating in the crisis and welcoming action from the First and Second Committee of the Asian Irredenta for a prompt convening of open and constructive dialogue among the war's stakeholders;

Recognizing the urgent need for instituting measures for averting violations of human rights and instituting long-term peacekeeping;

The Delegate Committee of the People's Federation of Pan-Asiatic States:

    1. Expresses its readiness to undertake a fact-finding mission into the war situation in Nacrad and Kongsi as a matter of urgency;

    2. Calls on the Government of Nacrad and Kongsi to cooperate and authorize the fact-finding mission urgently;

    3. Urges the First and Second Committee of the Asian Irrdenta to facilitate the mission of the Delegate Committee and to take the necessary steps to ensure, as part of the mediation efforts, that all violations of human rights are halted forthwith;

    4. Calls on the Governments of Nacrad and Kongsi as well as all concerned political stakeholders to positively respond to the request for dialogue and avail themselves for engaging in the dialogue in order to bring about peace and stability to the natives of the wider region.

We hope for an immediate response from Asian Irredenta delegates.

THE DELEGATE COMMITTEE OF THE PEOPLE'S FEDERATION OF PAN-ASIATIC STATES to the Nations of the World, Parties Involved in the Kongsi-Nacrad Conflict, and Member-State Delegations of the Asian Irredenta of the Srivijayan Consortium in New Palembang City, on July 17th, 2020:

On the 11th of July, the First Committee of the Asian Irredenta elected to establish an independent international fact-finding mission on the Kongsi-Nacrad Conflict. In accordance with its mandate, the mission focused on the situation in and aftermath of the Battle of Ganzhou.

The mission, organized by the nations of a tribunal of representatives from all committees of the Srivijayan Consortium, primarily, from the nations of Pan-Asiatic States (represented by His Excellency, Mr. Thiha Pyay, Senior Diplomat, Pan-Asiatic States Ministry of Foreign Affairs), Allied Iran (representative to-be-announced), and Cairene Arabia (represented by His Excellency, Mr. Badri Al-Saidi III); in association with the observer-state of Reorganisieren Reichregierung (represented by Lt. Col. Heinrich Kriebel (ret.), Senior Diplomat and Consul-General of the Shanghai Consultate, Auswärtiges Amt) - with the permission and cooperation of the governments of Nacrad and Kongsi - was initiated today by way of the mobilization of Consortium resources. A permanent legation office was established in Riverfort, while an office in Kongsi is yet to be approved by authorities.

Factual findings shall be based on the “reasonable grounds” standard of proof. This standard will have been met when a sufficient and reliable body of primary information, consistent with other information, would allow an ordinarily prudent person to reasonably conclude that an incident or pattern of conduct occurred.

The mission strictly adheres to the principles of independence, impartiality and objectivity. It seeks consent from sources on the use of information, ensuring confidentiality as appropriate. Specific attention is paid to the protection of victims and witnesses, considering their well-founded fear of reprisals. The mission expresses its grave concern at the intimidation and threats faced by persons cooperating with the mechanisms of the Asian Irredenta examining the situation in Myanmar. It urges Kongsi and Nacrad to protect human rights defenders.

The Asian Irredenta of the Srivijayan Consortium thanks all parties involved for their cooperation, and urges further association with members of the investigative body in order to precisely asses the situation of the war in the region.

THE LEGATION OF THE SRIVIJAYAN CONSORTIUM FACT-FINDING COMMITTEE FOR THE RESOLUTION OF THE NACRAD-KONGSI CONFLICT: to the Nations of the World, Parties Involved in the Kongsi-Nacrad Conflict, and Member-State Delegations of the Asian Irredenta of the Srivijayan Consortium in New Palembang City, on August 27th, 2020:

On the 11th of July, 2020, the First Committee of the Asian Irredenta elected to establish an independent international fact-finding mission on the Kongsi-Nacrad Conflict.

The mission, organized by the nations of a tribunal of representatives from all committees of the Srivijayan Consortium, primarily, from the nations of Pan-Asiatic States (represented by His Excellency, Mr. Thiha Pyay, Senior Diplomat, Pan-Asiatic States Ministry of Foreign Affairs), and Cairene Arabia (represented by His Excellency, Mr. Badri Al-Saidi III); in association with the observer-state of Reorganisieren Reichregierung (represented by Lt. In the time since, this delegation has interviewed, both personally and through our working staff, over 600 (six hundred) members of the general population in both militarized and non-militarized zones; investigated 5 (five) former population centers heavily afflicted by the conflict; visited numerous post-war environments and gathered a collection of accounts deemed true beyond all reasonable doubt based on the standards of fair, just, and accurate fact-finding protocols.

The conclusions and stances of this fact-finding mission do not represent the official views of our home governments, and are views we have adopted given the multitude of information we have observed, debated, and investigated over the past eight weeks of our stay in the Nacrad-Kongsi territories.

