  4. Departments shall have a representative form of government with free, fair, and regular elections. Each department shall be governed by a departmental council.
  5. Departmental councils shall have the power to pass ordinances, lay and collect taxes, and provide services.

§5 - National Law
  1. No municipality or department may pass an ordinance that would conflict with national law.


Local government bill. Municipalities and departments are administrative divisions and do not have irrevocable rights like in a federation.

To me at least, "municipality" sounds like it applies to only urban areas. Maybe a different word could be used for rural subdivisions. "Commune" (as in Swedish kommun) or "county" are possibilities.

But this is a minor issue, so I sponsor this. (Anna Nilsson, PLP)

A bill to establish a system of courts and justice

BE IT THEREFORE ENACTED, as follows:

§1 - Definitions
  1. Citation - a low-level offense that carries no penalty of imprisonment, such as a parking ticket or public urination
  2. Criminal offense - an offense against the criminal code of Saint Hilda

§2 - Rights
  1. All residents of Saint Hilda are entitled to a trial by a jury of their peers for any criminal or civil offense that rises beyond the level of a citation.
  2. Juries shall consist of 12 individuals selected from a random pool of residents of Saint Hilda.
  3. Any individual convicted of a criminal offense has the right to appeal the decision of the court to a higher court. There shall be no jury for an appeal.
  4. Any individual may choose to waive their right to a jury trial and have their case heard solely by a judge.
  5. All individuals charged with a crime have the right to an attorney. If they cannot afford an attorney, one will be provided for them at public expense.

§3 - Court System
  1. There shall be three levels of courts in Saint Hilda: department courts, courts of appeals, and the Supreme Court.
  2. All courts fall under the purview of the Ministry of Justice and all employees of courts shall be considered employees of the national government.
  3. There shall be one (1) department court in each department of Saint Hilda. Department courts are responsible for hearing cases relating to criminal offenses, as well as civil lawsuits. No case shall be heard in a higher court without first being heard in a department court. Department courts shall have no less than five (5) judges to hear cases, though only one (1) judge shall hear each case.
  4. There shall be five (5) courts of appeals, each encompassing multiple departments. The courts of appeals shall hear all cases appealed in the departments for which they are responsible. Each court of appeals shall have nine (9) judges, and three (3) judges shall hear each case.
  5. There shall be one (1) Supreme Court of Saint Hilda. The decision of the Supreme Court shall be final in all cases. The Supreme Court shall have the right to hear or choose not to hear any cases appealed to it from the courts of appeals. No case shall be appealed to the Supreme Court without first having been heard in a court of appeals. The Supreme Court shall have seven (7) judges, who shall be referred to as justices, and all justices, when able to be present, shall hear each case.
  6. Departments may establish special jurisdictional courts (bankruptcy, traffic, etc) as they believe to be necessary. All courts created in this way shall be the responsibility of the department and all employees considered employees of the department. The selection of judges and employees for these courts shall be on the basis of merit.

§4 - Selection for the Judiciary
  1. All judges, whether for department, appeals, or Supreme courts, shall be selected on the basis of merit. No individual shall be nominated for a judgeship who is not a licensed attorney or a citizen of Saint Hilda.
  2. The Prime Minister shall nominate, subject to a majority vote of Parliament, individuals to serve on the department courts, courts of Appeals, and the Supreme Court.
  3. The Ministry of Justice shall be charged with the identification and recommendation to the Prime Minister of suitable candidates for judgeship.
  4. Judges of the department courts shall serve for nine (9) years or until they have resigned or been impeached by Parliament for conduct unbecoming of the office.
  5. Judges of the courts of appeals shall serve for twelve (12) years or until they have resigned or been impeached by Parliament for conduct unbecoming of the office.
  6. Justices of the Supreme Court shall serve for fifteen (15) years or until they have resigned or been impeached by Parliament for conduct unbecoming of the office.

