Dear Colleagues,

Attached are two bills designed to improve national security in the U.S. while simultaneously protecting civil liberties. The first is the Protecting American Privacy Act, which aims to redesign the process of citizen data collection by the NSA. It establishes FISA Court warrants as the sole means of obtaining such data, ending the unconstitutional authority granted to the NSA that allows them to collect phone records, GSP data, search history, and browsing information. Additionally, it strengthens oversight processes to prevent the FISA Court from being too permissive with granting warrants by providing the amicus curiae, established by the USA FREEDOM Act, with full access to court materials. Additionally, it prevents private information from being retained for more than three years if a crime or national security concern has not been discovered. Finally, it mandates that all FISA Court decisions with regard to warrants are made public after the conclusion of related investigations.

PAPA would be an unprecedented step towards dialing back our mass surveillance programs. We would appreciate bipartisan support in this effort. Currently, Reps. Nez and Vohoffsky are on the bill, along with Sen. Winthrop. We would like more support.

The second bill is the Protecting American Diplomats Act. In response to recent events in Israel where our nation lost an ambassador to terrorists, it is imperative that we boost security measures to protect members of the U.S. Foreign Service. The legislation is a State Department authorization bill that reallocates the existing $10 billion funding for diplomatic programs to focus on security for diplomatic personnel. Additionally, the bill creates new standards for security hiring and establishes new guidelines for diplomat training for emergencies.

If passed, the bill would be the first State Department Authorization bill in 16 years. It would be a big step forward for making our service members feel safe abroad.

Overview: Introduced in the wake of the terrorist attacks on September 11, 2001, the Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act (USA PATRIOT Act) opened up new justifications and methods for mass surveillance by the U.S. government. In particular, criticism of the law has focused on the sweeping phone records surveillance exposed by former NSA contractor [not-Edward Snowden] in 2013, but there are many additional aspects to the statute and how it came to be that are unfamiliar to many. One such concern are the “secret law” loopholes that allow the government to secretly conduct surveillance outside the publicly understood FISA process. This bill seeks to protect the civil liberties of American residents through several reforms to the USA PATRIOT Act.

Section 1: PREVENTING WARRANTLESS SEARCHES AND DATA COLLECTION

Hereby amends Section 215 of the USA PATRIOT Act to:

    a) Officially and permanently end all authority for the National Security Administration to collect the personal phone call records of private American citizens;

    b) Prohibit the warrantless collection of cell site location, GPS information, browsing history and internet search history;

    c) Establish a three-year limitation on retention of information that is not foreign intelligence or evidence of a crime and enforces that the Foreign Intelligence Surveillance Council (FISA) Court reviews compliance with these procedures.

Section 2: REFORMING INDEPENDENT OVERSIGHT
Hereby expands the duties and powers of the independent amici curiae of the FISA Court, also known as “independent reviewers,” by:

    a) Granting the amici curiae access to every opinion, transcript, pleading or other document of the FISA Court and the FISA Court of Review, and permitting them to raise any issues of concern with the Court, including but not limited to abuse in regard to warrantless authority;

    b) Ensuring that every FISA Court opinion is made public after related investigations are closed;

    c) Reestablishing that the preemptive release of any protected/classified information being analyzed by the FISA Court will hold leakers liable to prosecution under the Espionage Act of 1917.

Section 3: CLOSING “SECRET LAW” LOOPHOLES
Hereby ensures that the United States government cannot conduct mass surveillance outside of established review procedures by:

    a) Establishing FISA as the exclusive means for collecting communicative records for foreign intelligence purposes;

    b) Establishing probable cause FISA warrants as the exclusive means for collecting the phone records, cell site location, GPS information, internet search history, and browsing history;

Overview: American diplomats know all too well the immense danger that they put themselves in while serving their country abroad. As defenders of the ideals of liberty, justice, and human rights, they put themselves at risk for the betterment of our world and the protection of our nation. It is imperative that those who are working towards wold peace are provided with the necessary resources to defend themselves from attack. It is the least our nation can do for those who are doing so much for us.

This Act seeks to authorize additional funds to be appropriated to improve the security of U.S. Embassies throughout the world. It provides funding for the management and operations of the Department of State at fiscally responsible levels, while strengthening security at our diplomatic facilities overseas. Our embassies and personnel are targets for those seeking to harm the United States, and more needs to be done to ensure their safety.

Section 1: AUTHORIZATION OF FUNDS

The following amounts are authorized to be appropriated for the Department of State under “Administration of Foreign Affairs” to carry out the authorities, functions, duties, and responsibilities in the conduct of foreign affairs of the United States, and for other purposes authorized by law:

    (1) DIPLOMATIC AND CONSULAR PROGRAMS: For “Diplomatic and Consular Programs," $10,000,000,000 for fiscal year 2020;

    (A) BUREAU OF DEMOCRACY, HUMAN RIGHTS, AND LABOR: Of such amounts, not less than $25,000,000 for fiscal year 2014 is authorized to be appropriated for the Bureau of Democracy, Human Rights and Labor.

