Official Name: Public Divulgence of Prescription Discounts and Real-Time Recipient Prescription Expense Act

Section I: Public disclosure of drug discounts

Section 1150A of the Social Security Act (42 U.S.C. 1320b–2342 U.S.C. 1320b–2342 U.S.C. 1320b–2342 U.S.C. 1320b–2342 U.S.C. 1320b–23) is amended—

(1)in subsection (c), in the matter preceding paragraph (1), by inserting (other than as permitted under subsection (e)) after disclosed by the Secretary; and
(2)by adding at the end the following new subsection:
(e)Public availability of certain data
(1)In general
To allow the comparison of PBMs’ ability to negotiate rebates, discounts, direct and indirect remuneration fees, administrative fees, and price concessions and the number of such rebates, discounts, direct and indirect remuneration fees, administrative fees, and price concessions that are passed through to plan sponsors, beginning January 1, 2021, the Secretary shall make available on the Internet website of the Department of Health and Human Services the information concerning the second preceding calendar year provided to the Secretary on generic dispensing rates (as described in paragraph (1) of subsection (b)) and information provided to the Secretary under paragraphs (2) and (3) of such subsection that, as determined by the Secretary, is concerning each PBM.

(2)Availability of data
In carrying out paragraph (1), the Secretary shall ensure the following:

(A)Confidentiality
The data represented in such paragraph is presented in a manner that restricts the disclosure of information, concerning an individual prescription or an individual plan, on rebates, discounts, direct and indirect remuneration fees, administrative fees, and price concessions.

(B)Class of drug
The data expressed in such paragraph is made open by class of drug, using an existing classification system, but only if the class contains such number of drugs, as designated by the Secretary (but not fewer than three drugs), to guarantee the confidentiality of exclusive knowledge or other data that is restricted to be disclosed under subparagraph (A).


Section II: Requiring prescription drug plan sponsors to incorporate real-time benefits data as part of such sponsor’s electronic prescription program under the Medicare program

Section 1860D–4(e)(2) of the Social Security Act (42 U.S.C. 1395w–104(e)(2)42 U.S.C. 1395w–104(e)(2)42 U.S.C. 1395w–104(e)(2)42 U.S.C. 1395w–104(e)(2)42 U.S.C. 1395w–104(e)(2)) is amended—

(1)in subparagraph (D), by striking To the extent and inserting Except as provided in subparagraph (F), to the extent; and
(2)by adding at the end the following new subparagraph:
(F)Real-time benefit data
(i)In general
Not later than January 1, 2021, the program shall implement real-time benefit tools that are able of combining with a prescribing health care professional’s electronic prescribing or electronic health record system for the release of formulary and benefit data in real-time to prescribing health care specialists. Concerning a covered part D drug, such tools shall be able to transmit such information specific to an individual registered in a prescription drug plan. Such information shall include the following:

(I)A list of any clinically appropriate options to such drugs included in the formulary of such plan.
(II)Cost-sharing data for such drug and such alternatives, including a description of any variance in cost-sharing based on the pharmacy dispensing such drug or such alternatives.
(III)Data relating to whether such drug is included in the formulary of such plan and any prior authorization or other utilization management specifications applicable to such drug and such alternatives so included.
(ii)Electronic transmission
The provisions of subclauses (I) and (II) of clause (ii) of subparagraph (E) shall apply to an electronic transmission described in clause (i) in the same manner as such provisions apply concerning an automated release described in clause (i) of such subparagraph.

(iii)Special rule for 2021
The program shall be deemed in compliance with clause (i) for 2021 if the program complies with the prerequisites of section 423.160(b)(7) of title 42, Code of Federal Regulations (or a successor ordinance), for such year.

(iv)Rule of composition
Nothing in this subparagraph shall be interpreted as to allow a real-time benefits tool to direct an individual, without the acquiescence of the individual, to a particular pharmacy or pharmacy setting over their preferred pharmacy setting nor prohibit the indication of a preferred pharmacy under such tool.