§5 - Public Prosecutor and Public Defender
  1. Each department shall have an Office of the Public Prosecutor (OPP) and an Office of the Public Defender (OPD).
  2. The OPP shall be charged with the prosecution of criminal and civil offenses. Each departmental OPP shall have a Chief Prosecutor and no less than three (3) Assistant Prosecutors. The Chief Prosecutor shall be the official responsible for the operations of the OPP and the prosecution of cases.
  3. The OPD shall be charged with the defense of individuals who cannot or choose not to hire an attorney of their own. Each departmental OPD shall have a Chief Defender and no less than five (5) Assistant Defenders. The Chief Defender shall be the official responsible for the operations of the OPD and the defense of individuals.
  4. All applicants for the positions listed in this section of this Act shall be considered on the basis of merit. No individual shall be employed in one of the positions listed in this section of the Act who is not a licensed attorney.


Judiciary system bill. Sets up courts, selection of judges, and prosecution/defense.

1. §3 doesn't actually specify which court hears citations. I guess they'd fall under "civil lawsuits"?
2. The lower level courts in §3f are good, but I believe some basic lower-level court should be already created instead of asking the departments to create them— something like a magistrates' court for hearing trivial citations, in a jurisdiction smaller than the whole department (which would not be possible now if I'm reading it correctly)
3. Jury trials? Erk.
4. I think the "or" in "licensed attorney or citizen..." in §4a should be an "and".


Municipality refers to an area officially incorporated as such, ie an official town/village/city with its own local council and whatever is in the "city limits." Non-incorporated areas are governed directly by the department they are in. Departments end up occupying a space between counties and states. They aren't just local government, because they in theory will encompass multiple municipalities and non-incorporated areas, but they don't have the same irrevocable powers as states and they govern some local, non-incorporated areas directly.

Added a section clarifying that municipalities should establish courts to deal with citations. Jury trial is a fundamental right, though I can certainly add language to assuage any discomfort you have with trial by jury. Changed the "and." Thanks for the feedback and to all who sponsored!

The Life Amendment does. The Local Government Act, Legal Justice Act, Employment and Education Non-Discrimination Act, Marriage Act, and Standing Orders all have enough but haven't been officially submitted. The Conscription Act, Fair & Open Elections Act, Narcotics Act, and Budget Stability Act have all been proposed but don't have enough sponsors.

Foreign companies that are government contractors to the government of Saint Hilda shall not be known as “foreign corporations” but still shall be barred from political spending and making political donations in accordance with section one. Companies based in Sweden or its colonies shall be exempt to this definition

§3 - Penalties
  1. The Prime Minister of Saint Hilda hereby shall be tasked with deciding which government organization shall oversee and enforce this legislation, or creating a new government organization to oversee and enforce this legislation
  2. A corporation which violates this legislation shall be charged with corporate election fraud and if found guilty by a jury shall pay a fine of between 1% and 10% of their yearly revenue as determined by a judge as well as be barred from political spending for the next 5 years.
  3. If a foreign corporation refuses to pay a fine after being ordered to do so by a judge and found guilty by a jury, they shall no longer be allowed to operate in Saint Hilda, unless the Prime Minister of parliament of Saint Hilda decide their goods are services are crucial to the proper functioning of Saint Hilda

§4 - Implementation
  1. This bill will be enacted immediately upon its passage.
  2. All laws in conflict with this legislation are hereby declared null and void.
  3. This legislation is not intended to and will not supersede any constitutional provisions, but instead back them with statutory law.