    (B) WORLDWIDE SECURITY PROTECTION: Of such amounts, not less than $3,000,000,000 for fiscal year 2014 is authorized to be appropriated for worldwide security protection.


    (2) CAPITAL INVESTMENT FUND: For “Capital Investment Fund”, $75,000,000 for fiscal year 2014;

    (A) EDUCATIONAL AND CULTURAL EXCHANGE PROGRAMS: For “Educational and Cultural Exchange Programs”, $535,000,000 for fiscal year 2014, of which funding for educational and cultural programs that occur in countries or regions that are at risk of, in, or are in transition from, conflict or civil strife should be prioritized.


    (3) CONFLICT STABILIZATION OPERATIONS: Of such amounts, not less than $45,000,000 for fiscal year 2014 is authorized to be appropriated for "Conflict Stabilization Operations."

Section 2: EMBASSY SECURITY AND PERSONNEL REQUIREMENTS

a) Not later than 30 days after the date of the enactment of this section, the Secretary of State shall submit to the appropriate congressional committees a report, in classified form, that contains an initial list of diplomatic and consular posts designated as high risk, high threat posts.

b) Designations Before Opening Or Reopening Posts: Before opening or reopening a diplomatic or consular post, the Secretary shall determine if such post should be designated as a high risk, high threat post.

c) The Secretary of State shall complete a strategic review of the Bureau of Diplomatic Security of the Department of State to ensure that the mission and activities of the Bureau are fulfilling the current and projected needs of the Department of State, including assessments of:

    (1) staffing needs for both domestic and international operations;
    (2) facilities under chief of mission authority adhering to security standards;
    (3) necessary security training provided to personnel under chief of mission authority for expected assignments and objectives;
    (4) programs being carried out by personnel with the necessary experience and at commensurate grade levels.

d) The Secretary may transfer to, and merge with, any appropriation for embassy security, construction, and maintenance such amounts appropriated for fiscal year 2020 for any other purpose related to the administration of foreign affairs on or after December 30, 2019, if the Secretary determines such transfer is necessary to provide for the security of sites and buildings in foreign countries under the jurisdiction and control of the Secretary.

e) The Overseas Security Policy Board’s security standards for United States diplomatic and consular posts must apply to all such security personnel posts regardless of the duration of their occupancy.

Section 3: EMBASSY SECURITY AND PERSONNEL TRAINING

a) Individuals assigned permanently to or who are in long-term temporary duty status as designated by the Secretary at a high risk, high threat post shall receive security training described in subsection (b) on a mandatory basis in order to prepare such individuals for living and working at such posts.

(b) Security Training Described: Security training referred to in subsection (a)—

    (1) is training to improve basic knowledge and skills; and

    (2) may include—

    (A) an ability to recognize, avoid, and respond to potential terrorist situations, including a complex attack;

    (B) conducting surveillance detection;

    (C) providing emergency medical care;

    (D) ability to detect the presence of improvised explosive devices;

    (E) minimal firearms familiarization; and

    (F) defensive driving maneuvers.

Senator Doyle,
I am the original sponsor of the USA Freedom Act. I had championed that legislation in the hopes that we could pass some immediate reforms to the Patriot Act. President Baharia ended up signing it. However, the government's continued broad application for phone records is not consistent with what I tried to accomplish with the Freedom Act. Seizing phone records of millions of innocent people is excessive and un-American.

As such, I would be happy to cosponsor this. It is long past time for the government to legally recognize the dangers posed by overreaches like looking at search history. It poses a threat to the First Amendment, and while I believe it is constitutional, it is not morally sound. I look at everything through a constitutional lens, and this bill provides the necessary clarity that my law lacked.

"Honestly, I'm not completely sure a bill like that could exist. The wording would have to be very, very specific for it to even pass the House and Senate with a normal majority, let alone 2/3rds and all the states too. Personally, I think it'd be easier to get the ERA passed is to win Virginia later this year, then win the Senate and the Presidency next year, then pass an extension for the amendment, and then hope the courts end up agreeing with us somehow but that's just me, both ways seem annoyingly hard.

The legislation is a State Department authorization bill that reallocates the existing $10 billion funding for diplomatic programs to focus on security for diplomatic personnel. Additionally, the bill creates new standards for security hiring and establishes new guidelines for diplomat training for emergencies.

If passed, the bill would be the first State Department Authorization bill in 16 years. It would be a big step forward for making our service members feel safe abroad.

