PREAMBLE
Herby defines the Council of Elysian States (on the Prevention of Genocide) as an international legislative body with the power to levy declarations, deploy observers and peacekeepers for the sake of preserving ethnic identity, diminish racism and preserve the right to self-determination.
CLAUSES
1 - SECRETARY-GENERAL
The Secretary-General of the Council of Elysian States is the primary member of the Secretariat and President of the General Assembly.
A. Defines the Secretary-General of the Council of Elysian States is the elected leader of the Organization and President of the General Assembly, designed to moderate and oversee the debate of the General Assembly.
B. The Secretary-General of the Council of Elysian States is elected once every 6 months and must serve on the position of Ambassador from a signatory nation before standing for the candidacy before the Council.
C. The Secretary-General has the full discretion to approve or disapprove applications for membership to the Council of Elysian States, but the General Assembly may bypass him/her in the event that the Secretary-General demonstrates political and national bias, and may vote in members with a 1/2 majority.
D. The Secretary-General is be elected by 2/3rds majority and removed by 2/3rds majority.
II - GENERAL ASSEMBLY
The General Assembly is the legislative body of the Council of Elysian States.
A. The General Assembly of the Council of Elysian States is occupied with the signatories of the Charter and the Ormania Declaration.
B. The General Assembly of the Council of Elysian States may pass resolutions concerning the topic of Human Rights, Genocide and Degradation of peoples in the region of Elysium and directives in the event of crisis.
C. The General Assembly, in intention to investigate disturbances, may call for the deployment of Observers of the Council of Elysian States (OCES) within the boundaries of a directive to investigate and gather information on the state of a defined area. The Observers may not act unless given a specific mission and objective.
D. In the event of the confirmation of the definition of genocide is taking place in a specific area, the General Assembly may call for international intervention within the boundaries of a directive, but must define the means of intervention (ex. foreign aid, foreign military intervention).
E. The General Assembly may call for the creation of a Council Peacekeeping Mission (CPM) within the boundaries of a directive. The General Assembly must designate a certain signatory(ies) of the Charter to carry out such a mission with a specific objective.
F. The Council Peacekeeping Missions must designate themselves distinctly by the wearing of white berets or helmets and white armbands.
III - INTERNATIONAL COURT OF JUSTICE
The International Court of Justice shall be the principal judicial organ of the Council of Elysian States.
A. All Members of the Council of Elysian States are ipso facto parties to the International Court of Justice.
B. Each Member of the Council of Elysian undertakes to comply with the decision of the International Court of Justice in any case to which it is a party.
C. The General Assembly may request the International Court of Justice to give an advisory opinion on any legal question.
D. The Justices of the International Court of Justice shall consist of 4 elected members, 1 from the 4 districts of the region of Elysium, and a Chief Justice, appointed by the Secretary-General.
E. Justices serve for life.
F. The International Court of Justice may hold fair trial of any person disrupting the principles of the Council of Elysian States ay any given time.
IV - MEMBERSHIP
All members may apply via diplomatic communication to the Council of Elysian States.
A. All members must be signatories to the Ormania Declaration on the Prevention of Genocide and Preservation of Human Rights & the Charter of the Council of Elysian Nations on the Prevention of Genocide.
B. The Secretary-General has the full discretion to approve or disapprove applications for membership to the Council of Elysian States.
C. The General Assembly may bypass the Secretary-General in the event that the Secretary-General demonstrates political and national bias, and may vote in members with a 1/2 majority.
V - PARLIAMENTARY PROCEDURE
A. All approvals for membership made by the General Assembly requires a simple (1/2) majority.
B. All resolutions and directives must be approved by a standard (2/3) majority.
C. All motions to remove the Secretary-General must be approved by a overwhelming (3/4) majority.
D. All elections of a candidate for the Secretary-General must be approved by a standard (2/3) majority.
E. All amendments to the Charter of the Council of Elysian States must be approved a standard (2/3) majority.
VI - DEFINITION OF GENOCIDE
Herby defines genocide as,
A. The encouragement of the classification, dehumanization, polarization, preparation, extermination, and denial against minorities and/or majorities by regimes and/or terrorist organizations via the use of violence, starvation, deportation and deprivation;
B. The mass killing of minorities and/or majorities by regimes and/or terrorist organizations via the use of violence, starvation, deportation and deprivation;
C. The forced removal and displacement of minorities and/or majorities by regimes and/or terrorist organizations via the use of violence, starvation, deportation and deprivation;
D. The enslavement and brutalisation of any minorities and/or majorities by regimes and/or terrorist organizations via the use of violence, starvation, deportation and deprivation.
