Securing America's Future Enforcement Act
A BILL
To provide that wages earned and self-employment income derived by individuals who were illegally in the United States shall not be credited for coverage under the Social Security Act, to provide for the types of identification recognized by the federal government and financial institutions, to provide for reimbursement for state officers or employees to receive training to perform immigration enforcement actions, to make permament the E-Verify pilot program, and to require its use by employers, to amend the Immigration and Nationality Act and title IV of the Social Security Act to provide for the denial of family classification petitions filed by an individual who owes child support arrearages, to reform the Section 8 rental assistance program to exclude support for families harboring illegal aliens or failing to meet work requirements, and to give preference in such assistance to veterans, and to prohibit the issuing of driver’s licenses to illegal aliens.

SECTION 1: SHORT TITLE
This Act may be cited as the "Securing America's Future Enforcement Act".
SECTION 2: LIMITATIONS ON COVERAGE
SECTION 3: FORMS OF ACCEPTABLE IDENTIFICATION
- The Social Security Act is amended to clarify that wages earned or self-employment income derived by individuals who were not citizens or nationals of the United States and who were in the country illegally shall not be credited for coverage under the OASDI program.
- These amendments shall apply with respect to wages earned or self-employment income derived before, on, or after the date of enactment of this Act. The Commissioner of Social Security shall as soon as is practicable recompute all primary insurance amounts as is necessary to carry out the amendments.
SECTION 4: BORDER SECURITY AND IMMIGRATION ENFORCEMENT
- Limits the forms of photo identification that may be recognized by a Federal agency or a financial institution to:
- A Social Security card accompanied by a photo identification card issued by the Federal government or a State government;
- a driver’s license or identification card that is in compliance with the REAL ID Act of 2005;
- a passport issued by the United States or a foreign government; or,
- a USCIS photo identification card issued by the Secretary of Homeland Security.
- This Act shall come into effect after six months.
SECTION 5: MANDATORY EMPLOYMENT VERIFICATION
- Authorizes funds for FY2008 for reimbursing law enforcement officers or employees of a State or subdivision thereof for training in performing immigration enforcement actions.
- Such funds may only be used for covering transportation, lodging, subsistence and other per diem needs for such officers or employees, or for covering temporary replacement during such training.
SECTION 6: NO ILLEGALS IN THE CAPITOL
- Makes the basic pilot program established by Section 401(b) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, herein "E-Verify", a permament program. Requires every entity employing one or more persons in the United States to make use of the E-Verify program. Directs the Secretary of Homeland Security to establish a toll-free telephone line for compliance.
- The date required for compliance shall be, from the date of passage of this Act:
- 1 year for Federal agencies, Federal contractors, and entities employing over 250 employees.
- 2 years for entities employing over 100 employees.
- 3 years for entities employing over 30 employees.
- 4 years for all other entities.
- Every entity that employs one or more employees in the United States shall verify within 4 years of passage of this Act that every employee is authorized to work in the United States.
No funds may be made available for any contract for the provision of goods or services in the Capitol to any contractor who employs individuals and does not participate in the E-Verify and remain in compliance with these mandates.
SECTION 7: DENIAL OF IMMIGRATION PETITION TO THOSE DELINQUENT IN CHILD ARREARS
Prohibits the Secretary of Homeland Security from approving any immigration petition to a petitioner certified as delinquent in child support arrears.
SECTION 8: REVOCATION OF PREVIOUSLY GRANTED IMMIGRATION PETITIONS
Authorizes the Secretary of Homeland Security to revoke approval of any immigration petition that would have been denied under Section 7 of this Act.
SECTION 9: LIMITATIONS ON RENTAL ASSISTANCE
Prohibits rental assistance under Section 8 of the United States Housing Act of 1937 from being provided to any family that harbors an illegal alien or convicted felon, and to any family unless each member of that family who is over 18 years old performs at least 20 hours of work activity each week. Otherwise places a 5 year limit on rental assistance.
SECTION 10: PREFERENCE IN RENTAL ASSISTANCE
Requires that preference in rental assistance under Section 8 of the United States Housing Act of 1937 be given to any family with a resident member who is a veteran of the United States uniformed services.
SECTION 11: PROHIBITION ON ISSUING DRIVER’S LICENSES TO ILLEGAL ALIENS
Amends the REAL ID Act of 2005 to strike provisions permitting issuing driver’s licenses to illegal aliens. Prohibits a State from issuing a driver’s license to an individual who has not demonstrated lawful status under the provisions of the REAL ID Act of 2005.