A bill to prevent discrimination in employment and education

BE IT THEREFORE ENACTED, as follows:



§1 - Definitions
  1. Race/Color - an individual's skin color, ancestry, or perceived shared physical traits with a distinct group of humans
  2. Sex - Physical characteristics that identify an individual as male or female, as defined on their birth certificate
  3. National origin - the nation an individual was born in
  4. Disability - a physical or mental condition that limits a person's movements, senses, or activities
  5. Sexual orientation - who an individual is sexually attracted to
  6. Public employer - a governmental or quasi-governmental agency that employs individuals

§2 - Employment
  1. It is illegal for public employers to discriminate against applicants for employment in all cases on the basis of the following characteristics: race, color, sex, religion, national origin, sexual orientation.
  2. If a public employer determines that an individual's age, disability, or language proficiency would prevent them from completing the tasks associated with the job and has sufficient evidence to support this, then they may refuse to hire that individual. If there is no or not sufficient evidence, then the public employer may not use those characteristics as reason not to hire that individual.
  3. It is illegal for private employers to discriminate against applicants for employment in all cases on the basis of the following characteristics: race (except if the job in and of itself requires a particular race, such as a character in the film industry), color, sex (except if the job in and of itself requires a particular sex, as in the film industry), religion, national origin, sexual orientation (except as defined in section 2e of this act).
  4. If a private employer determines that an individual's age, disability, or language proficiency would prevent them from completing the tasks associated with the job and has sufficient evidence to support this, then they may refuse to hire that individual. If there is no or not sufficient evidence, then the public employer may not use those characteristics as reason not to hire that individual.
  5. The right of religious organizations to hire or dismiss individuals on the basis of their religion or sexual orientation shall be protected, if the religious organization has sufficient evidence to prove that these characteristics would interfere with the mission or values of the organization.
  6. Mandates that public employers have and pursue a plan to ensure diversity in management or higher levels of employment on the basis of the following characteristics: race, color, sex, disability.
  7. Encourages private employers to have and pursue a plan to ensure diversity in management or higher levels of employment on the basis of the following characteristics: race, color, sex, disability.

§3 - Education
  1. It is illegal for public educational institutions to discriminate against applicants for admission in all cases on the basis of the following characteristics: race, color, sex, religion, national origin, sexual orientation, age, disability, or primary language.
  2. It is illegal for private educational institutions to discriminate against applicants for admission in all cases on the basis of the following characteristics: race, color, religion, national origin, age, disability, or primary language.
  3. Mandates that public higher educational institutions have and pursue a plan to ensure diversity in their undergraduate and graduate student body on the basis of the following characteristics: race, color, sex, disability.
  4. Encourages and affirms the right of private higher educational institutions to have and pursue a plan to ensure diversity in their undergraduate and graduate student body on the basis of the following characteristics: race, color, sex, disability.

§4 - Enforcement
  1. The Equal Employment Commission shall be the body that oversees the provisions of this Act with regards to employment. Individuals shall submit complaints and evidence that this act has been violated and employers shall submit evidence to the EEC. The EEC shall have power to assess fines to employers for violation of this act and issue legal remedies and relief for individuals harmed under this act. The decisions of the EEC shall be determined to be final in regards to complaints under this Act unless otherwise specified by the courts.
  2. The Equal Education Board shall be the body that oversees the provisions of this Act with regards to education.   2. Parliament shall establish a number of departments, no less than ten (10), corresponding to historical and geographic regions. Parliament may establish additional departments, abolish, or merge departments as necessary.
  3. All land within the departments, including incorporated municipalities, shall be subject to the ordinances of the department.
  4. Departments shall have a representative form of government with free, fair, and regular elections. Each department shall be governed by a departmental council.
  5. Departmental councils shall have the power to pass ordinances, lay and collect taxes, and provide services.

§5 - National Law
  1. No municipality or department may pass an ordinance that would conflict with national law.

A bill to establish a system of courts and justice

BE IT THEREFORE ENACTED, as follows:

§1 - Definitions
  1. Citation - a low-level offense that carries no penalty of imprisonment nor significant fine, such as a parking ticket or public urination
  2. Criminal offense - an offense against the criminal code of Saint Hilda

§2 - Rights
  1. All residents of Saint Hilda are entitled to a trial by a jury of their peers for any criminal or civil offense that rises beyond the level of a citation.
  2. Juries shall consist of 12 individuals selected from a random pool of residents of Saint Hilda. Juries shall render their verdict by unanimous decision and shall use "beyond a reasonable doubt" as the standard by which they render their verdict in criminal cases. In civil cases, "clear and convincing evidence" shall be the standard by which they render their verdict.
  3. Any individual convicted of a criminal offense has the right to appeal the decision of the court to a higher court. There shall be no jury for an appeal.
  4. Any individual may choose to waive their right to a jury trial and have their case heard solely by a judge.
  5. All individuals charged with a crime have the right to an attorney. If they cannot afford an attorney, one will be provided for them at public expense.