Section III: Sense of Congress concerning the need to grow commercially obtainable drug price matching platforms

Congress senses that—

(1)commercially obtainable prescription price matching platforms can, at no cost, help patients find the lowest price for their prescriptions at their local pharmacy;
(2)such platforms should be combined, to the maximum extent possible, in the health care distribution ecosystem; and
(3)pharmacy benefit managers should work to publish generic and brand name drug prices to such platforms to ensure that—
(A)patients can benefit from the most economical possible price available to them; and
(B)overall prescription prices can be reduced as more educated purchasing choices are made based on price transparency.

An Act to Combat Online Predators and Prevent Scams Targeted at Senior Americans

Overview: There is a widespread issue in the United States regarding online predators stalking and preying on Americans, particularly younger Internet users. Likewise, senior citizens have increasingly become targets of scams. These are widespread issues and crimes that must be addressed and studied in order to deter their continuance. It is this Congress’ duty to protect Americans and thus this Act will be a first step towards combating online predators and scams.

Section I - Definitions:

a) Online Predator - A person or group of people who commit the act of interstate stalking, as defined by Chapter 110A of Title 18, United States Code, Section 2261A.

b) Senior Scams - A scheme or plan used to deliberately trick or mislead older people for some benefit to the perpetrator, often monetary.

Section II - Provisions:

a) Except as provided in paragraph (b), if the victim of an online predator(s) is under the age of 18 years, the maximum imprisonment for the offense is 5 years greater than the maximum term of imprisonment otherwise provided for that offense in Chapter 110A of Title 18, United States Code, Section 2261A. This amended section shall henceforth be referred to as "Enhanced penalty for stalkers of children."

b) Paragraph (a) shall not apply to a person who violates Section 2261A if the person is subject to a sentence under section Chapter 110A of Title 18, United States Code, Section 2261(b)(5); and the person is under the age of 18 at the time the offense occurred; or the victim of the offense is not less than 15 nor more than 17 years of age and not more than 3 years younger than the person who committed the offense at the time the offense occurred.

c) No later than 1 year after the date of the enactment of this Act, the Attorney General shall submit a report to Congress, which shall include an evaluation of Federal, Tribal, State, and local efforts to enforce laws relating to stalking; and identify and describe those elements of such efforts that constitute the best practices for the enforcement of such laws. This report shall be issued as the Report on Best Practices Regarding Enforcement of Anti-Stalking Laws.

d) There is established a Senior Scams Prevention Advisory Group and thus referred to in this Act as the “Advisory Group”. The Advisory Group shall be composed of stakeholders such as the following individuals or the designees of those individuals: the Chairman of the Federal Trade Commission; the Attorney General; the Director of the Bureau of Consumer Financial Protection; representatives from each of the following sectors, including trade associations, to be selected by Federal Trade Commission: retail, gift cards, telecommunications, wire-transfer services, senior peer advocates, consumer advocacy organizations with efforts focused on preventing seniors from becoming the victims of scams, financial services, including institutions that engage in digital currency, prepaid cards; a prudential regulator, as defined by the Consumer Financial Protection Act of 2010 (12 U.S.C. 5481); the Director of the Financial Crimes Enforcement Network; and any other Federal, State, or local agency, industry representative, consumer advocate, or entity, as determined by the Federal Trade Commission.

e) A member of the Advisory Group shall serve without compensation in addition to any compensation received for the service of the member as an officer or employee of the United States, if applicable. The Advisory Group shall collect information on the existence, use, and success of educational materials and programs for retailers, financial services, and wire-transfer companies, which may be used as a guide to educate employees on how to identify and prevent scams that affect seniors. This guide shall include useful information: for retailers, financial services, and wire transfer companies for the purpose described in paragraph (f); for training for employees on ways to identify and prevent senior scams; for best practices for keeping employees up to date on current scams; for the most effective signage and placement in retail locations to warn seniors about scammers’ use of gift cards, prepaid cards, and wire transfer services; for suggestions on effective collaborative community education campaigns; for available technology to assist in identifying possible scams at the point of sale; and for other information that would be helpful to retailers, wire transfer companies, financial institutions, and their employees as they work to prevent fraud affecting seniors.

