Penalty Enhancement Act

AN ACT to increase penalties for serious crimes, especially violent, terroristic or sexual crimes, to ensure a strong deterrent, and for related purposes.

Section 1 - SEXUAL OFFENSES
  1. Title 18, § 2241 of the U.S. Code shall be amended to read:
    "(a) By Force or Threat.— Whoever, in the special maritime and territorial jurisdiction of the United States or in a Federal prison, or in any prison, institution, or facility in which persons are held in custody by direction of or pursuant to a contract or agreement with the head of any Federal department or agency, knowingly causes another person to engage in a sexual act—
    (1) by using force against that other person; or
    (2) by threatening or placing that other person in fear that any person will be subjected to death, serious bodily injury, or kidnapping;
    or attempts to do so, shall be fined under this title, and imprisoned for not less than 25 years or for life.
    (b) By Other Means.— Whoever, in the special maritime and territorial jurisdiction of the United States or in a Federal prison, or in any prison, institution, or facility in which persons are held in custody by direction of or pursuant to a contract or agreement with the head of any Federal department or agency, knowingly—
    (1) renders another person unconscious and thereby engages in a sexual act with that other person; or
    (2) administers to another person by force or threat of force, or without the knowledge or permission of that person, a drug, intoxicant, or other similar substance and thereby—
    (A) substantially impairs the ability of that other person to appraise or control conduct; and
    (B) engages in a sexual act with that other person;
    or attempts to do so, shall be fined under this title, and imprisoned for not less than 15 years or for life.
    (c) With Children.—
    Whoever crosses a State line with intent to engage in a sexual act with a person who has not attained the age of 12 years, or in the special maritime and territorial jurisdiction of the United States or in a Federal prison, or in any prison, institution, or facility in which persons are held in custody by direction of or pursuant to a contract or agreement with the head of any Federal department or agency, knowingly engages in a sexual act with another person who has not attained the age of 12 years, or knowingly engages in a sexual act under the circumstances described in subsections (a) and (b) with another person who has attained the age of 12 years but has not attained the age of 16 years (and is at least 4 years younger than the person so engaging), or attempts to do so, shall be punished by the death penalty or imprisonment for not less than 40 years or for life. If the defendant has previously been convicted of another Federal offense under this subsection, or of a State offense that would have been an offense under either such provision had the offense occurred in a Federal prison, the defendant shall be sentenced to the death penalty or life in prison.
    (d) State of Mind Proof Requirement.—
    In a prosecution under subsection (c) of this section, the Government need not prove that the defendant knew that the other person engaging in the sexual act had not attained the age of 12 years."
  2. Title 18, § 2251(e) of the U.S. Code shall be amended to read:
    "Any individual who violates, or attempts or conspires to violate, this section shall be fined under this title and imprisoned not less than 20 years nor more than life, but if such person has one prior conviction under this chapter, section 1591, chapter 71, chapter 109A, or chapter 117, or under section 920 of title 10 (article 120 of the Uniform Code of Military Justice), or under the laws of any State relating to aggravated sexual abuse, sexual abuse, abusive sexual contact involving a minor or ward, or sex trafficking of children, or the production, possession, receipt, mailing, sale, distribution, shipment, or transportation of child pornography, such person shall be fined under this title and imprisoned for life, but if such person has 2 or more prior convictions under this chapter, chapter 71, chapter 109A, or chapter 117, or under section 920 of title 10 (article 120 of the Uniform Code of Military Justice), or under the laws of any State relating to the sexual exploitation of children, such person shall be punished by the death penalty or imprisonment for life. Any organization that violates, or attempts or conspires to violate, this section shall be fined under this title. Whoever, in the course of an offense under this section, engages in conduct that results in the death of a person, shall be punished by the death penalty or imprisonment for life."

