The Central Alliance of Strategic Defense and Trade [OPEN]

Overview:
The Central Alliance of Strategic Defense and Trade (CASDT) is an alliance that guarantees free trade and mutual defense between member nations. The CASDT has a strong belief and emphasis on democratic values and liberty, requiring joining nations to have a democratic political system. Also, the CASDT encourages peaceful solutions in times of crisis, but if the need arises,
the CASDT has a joint-nation peace-keeping force which serves to directly aid member nations. All member states of the CASDT are required to have open borders and promote open trade with its fellow CASDT members.

The CASDT's core tasks for all member nations are
  • To promote and increase economic activity through open trade
  • Collective Defense
  • International Crisis Management
  • Promote democracy and liberty


The CASDT Assembly
To ensure that all member nations have a say in CASDT affairs, each member nation will assign a delegate to the CASDT Assembly. These delegates will vote and decide upon issues facing the CASDT according to the current administration of each delegate's respective nation. The Assembly will be led by a General Secretariat who will be elected by the delegates.

  • The applying nation must have a democratic system of government or a government system similar to a democracy
  • The applying nation must be willing sign the Inter-Pacific Free Trade Agreement
  • The applying nation must show a commitment of freedom of people and the economy

The Inter-Pacific Free Trade Agreement

The Inter-Pacific Free Trade Agreement
This trade agreement authorizes private corporations from the participating nations to import and export products, services, and jobs freely bypassing any trademark, copyright, and congressional approval of the sovereign nation. Under this agreement, all trades, transactions, and jobs authorized through this agreement may be made struck void by a vote in either nation's Congress.


Section I: Commitment to Labor Laws
Corporations wishing to expand into a participating nation may do so freely but agree to follow the labor laws of the respective nation. Corporations that violate labor laws may be targeted with penalties that may not be limited to legal lawsuits and economic sanctions.

Section II: Trademark & Copyright Protections
Nations are entitled to abide by their own respective Copyright and Trademark laws. The establishment of the IPFTA establishes new international trademark and copyright laws that all member corporations must follow. Corporations violating copyright & trademark laws will be targeted with penalties that may not be limited to legal lawsuits and economic sanctions.

Section III: Inter-Pacific Peace Tribunal (IPPT)
Nations establish an international justice tribunal which oversees corporate litigations and consists of 1 judge from each participating member nation. This tribunal will have authority over any international incidents between participating nations. These may range from copyright and trademark disputes to human rights and immigration cases which may fall under the IPPTs jurisdiction.
IPPT judges are selected at random and each member nation reserves the right to have their judge join or abstain from a ruling. Rulings made by the IPPT are legally binding and not adhering to an IPPT ruling may result in a ban from the CASDT and all future IPFTA trades.


Section IV: Affordable Healthcare & Pharmaceuticals Commitment
Nations agree that affordable healthcare and prescription drugs are a basic right to all citizens. Under this agreement, Nations will allow doctors to travel abroad for peace missions. These missions may include sending doctors and students to medical universities. Giving help and emergency aid to areas needing assistance. This will also authorize private pharmaceutical industries to expand and export their business and supplies abroad drastically reducing demand and costs on prescription drugs in participating nations.

Section V: Agriculture, Livestock, and Dairy Agreement
Nations agree to offer the agreement unrestricted access to private Agriculture, Livestock, and Dairy sectors that were previously not accessed through past trade agreements. Nations agree to export product that meets quality standards of the purchasing nation. Nations that export product that does not meet a nation's standards will not be allowed to be sold in that nation. In the event that any product causes illness or death as a result of foreign contamination, the exporting company can be held liable either via legal lawsuits or loss of trade privileges.

The CASDT Joint-Peace Force

**All CASDT must supply at least 1 military brigade into the Alliance Joint-Peace Force**

Absolute Consent
Alliance Joint-Peace Force (AJPF) peacekeeping operations may only be deployed with the consent of the main parties to the conflict. This requires a commitment by the parties to a political process. Their acceptance of a peacekeeping operation provides The Central Alliance of Strategic Defense and Trade with the necessary freedom of action, both political and physical, to carry out its mandated tasks. In the absence of such consent, a peacekeeping operation risks becoming a party to the conflict; and being drawn towards enforcement action, and away from the fundamental goals of the peacekeeping the process.