§3 - Court System
  1. There shall be two levels of courts in Saint Hilda below the High Courts: department courts and lower courts of appeals.
  2. All courts fall under the purview of the Ministry of Justice and all employees of courts shall be considered employees of the national government.
  3. There shall be no less than one (1) department court in each department of Saint Hilda. Department courts are responsible for hearing cases relating to criminal offenses, as well as civil lawsuits. No case shall be heard in a higher court without first being heard in a department court. Department courts shall have no less than five (5) judges to hear cases, though only one (1) judge shall hear each case.
  4. There shall be five (5) lower courts of appeals, each encompassing multiple departments. The lower courts of appeals shall hear all cases appealed in the departments for which they are responsible. Each lower court of appeals shall have nine (9) judges, and three (3) judges shall hear each case.
  5. Reaffirms that the decision of the High Courts shall be final in all cases. The High Courts shall have the right to hear or choose not to hear any cases appealed to them from the courts of appeals. No case shall be appealed to the High Courts without first having been heard in a lower court of appeals. Each of the High Courts shall have seven (7) judges, who shall be referred to as justices, and all justices, when able to be present, shall hear each case.
  6. Departments may establish special jurisdictional courts (bankruptcy, traffic, etc) as they believe to be necessary. All courts created in this way shall be the responsibility of the department and all employees considered employees of the department. The selection of judges and employees for these courts shall be on the basis of merit.
  7. Municipalities are directed to establish courts for the administration of citations. All courts created in this way shall be the responsibility of the municipality and all employees considered employees of the municipality. The selection of judges and employees for these courts shall be on the basis of merit.

§4 - Selection for the Judiciary
  1. All judges, whether for department, appeals, or Supreme courts, shall be selected on the basis of merit. No individual shall be nominated for a judgeship who is not a licensed attorney and a citizen of Saint Hilda.
  2. The Prime Minister shall nominate, subject to a majority vote of Parliament, individuals to serve on the department courts, courts of Appeals, and the Supreme Court.
  3. The Ministry of Justice shall be charged with the identification and recommendation to the Prime Minister of suitable candidates for judgeship.
  4. Judges of the department courts shall serve for nine (9) years or until they have resigned or been impeached by Parliament for conduct unbecoming of the office. They may not serve for multiple terms on any department court.
  5. Judges of the lower courts of appeals shall serve for twelve (12) years or until they have resigned or been impeached by Parliament for conduct unbecoming of the office. They may not serve multiple terms on any lower court of appeals.
  6. Justices of the Supreme Court shall serve for fifteen (15) years or until they have resigned or been impeached by Parliament for conduct unbecoming of the office. They may serve multiple terms.

§5 - Public Prosecutor and Public Defender
  1. Each department shall have an Office of the Public Prosecutor (OPP) and an Office of the Public Defender (OPD).
  2. The OPP shall be charged with the prosecution of criminal and civil offenses. Each departmental OPP shall have a Chief Prosecutor and no less than three (3) Assistant Prosecutors. The Chief Prosecutor shall be the official responsible for the operations of the OPP and the prosecution of cases.
  3. The OPD shall be charged with the defense of individuals who cannot or choose not to hire an attorney of their own. Each departmental OPD shall have a Chief Defender and no less than five (5) Assistant Defenders. The Chief Defender shall be the official responsible for the operations of the OPD and the defense of individuals.
  4. All applicants for the positions listed in this section of this Act shall be considered on the basis of merit. No individual shall be employed in one of the positions listed in this section of the Act who is not a licensed attorney.

