Whereas the Treaty of the Esquarian Community states that "[t]he Community has a single legal personality and is competent to make treaties with subjects of international law",

The Esquarian Parliament and Council of Esquarium resolve as follows:

1. The President of the Esquarian Community is hereby directed in their authority as representative extraordinary and plenipotentiary of the Community to sign the Treaty Concerning the Freedom of Navigation on the High Seas ("High Seas Treaty").
   
   
2. The President of the Esquarian Community is hereby directed in their authority as representative extraordinary and plenipotentiary of the Community to sign the Treaty on the Elimination of Piracy, Overfishing and Other Criminal Maritime Activities ("Whaling Treaty").
   
   
3. The Parliament and Council hereby ratify the aforementioned treaties.
   
   
4. The Esquarian Secretariat shall, with all due haste, inform the governments of the Aininian Republic and Most Serene Republic of Tuthina of the Esquarian Community's accession to the terms of both treaties as a single High Contracting Party.
   
   
5. The Secretariat is hereby authorised to:
   i. pay all applicable membership fees as prescribed for membership in the International Fisheries Commission (Commission),
   ii. appoint an Esquarian Commissioner to represent the interests of the Community on the Commission.

Visa and Consular Affairs Act
An Act made for purposes pursuant to Article I, Sections 5 and 6, and Article IV, Section 5 of the Treaty of the Esquarian Community.

§1 — Definitions

1. “Community” means the Esquarian Community.
2. “Consular protection” means the provision to a person in a foreign country assistance in the event of death, serious accident or illness, arrest or detention, becoming the victim of violent crime, loss of travel documents, or other circumstances requiring relief or repatriation.
3. “Diplomatic missions” means embassies, consulates, permanent missions, and any other place of diplomatic or consular representation.
4. “Lawful reason”, in respect to §4, means fraud, criminal record, suspected visa type violation, gross offence to public morals, or credible and imminent threat to public health and safety.
5. “Passport” means any document intended to allow the bearer to cross an international frontier.
   
   1. “Diplomatic passport” means a passport issued to a person who is to enjoy diplomatic immunity.
   2. “Official passport” means a passport (other than a diplomatic passport) issued to an employee of a national government or international organization for the purpose of travel related to their duties.
   3. “Community diplomatic passport” means a diplomatic passport issued on behalf of the Community.
   4. “Community official passport” means an official passport issued on behalf of the Community.

§2 — Consular protection

1. Member States are obliged to provide consular protection to Esquarian Citizens at their diplomatic missions located outside the Community in the event that the Esquarian Citizen is unable to obtain the consular protection of his or her nationality.
2. Member States may require that a foreign national seeking consular protection under the provisions of this Act and pursuant Esquarian law provide proof of Esquarian Citizenship.

§3 — Community diplomatic affairs

1. Member States must, at their diplomatic missions, display the flag of the Esquarian Community alongside their national flag in a position of equal prominence. The national flag may take the place of honor.
2. All passports issued by Member States must conspicuously display the words “Esquarian Community” on the front cover in at least one official language of the Community.
3. The Secretariat of the Community will issue Community diplomatic passports and Community official passports to officials and employees of the Community who are engaged in travel related to their duties.
4. The following officials are entitled to a Community diplomatic passport:
   
   1. The President of the Esquarian Community
   2. The President of the Council of Esquarium
   3. High Representatives of the Community accredited to foreign states or international organizations
   4. Officials and staff of Community diplomatic missions
   5. Other officials as designated by the President of the Esquarian Community
5. Employees of the Community who are not entitled to a Community diplomatic passport may be issued a Community official passport when engaged in travel related to their duties at the discretion of the Esquarian Secretariat.