The fact that the main parties have given their consent to the deployment of AJPF peacekeeping operation does not necessarily imply or guarantee that there will also be consent at the local level, particularly if the main parties are internally divided or have weak command and control systems. The universality of consent becomes even less probable in volatile settings, characterized by the presence of armed groups not under the control of any of the parties, or by the presence of other spoilers.

Impartiality Mandate
Impartiality is crucial to maintaining the consent and cooperation of the main parties, but should not be confused with neutrality or inactivity. AJPF peacekeepers should be impartial in their dealings with the parties to the conflict, but not neutral in the execution of their mandate.

Just as a good referee is impartial, but will penalize infractions, so a peacekeeping operation should not condone actions by the parties that violate the undertakings of the peace process or the international norms and principles that the AJPF peacekeeping operation intends to uphold.

Notwithstanding the need to establish and maintain good relations with the parties, a peacekeeping operation must scrupulously avoid activities that might compromise its image of impartiality. A mission should not shy away from a rigorous application of the principle of impartiality for fear of misinterpretation or retaliation.

Failure to do so may undermine the peacekeeping operation’s credibility and legitimacy and may lead to a withdrawal of consent for its presence by one or more of the parties

Rule of Force Mandate
AJPF peacekeeping operations are not an enforcement tool. However, they may use force at the tactical level, with the authorization of the sovereign nation, if acting in self-defense and defense of the mandate.

In certain volatile situations, the sovereign nation has given AJPF peacekeeping operations “robust” mandates authorizing them to “use all necessary means” to deter forceful attempts to disrupt the political process, protect civilians under imminent threat of physical attack, and/or assist the national authorities in maintaining law and order. Although on the ground they may sometimes appear similar, robust peacekeeping should not be confused with peace enforcement, as envisaged this charter:

•Robust peacekeeping involves the use of force at the tactical level with the authorization of the sovereign nation and consent of the assisting nation and/or the main parties to the conflict.
•By contrast, peace enforcement does not require the consent of the main parties and may involve the use of military force at the strategic or international level, which is normally prohibited for the Member States, unless authorized by the sovereign nation.

An AJPF peacekeeping operation should only use force as a measure of last resort. It should always be calibrated in a precise, proportional and appropriate manner, within the principle of the minimum force necessary to achieve the desired effect, while sustaining consent for the mission and its mandate. The use of force by an AJPF peacekeeping operation always has political implications and can often give rise to unforeseen circumstances.

Judgments concerning its use need to be made at the appropriate level within a mission, based on a combination of factors including mission capability; public perceptions; humanitarian impact; force protection; safety and security of personnel; and, most importantly, the effect that such action will have on national and local consent for the mission.

The Xeric Imperium is not very democratic. With the Emperor and slavery and all. The Corporations are democratic and any one can become a delegate to the Senate. Sorry, I worded it wrong. It's more of a Parliamentary Corporatocracy.

He/she is an elective monarchy, which is a type of semi-democratic government. The slavery part... well IPFTA tribunal can decide on that.

It basically adds in that link that I have in my sig. (as an example), and can help increase the recognition and therefore membership of the CASDT.

And finally the big issue in the thread; The Imperial Regions of Commerce and The Xeric Imperium having an argument over each other's legitimacy in the agreement. Both nations (and the maker of the OP) willing, I'd be glad to help settle this as a temporary Judge for this case. If they're already solving through other channels let's have them figure it out themselves. Just trying to heal some wounds here so they don't come up again later down the road. Got no problem if my request is denied by any party; as I get it, it's new and you might not want to get things heated right now. However, if it is approved, I'll set up a separate thread for this (so that the application page doesn't get marked by any *cough* arguments that may occur), and can tell you that I will fairly listen to both sides, take into account previous posts/dispatches of said nations, and arrive at a fair, speedy, and public resolution (for a trial with the same characteristics, of course).

Glad to have joined and I hope to see this Alliance grow in size and ability!

Thanks for the suggestions! I have fixed the IPFTA and added the signature. As for the dispute between The Xeric Imperium and the Imperial Regions of Commerce, I would be fine with you being the judge in this case, if both parties say yes to having a trial.