Section 2 - TERRORISM
  1. Title 18, §2332a of the US Code shall be amended to read:
    "(a) Offense Against a National of the United States or Within the United States.— A person who, without lawful authority, uses, threatens, or attempts or conspires to use, a weapon of mass destruction —
    (1) against a national of the United States while such national is outside of the United States;
    (2) against any person or property within the United States, and
    (A) the mail or any facility of interstate or foreign commerce is used in furtherance of the offense;
    (B) such property is used in interstate or foreign commerce or in an activity that affects interstate or foreign commerce;
    (C) any perpetrator travels in or causes another to travel in interstate or foreign commerce in furtherance of the offense; or
    (D) the offense, or the results of the offense, affect interstate or foreign commerce, or, in the case of a threat, attempt, or conspiracy, would have affected interstate or foreign commerce;
    (3) against any property that is owned, leased or used by the United States or by any department or agency of the United States, whether the property is within or outside of the United States; or
    (4) against any property within the United States that is owned, leased, or used by a foreign government,
    shall be punished by death or imprisoned for any term of years or for life, and if death results, shall be punished by death or imprisoned for life.
    (b) Offense by National of the United States Outside of the United States.—
    Any national of the United States who, without lawful authority, uses, or threatens, attempts, or conspires to use, a weapon of mass destruction outside of the United States shall be punished by death or imprisoned for any term of years or for life, and if death results, shall be punished by death, or by imprisonment for life.
    (c) Definitions.—For purposes of this section—
    (1) the term “national of the United States” has the meaning given in section 101(a)(22) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(22));
    (2) the term “weapon of mass destruction” means—
    (A) any destructive device as defined in section 921 of this title;
    (B) any weapon that is designed or intended to cause death or serious bodily injury through the release, dissemination, or impact of toxic or poisonous chemicals, or their precursors;
    (C) any weapon involving a biological agent, toxin, or vector (as those terms are defined in section 178 of this title); or
    (D) any weapon that is designed to release radiation or radioactivity at a level dangerous to human life; and
    (3) the term “property” includes all real and personal property."
  2. Title 18, §2332b(c)(1) of the US Code shall be amended to read:
    "(1)Penalties.— Whoever violates this section shall be punished—
    (A) for a killing, or if death results to any person from any other conduct prohibited by this section, by death, or by imprisonment for life;
    (B) for kidnapping, by imprisonment for life;
    (C) for maiming, by imprisonment for not less than 5 years or for life;
    (D) for assault with a dangerous weapon or assault resulting in serious bodily injury, by imprisonment for not less than 5 years nor more than 50 years;
    (E) for destroying or damaging any structure, conveyance, or other real or personal property, by imprisonment for not less than 5 years nor more than 35 years;
    (F) for attempting or conspiring to commit an offense, for any term of years up to the maximum punishment that would have applied had the offense been completed; and
    (G) for threatening to commit an offense under this section, by imprisonment for not more than 15 years."
  3. Title 18, §2332g(c) of the US Code shall be amended to read:
    "(1) In general.—
    Any person who violates, or attempts or conspires to violate, subsection (a) shall be fined not more than $5,000,000 and shall be sentenced to a term imprisonment not less than 45 years or to imprisonment for life.
    (2) Other circumstances.—
    Any person who, in the course of a violation of subsection (a), uses, attempts or conspires to use, or possesses and threatens to use, any item or items described in subsection (a), shall be fined not more than $10,000,000 and shall be sentenced to imprisonment for life.
    (3) Special circumstances.—
    If the death of another results from a person’s violation of subsection (a), the person shall be punished by imprisonment for life or shall be punished by the death penalty, and, if not sentenced to the death penalty, shall be fined not more than $25,000,000."
  4. Title 18, §2332h(c) of the US Code shall be amended to read:
    "(1) In general.—
    Any person who violates, or attempts or conspires to violate, subsection (a) shall be fined not more than $5,000,000 and shall be sentenced to a term imprisonment not less than 45 years or to imprisonment for life.
    (2) Other circumstances.—
    Any person who, in the course of a violation of subsection (a), uses, attempts or conspires to use, or possesses and threatens to use, any item or items described in subsection (a), shall be fined not more than $10,000,000 and shall be sentenced to imprisonment for life.
    (3) Special circumstances.—
    If the death of another results from a person’s violation of subsection (a), the person shall be punished by imprisonment for life or shall be punished by the death penalty, and, if not sentenced to the death penalty, shall be fined not more than $25,000,000."
  5. Title 18, §2332i(c) of the US Code shall be amended to read:
    "Whoever violates this section shall be fined not more than $5,000,000 and shall be punished by the death penalty, or imprisonment for any term of years or for life."