§4 — Visa policy

1. The Community constitutes a single area for visa purposes.
2. Member States will cease to issue visas with solely domestic validity on 1 July 2018 and will from that date issue visas in the name of the Community.
3. Nationals of non-Community states which do not have a visa waiver are required to obtain a visa to present themselves at a port of entry to a Member State.
4. Member States will admit non-Community nationals at their ports of entry—
   
   1. when they are in possession of a valid Community visa issued by any duly empowered authority, and;
   2. when the visa was first used in the country of issuance, and;
   3. when the visa has validity throughout the Community, and;
   4. when no lawful reason exists for the individual’s exclusion.
5. All nonimmigrant visas have validity throughout the Community for the purpose of exercising freedom of movement.
6. Immigrant visas have validity in the country of issuance.
7. Non-Community nationals lawfully admitted into a Member State without visa shall be considered to have been issued a nonimmigrant visa by the Member State upon arrival.
8. The ability of Member States to restrict the ability of non-Community nationals to work, study or access public services shall not be limited by this Act.
9. States listed in Schedule A of this act constitute the visa-waiver list. Citizens of such states may enter the Community without a visa for 90 days in any 180-day period for personal or business purposes upon presentation of a passport valid for the length of the stay, provided that they may not engage in paid or unpaid work or study while in the Community and notwithstanding other reasons for inadmissibility. The Council of Esquarium may add or remove states from the visa-waiver list.

1. People’s Republic of Namor

Taras Pashkov read over the new bill that had been proposed by the Montecaran delegation. Glancing word by word, he started to obtain some sort of understanding of what the Montecaran government wanted to propose.

Sigh.

It seems like a multifaceted topic: consular assistance, requiring all visas to be valid not just for travel into Luziyca, but rather the entire Esquarian Community, and of course, giving the Esquarian Community equal prominence with the host country.

And then there is the nation on the visa-waiver list: Namor. The nation which just a couple of months ago was slated for inclusion for sanctions under the Katsarou-Vasiliev Act that was not passed (fortunately).

He knew that with the National Luziycan Party in the House of Representatives, the bill presented by the Montecaran delegation, as it currently stands, would be a bit difficult to swallow politically. The fact that the EC flag would have to be just as prominent as the Luziycan flag at all Luziycan diplomatic missions, and the granting of visa-waivers to Namorese nationals would certainly piss off many people in Luziyca, especially those skeptical to the maintenance of the Esquarian Community.

Of course, it does make sense to Pashkov: with the passage of the Labour and Residency Act, it really makes no sense for the Christian Republic to only issue visas granting people to not travel to the rest of the Community. As well, the Liberal governments of Pivec and Agapov have both been determined to make Luziyca a more cooperative state with the rest of the international community. And of course, allowing Namorese to be further integrated into the EC would, in an ideal world, reduce the chances of a Fourth Namo-Luziycan War, no matter what nationalists on both sides of the Gulf wish.

After consolidating his thoughts together, and a quick sip of water, Taras Pashkov was ready to articulate his country's position.

"Mr. President, the Christian Republic supports the ideals presented in the proposal tabled by the Montecaran delegation. In particular, the Christian Republic wholeheartedly approves of much of the proposal as it currently stands right now."

"However, the Christian Republic of Luziyca objects to requiring our diplomatic missions to display the flag of the Esquarian Community alongside our flag in a position of equal prominence. If we are to require all diplomatic missions of member nations to display both flags, then we run the risk of increasing clutter on our embassy sites. The clutter could detract from the architecture of the embassies of member states, thereby increasing the likelihood that the embassies of smaller member states, such as Montecara or Katranjiev would be a bit more difficult to see at first glance."

"If the Montecaran delegation is willing to remove that section, Mr. President, the Christian Republic would be more than willing to sponsor this bill."

After reading an updated draft presented by the Montecaran delegation, Pashkov had this to say:

WHEREAS the People's Republic of Namor has openly explored expanded cooperation between itself and states such as the Union of Nautasian Islamic Republics, Auspicious Republic of Xiaodong, and the State of Razaria,

WHEREAS the states aforementioned are openly hostile towards the values of liberty, democracy, and justice espoused by the Esquarian Community and its member states,

WHEREAS the states aforementioned have made repeated military threats towards member states of the Esquarian Community,

WHEREAS said expanded cooperation between Namor and the states aforementioned has included the potential sharing of intelligence information and military technology, and the lifting of Namorese tariffs against states currently sanctioned by the Esquarian Community,

WHEREAS these actions could embolden states openly hostile towards the Esquarian Community and its members,

THEREFORE, the President of the Esquarian Community is hereby directed to denounce the Association Agreement between the Esquarian Community and the People's Republic of Namor.