In particular, criticism of the law has focused on the sweeping phone records surveillance exposed by former NSA contractor [not-Edward Snowden] in 2013, but there are many additional aspects to the statute and how it came to be that are unfamiliar to many. One such concern are the “secret law” loopholes that allow the government to secretly conduct surveillance outside the publicly understood FISA process. This bill seeks to protect the civil liberties of American residents through several reforms to the USA PATRIOT Act.

Section 1: PREVENTING WARRANTLESS SEARCHES AND DATA COLLECTION

Hereby amends Section 215 of the USA PATRIOT Act to:

    a) Officially and permanently end all authority for the National Security Administration to collect the personal phone call records of private American citizens;

    b) Prohibit the warrantless collection of cell site location, GPS information, browsing history and internet search history;

    c) Establish a three-year limitation on retention of information that is not foreign intelligence or evidence of a crime and enforces that the Foreign Intelligence Surveillance Council (FISA) Court reviews compliance with these procedures.

Section 2: REFORMING INDEPENDENT OVERSIGHT
Hereby expands the duties and powers of the independent amici curiae of the FISA Court, also known as “independent reviewers,” by:

    a) Granting the amici curiae access to every opinion, transcript, pleading or other document of the FISA Court and the FISA Court of Review, and permitting them to raise any issues of concern with the Court, including but not limited to abuse in regard to warrantless authority;

    b) Ensuring that every FISA Court opinion is made public after related investigations are closed;

    c) Reestablishing that the preemptive release of any protected/classified information being analyzed by the FISA Court will hold leakers liable to prosecution under the Espionage Act of 1917.

Section 3: CLOSING “SECRET LAW” LOOPHOLES
Hereby ensures that the United States government cannot conduct mass surveillance outside of established review procedures by:

    a) Establishing FISA as the exclusive means for collecting communicative records for foreign intelligence purposes;

As defenders of the ideals of liberty, justice, and human rights, they put themselves at risk for the betterment of our world and the protection of our nation. It is imperative that those who are working towards wold peace are provided with the necessary resources to defend themselves from attack. It is the least our nation can do for those who are doing so much for us.

This Act seeks to authorize additional funds to be appropriated to improve the security of U.S. Embassies throughout the world. It provides funding for the management and operations of the Department of State at fiscally responsible levels, while strengthening security at our diplomatic facilities overseas. Our embassies and personnel are targets for those seeking to harm the United States, and more needs to be done to ensure their safety.

Section 1: AUTHORIZATION OF FUNDS

The following amounts are authorized to be appropriated for the Department of State under “Administration of Foreign Affairs” to carry out the authorities, functions, duties, and responsibilities in the conduct of foreign affairs of the United States, and for other purposes authorized by law:

    (1) DIPLOMATIC AND CONSULAR PROGRAMS: For “Diplomatic and Consular Programs," $10,000,000,000 for fiscal year 2020;

    (A) BUREAU OF DEMOCRACY, HUMAN RIGHTS, AND LABOR: Of such amounts, not less than $25,000,000 for fiscal year 2014 is authorized to be appropriated for the Bureau of Democracy, Human Rights and Labor.

    (B) WORLDWIDE SECURITY PROTECTION: Of such amounts, not less than $3,000,000,000 for fiscal year 2014 is authorized to be appropriated for worldwide security protection.


    (2) CAPITAL INVESTMENT FUND: For “Capital Investment Fund”, $75,000,000 for fiscal year 2014;

    (A) EDUCATIONAL AND CULTURAL EXCHANGE PROGRAMS: For “Educational and Cultural Exchange Programs”, $535,000,000 for fiscal year 2014, of which funding for educational and cultural programs that occur in countries or regions that are at risk of, in, or are in transition from, conflict or civil strife should be prioritized.


    (3) CONFLICT STABILIZATION OPERATIONS: Of such amounts, not less than $45,000,000 for fiscal year 2014 is authorized to be appropriated for "Conflict Stabilization Operations."

Section 2: EMBASSY SECURITY AND PERSONNEL REQUIREMENTS

a) Not later than 30 days after the date of the enactment of this section, the Secretary of State shall submit to the appropriate congressional committees a report, in classified form, that contains an initial list of diplomatic and consular posts designated as high risk, high threat posts.

b) Designations Before Opening Or Reopening Posts: Before opening or reopening a diplomatic or consular post, the Secretary shall determine if such post should be designated as a high risk, high threat post.

c) The Secretary of State shall complete a strategic review of the Bureau of Diplomatic Security of the Department of State to ensure that the mission and activities of the Bureau are fulfilling the current and projected needs of the Department of State, including assessments of:

    (1) staffing needs for both domestic and international operations;
    (2) facilities under chief of mission authority adhering to security standards;
    (3) necessary security training provided to personnel under chief of mission authority for expected assignments and objectives;
    (4) programs being carried out by personnel with the necessary experience and at commensurate grade levels.

d) The Secretary may transfer to, and merge with, any appropriation for embassy security, construction, and maintenance such amounts appropriated for fiscal year 2020 for any other purpose related to the administration of foreign affairs on or after December 30, 2019, if the Secretary determines such transfer is necessary to provide for the security of sites and buildings in foreign countries under the jurisdiction and control of the Secretary.

e) The Overseas Security Policy Board’s security standards for United States diplomatic and consular posts must apply to all such security personnel posts regardless of the duration of their occupancy.