Section 3 - CAPITAL SENTENCING AMENDMENT
  1. Title 18, §3591(a)(1) of the US Code shall be amended to read:
    "(1) an offense described in section 794, section 2241, section 2251, section 2332a, section 2332i or section 2381; or"
  2. Title 18, §3592(b) of the US Code shall be amended to read:
    "(b) Aggravating Factors for Espionage, Treason and Terrorism.—In determining whether a sentence of death is justified for an offense described in section 794, section 2332a, section 2332i or section 2381, the jury, or if there is no jury, the court, shall consider each of the following aggravating factors for which notice has been given and determine which, if any, exist:
    (1) Prior offense.—
    The defendant has previously been convicted of another offense involving section 794, section 2332a, section 2332i or section 2381 for which a sentence of either life imprisonment or death was authorized by law.
    (2) Grave risk to national security.—
    In the commission of the offense the defendant knowingly created a grave risk of substantial danger to the national security.
    (3) Grave risk of death.—
    In the commission of the offense the defendant knowingly created a grave risk of death to another person.
    The jury, or if there is no jury, the court, may consider whether any other aggravating factor for which notice has been given exists."
  3. Title 18, §3592(e) of the US Code shall be inserted and shall read:
    "(e) Aggravating Factors for Child Sex Offense Death Penalty.—In determining whether a sentence of death is justified for an offense described in section 2241 or section 2251, the jury, or if there is no jury, the court, shall consider each of the following aggravating factors for which notice has been given and determine which, if any, exist:
    (1) Previous conviction of offense for which a sentence of death or life imprisonment was authorized.—
    The defendant has previously been convicted of another Federal or State offense for which a sentence of life imprisonment or death was authorized by statute.
    (2) Previous conviction of other serious offenses.—
    The defendant has previously been convicted of two or more Federal or State offenses, each punishable by a term of imprisonment of more than one year, committed on different occasions, involving offenses defined in chapter 109A (sexual abuse) or chapter 110 (sexual abuse of children), or the infliction of, or attempted infliction of, serious bodily injury or death upon another person.
    (3) Use of Weapons, Etc.—
    In committing the offense the defendant used a weapon or threatened, intimidated, assaulted, or injured the victim.
    (4) Victim was under 8 years of age.—
    The victim of the offense had not attained 8 years of age at the time of the offense.
    (5) Pecuniary Value.—
    The defendant committed the offense as consideration for the receipt, or in the expectation of the receipt, of anything of pecuniary value.
    (6) Heinous, cruel, or depraved manner of committing offense.—
    The defendant committed the offense in an especially heinous, cruel, or depraved manner in that it involved torture or serious physical abuse to the victim.
    (7) Substantial planning and premeditation.—
    The defendant committed the offense after substantial planning and premeditation.
    (8) Disability of victim.—
    The victim had a disability as defined by Title 42, §12102.

    The jury, or if there is no jury, the court, may consider whether any other aggravating factor for which notice has been given exists."
  4. Title 18, §3593(e) of the US Code shall be amended to read:
    "(e)Return of a Finding Concerning a Sentence of Death.—If, in the case of—
    (1) an offense described in section 3591(a)(1), an aggravating factor required to be considered under section 3592(b) is found to exist;
    (2) an offense described in section 3591(a)(2), an aggravating factor required to be considered under section 3592(c) is found to exist;
    (3) an offense described in section 3591(b), an aggravating factor required to be considered under section 3592(d) is found to exist; or
    (4) an offense described in section 3591(a)(1), an aggravating factor required to be considered under section 3592(e) is found to exist,
    the jury, or if there is no jury, the court, shall consider whether all the aggravating factor or factors found to exist sufficiently outweigh all the mitigating factor or factors found to exist to justify a sentence of death, or, in the absence of a mitigating factor, whether the aggravating factor or factors alone are sufficient to justify a sentence of death. Based upon this consideration, the jury by unanimous vote, or if there is no jury, the court, shall recommend whether the defendant should be sentenced to death, to life imprisonment without possibility of release or some other lesser sentence."

Section 4 - SHORT TITLE
This Act may be cited as the "Penalty Enhancement Act" or the "PEA".

This bill is then honorably presented to the United States Senate for consideration in order to ensure a strong deterrent for pedophiles and terrorists to improve the United States Law and is backed by Senator Barry Anderson on [date TBC].

WAIT I just read the names of who is debating. So both the DNC and the RNC have policies where if you are running for President you cannot participate in a debate against another Presidential Candidate that is not approved by them. Basically what I'm saying is if your characters debate one another they will be barred from future official debates

Is there any specific method that people use to find news from a particular date in a particular state? I'm trying to research things from my end and it's particularly difficult, especially when local news sites from the US aren't always available in the UK.

ANNOUNCEMENT

The election for Democratic caucus chair will take place in the next few days. I will make a post in the IC starting a meeting of the democratic caucus. Speaker Douglas will start proceeding and is backing Caroline Simone for the chair, any other House democrats are welcome to run.

Also, Gordona and Lyansus specifically, would Simone be open to an "endorsement quid pro quo" where Goldman endorses Simone for Caucus Chair and Simone endorses Goldman for the Presidency once the time comes?

Alright. I've started to write meetings with other centrist think tanks as well, so I'm wondering whether they would be willing to put forward a statement of endorsement once Goldman comes in if they are convinced of her ideology? Or do they usually intervene later on?

EDIT: Also, anyone want to interview Goldman?

Douglas' condition for his support for Simone seeking Caucus Chair would be to remain neutral in the primary race for the time being. She's not likely to deviate from that as she respects the authority of the leadership. She's also not tremendously impressed with how Goldman's handled herself, but she'd certainly be open to the notion if the pitch is sufficiently encouraging and she's given the latitude to make a commitment. That said, she'd need to outdo Veléz in a pitch and Simone was very impressed with Veléz.

Goldman's welcome to talk to Simone like anyone else, it's just that Simone can't come out and say anything.