f) Based on the required studies and guides in paragraph (e), the Advisory Group shall identify inadequacies, omissions, or deficiencies in those educational materials and programs for the categories in paragraph (e) and their execution in reaching employees to protect older adults; and create model materials, best practices guidance, or recommendations to fill those inadequacies, omissions, or deficiencies that may be used by industry and others to help protect older adults from scams. The Chairman of the Federal Trade Commission shall make the materials or guidance created by the Federal Trade Commission described in this paragraph and paragraph (e) publicly available; and encourage the use and distribution of the materials created under this subsection to prevent scams affecting seniors by governmental agencies and the private sector.

g) The Elder Abuse Prevention and Prosecution Act (34 U.S.C. 21711(c)(2)) is amended so that the Federal Trade Commission must provide relevant information and updates of newly created materials, guidance, or recommendations of the Senior Scams Prevention Advisory Group established under paragraph (e) and (f) of this Act; any relevant views or considerations made by members of the Advisory Group that were not included in the Advisory Group’s model materials or considered an official recommendation by the Advisory Group; the Advisory Group’s findings about senior scams and industry educational materials and programs; and any recommendations on ways stakeholders can continue to work together to reduce scams affecting seniors in an issued Report from the Senior Scams Prevention Advisory Group.

Overview: This legislation seeks to amend the United States Code (henceforth referred to as "USC") to narrow the appropriate use of euthanasia, following the precedent established by the Preventing Animal Cruelty and Torture Act, effectively ending the needlessly cruel and inhumane practice of "kill shelters" in the United States by rendering inappropriate euthanasia "criminal" in an ex negativo fashion. Ensuring this is not an unfunded mandate, this legislation also allocates funding from the budget of the United States Department of Agriculture (henceforth referred to as USDA) to non-profit organizations involved in the care, transportation, distribution, and foster care/adoptions of un-housed and in-need animals.

Section 1: This legislation recognizes the inhumane nature of "kill shelters," with over 1.5 million animals euthanized on a yearly basis, often by painful means under arbitrary policies. Moreover, this legislation recognizes that multiple states, counties, and municipalities have adopted "no-kill policies," ending the practice of "kill shelters," a policy which has in most cases paid for itself given revenue from animal adoption.

Section 2: Amending USC Title 7 Chapter 54 §2143. 'Standards and certification process for humane handling, care, treatment, and transportation of animals'.

a. Part A of USC Title 7 Chapter 54 §2143 references 'the appropriate use of euthanasia.' This section is amended to to include the following sub-parts:

(i) Appropriate use of euthanasia is defined as the euthanization and destruction only of animals which are terminally ill, under severe and irreparable pain, are violent to the point of causing bodily harm to themselves or others. Appropriate euthanasia does not cover animals euthanized and destroyed out of convenience, economic concern, or other hardship/burden.

(ii) Appropriate use of euthanasia requires consultation with an appropriately licensed veterinarian, along with written consent of said veterinarian.

Section 3: Enforcement of the amendment to the USC.

a. The Animal Welfare Litigation Program within the United States Department of Justice Division on Environment and Natural Resources will be responsible for the affirmative litigation of this amendment, in addition to its existing responsibility to enforce the provisions of the Animal Welfare Act.

b. The provisions of this legislation will be covered in the existing Inspector General's hotline for animal crimes.

c. Following existing precedent for the enforcement of violations of USC Title 7 Chapter 54, violations of Section 2 will be prosecuted as misdemeanours unless prosecution determines aggravating factors are at play, or repeat offense occurs, following Department of Justice guidelines.

Section 4: Funding alternative shelters.

a. Funds are to be allocated from the USDA budget for Food, Nutrition and Consumer Services to a grant program providing registered non-profit organizations involved in the transportation, housing, care, distribution, and veterinary services of un-housed shelter animals with needed annual funding.

i. This budget will amount to no less than 150 million dollars per annum.

ii. This budget will not provide funding to non-profit organizations which are themselves grant-giving.

b. This grant program will be overseen by the USDA Office of the Inspector General to ensure fair and ethical practices are used in the allocation of grant funding.