The mission, agreeing upon generally laid-down foundations of equity in dealing with the delicate situation in the Nacrad-Kongsi region beforehand, submits as of this time an immediate condemnation and call for cessation to the actions of the Nacradian Armed Forces surmounting (1) the terrorization of local women, ethnic and religious minorities in Nacrad-occupied zones of Kongsi territory and; (2) the implementation of a hitherto unreported settler-colonialism system in the aforementioned zones of occupation.

First and foremost our encounters with several individuals, anonymized in this report for their personal safety, has reported multiple violations of human rights in Nacrad-occupied zones of Kongsi territory, including violence against women and minorities. This fact-finding body emphasizes that the occupying military must stop using sexual and gender-based violence to terrorise and punish ethnic minorities. The brutal tactic is still being employed in several recently-occupied states, and is so severe in some, that it is a factor strong enough to implicate the Nacradian military’s genocidal intent to destroy the Muslim religious and ethnic Han minority populations in these zones.

Specifically, extreme physical violence, and the openness in which it is conducted reflects a widespread culture of tolerance towards humiliation and the deliberate infliction of severe physical and mental pain or suffering on civilians. The international community must hold the Nacradian military to account for the tremendous pain and suffering it has inflicted on persons of all genders across the country.

This impartial fact-finding mission, in the conduction of its survey of the state of the general population, particular religious minorities such as Muslims in Nacradian zones of occupation, reports that through the allegations of widespread and systematic killing of women and girls, the systematic selection of women and girls of reproductive ages for rape, attacks on pregnant women and on babies, the mutilation and other injuries to their reproductive organs, the physical branding of their bodies by bite marks on their cheeks, neck, breast and thigh, and so severely injuring victims that they may be unable to have sexual intercourse with their husbands or to conceive and leaving them concerned that they would no longer be able to have children; the Nacradian military has expressed a genocidal intent towards the people of its occupied territories.

The ethnically-diverse Kongsi territories are home to all faiths, yet many centers of religious worship for local Muslims in particular have been destroyed throughout the course of the conflict. Mosques and masjids, schools for Islamic studies, and homes of an array of Imams have been destroyed; either consciously or unconsciously by members of the Nacradian Armed Forces. While evidence to suggest that members of the military of Nacrad are directly implicated in the active proliferation of collateral damage, the lack of restraint by its servicemen and servicewomen should be cause for concern by members of the international community. We urge the military institution of Nacrad to exercise this restraint with immediate effect in order to preserve the way of life of the people in occupied zones.

Secondly, eyewitnesses suggest that the violators mostly operate on a command-level, whereby top-ranking military officials order their subordinates to commit atrocities under the pretext of peacekeeping in such areas. According to one independent survey, ethnic Han peoples have been disproportionately arrested in districts with long-standing ethnic Nacradian communities of Caucasian descent.

Taking into account that ethnic and religious cleansing not only undoes the legal and spatial formations within a given territory but also is a productive force aimed at securing and normalizing a new political order within a contested territory, we examined its impact on settler-colonial geographies. Previous academic works show that the relative completeness or incompleteness of ethnic cleansing helps shape the specific configuration of two intricately tied sites of social management – spatial reproduction and legal governance – within settler colonial regimes.

The proliferation of spatial reproduction has been observed in many of the zones of occupation, whereby the aforementioned Han minorities have issued several complaints to this mission regarding their displacement from their homes and their separation from their valuables; forcibly instigated by the Nacradian Armed Forces. This fact-finding mission has received numerous reports of such minorities and their denunciation of the acting military governors in the Kongsi area. We are stalwart in our position that the perpetrators must be held accountable and that the victims should receive justice.

In the days that follow, this fact-finding mission, through the authority of the Srivijayan Consortium, vows to commit itself further to unveiling the truth behind many of the aforementioned reports and allegations. Many of these acts amount to crimes under international law, including war crimes, crimes against humanity and acts of genocide. Yet, the Nacradian Government has failed to mention much less cease, prevent and take action against these acts in the country, nor hold those responsible to account.

We urge the concerned institutions to remain vigilant of the situation at hand and address the concerns brought-up in this report. With tens of thousands of war-refugees still trapped in zones of occupation, too fearful to return home, this report should serve as an important reminder of the need for accountability of perpetrators and justice for victims. It makes a call to action to the respective delegations of the Pan-Asiatic States, Cairene Arabia, and the Reorganisieren Reichregierung; as well as the international community to make accountability for these grave crimes an urgent priority.

We urge our governmental constituents at home to make a dedicated stance against the atrocities clearly being perpetuated by this prolonged conflict in Nacrad and advise all parties to make in due diligence the efforts necessary in ensuring that such deplorable actions are not funded by, or are party to the democratic nations of the world indirectly through free trade with the Nacradian government.