Section 3: EMBASSY SECURITY AND PERSONNEL TRAINING

a) Individuals assigned permanently to or who are in long-term temporary duty status as designated by the Secretary at a high risk, high threat post shall receive security training described in subsection (b) on a mandatory basis in order to prepare such individuals for living and working at such posts.

(b) Security Training Described: Security training referred to in subsection (a)—

    (1) is training to improve basic knowledge and skills; and

    (2) may include—

    (A) an ability to recognize, avoid, and respond to potential terrorist situations, including a complex attack;

    (B) conducting surveillance detection;

    (C) providing emergency medical care;

    (D) ability to detect the presence of improvised explosive devices;

    (E) minimal firearms familiarization; and

    (F) defensive driving maneuvers.

    (A) BUREAU OF DEMOCRACY, HUMAN RIGHTS, AND LABOR: Of such amounts, not less than $25,000,000 for fiscal year 2014 is authorized to be appropriated for the Bureau of Democracy, Human Rights and Labor.

    (B) WORLDWIDE SECURITY PROTECTION: Of such amounts, not less than $3,000,000,000 for fiscal year 2014 is authorized to be appropriated for worldwide security protection.


    (2) CAPITAL INVESTMENT FUND: For “Capital Investment Fund”, $75,000,000 for fiscal year 2014;

    (A) EDUCATIONAL AND CULTURAL EXCHANGE PROGRAMS: For “Educational and Cultural Exchange Programs”, $535,000,000 for fiscal year 2014, of which funding for educational and cultural programs that occur in countries or regions that are at risk of, in, or are in transition from, conflict or civil strife should be prioritized.


    (3) CONFLICT STABILIZATION OPERATIONS: Of such amounts, not less than $45,000,000 for fiscal year 2014 is authorized to be appropriated for "Conflict Stabilization Operations."

Section 2: EMBASSY SECURITY AND PERSONNEL REQUIREMENTS

a) Not later than 30 days after the date of the enactment of this section, the Secretary of State shall submit to the appropriate congressional committees a report, in classified form, that contains an initial list of diplomatic and consular posts designated as high risk, high threat posts.

b) Designations Before Opening Or Reopening Posts: Before opening or reopening a diplomatic or consular post, the Secretary shall determine if such post should be designated as a high risk, high threat post.

c) The Secretary of State shall complete a strategic review of the Bureau of Diplomatic Security of the Department of State to ensure that the mission and activities of the Bureau are fulfilling the current and projected needs of the Department of State, including assessments of:

    (1) staffing needs for both domestic and international operations;
    (2) facilities under chief of mission authority adhering to security standards;
    (3) necessary security training provided to personnel under chief of mission authority for expected assignments and objectives;
    (4) programs being carried out by personnel with the necessary experience and at commensurate grade levels.

d) The Secretary may transfer to, and merge with, any appropriation for embassy security, construction, and maintenance such amounts appropriated for fiscal year 2020 for any other purpose related to the administration of foreign affairs on or after December 30, 2019, if the Secretary determines such transfer is necessary to provide for the security of sites and buildings in foreign countries under the jurisdiction and control of the Secretary.

e) The Overseas Security Policy Board’s security standards for United States diplomatic and consular posts must apply to all such security personnel posts regardless of the duration of their occupancy.

Section 3: EMBASSY SECURITY AND PERSONNEL TRAINING

a) Individuals assigned permanently to or who are in long-term temporary duty status as designated by the Secretary at a high risk, high threat post shall receive security training described in subsection (b) on a mandatory basis in order to prepare such individuals for living and working at such posts.

(b) Security Training Described: Security training referred to in subsection (a)—

    (1) is training to improve basic knowledge and skills; and

    (2) may include—

    (A) an ability to recognize, avoid, and respond to potential terrorist situations, including a complex attack;

    (B) conducting surveillance detection;

    (C) providing emergency medical care;

    (D) ability to detect the presence of improvised explosive devices;

    (E) minimal firearms familiarization; and

    (F) defensive driving maneuvers.

This bill is then honorably presented to the Senate for consideration in order to prevent mass surveillance of the public and is backed by Frank Doyle on ___