  1. The NSB is hereby authorized and directed to collect, within the State of St. Hilda information on the following categories:
    1. The Population of St. Hilda.
    2. The average income of the citizenry.
    3. The Birth and Birth Rates of the citizenry.
    4. The deaths and Death rates of the citizenry.
    5. The employment of the citizenry, both of current state of employment as well as industry in which the citizenry may work.
    6. The causes of Death of the citizenry.
    7. The illnesses or lack thereof of the citizenry.
    8. The Education level of the citizenry.
    9. The Ethnic and National origins of the citizenry.
    10. The Religion or lack thereof of the citizenry.
    11. Crime Rates of the citizenry.
    12. The age groups of the citizenry.
    13. Any other information that the Parliament Of St. Hilda deems necessary and proper to allow it to accomplish its function or propose legislation.
      1. The Census
        1. The Census shall take the following form:
          How many people were living or staying in this house, apartment, or mobile home on the date of the Census?
          Were there any additional people staying here the date of the Census that you did not include in Question 1?
          Is this house, apartment, or mobile home: owned with mortgage, owned without mortgage, rented, occupied without rent?
          What is your telephone number?
          Please provide information for each person living here. Start with a person here who owns or rents this house, apartment, or mobile home. If the owner or renter lives somewhere else, start with any adult living here. This will be Person 1. What is Person 1's name?
          What is Person 1's sex?
          What is Person 1's age and Date of Birth?
          Is Person 1 of Foreign Birth origin?
          What is Person 1's ethnicity?
          Does Person 1 sometimes live or stay somewhere else?
          What is Person 1’s average Income?
          What is Person 1’s highest level of Education?
          Has Person 1 ever been the victim of a crime? If so, which?
          What is Person 1’s religious affiliation?
          Repeat for all people living in the household, apartment or mobile home.
        2. The Census is to be in Swedish, English, French, Spanish, and the 3 most commonly spoken native languages of the Indigenous Peoples of St. Hilda.
        3. The Census is to be taken every 10 years or at the request of Parliament, via simple majority vote.

        §2 - The powers of the NSB
        1. The Population shall be calculated by a national Census, sent to every household located within St. Hilda, either by physical mail or electronically.
        2. The Average Income shall be calculated by dividing the total income by the total population. The Total Income shall be established through the Census.
        3. All births within a hospital shall be logged by a doctor, and the information shall be transmitted to the NBS as soon as physically possible. If a Birth takes place outside of a hospital, the logging and transmission shall be done by a midwife. The Birth rate shall be calculated by logging live births per 1,000 in a population in a year.
        4. The Death rate shall be calculated by recording the number of deaths, divided by the number of people in the population, and then multiplied by 1000. To qualify as a legal death, the cadaver must be examined by a doctor and pronounced dead. The death must then be reported to the NSB. If no cadaver can be located, such as in the case of a plane crash or is otherwise unidentifiable, the person in question will be registered as legally dead, if there exists sufficient cause to believe them to be so.
        5. The Causes of Death must be listed in all police reports, coroner’s records, and, in the case of homicide or other human-caused deaths, court transcripts. The NSB is to have access to all of the aforementioned.
        6. The NSB is to have access to all hospital and doctor’s records pertaining to illness, although no medical professional or institution may disclose the identity of any of their patients to the NSB.
        7. The Education Level of the citizenry is to be established both through the Census and the graduation records of all educational institutions within St. Hilda. Educational institutions are required to keep physical and electronic copies of their graduation records until after the NSB has utilized them.
        8. The Ethnic origins of the citizenry shall be established through the Census. The National origin is to be established whenever a foreigner attempts to immigrate into the State of St. Hilda.
        9. The Religious identity of the citizenry is to be established through the Census.
        10. The Crime Rates of the citizenry are to be calculated through police reports. However, to counteract underreporting or bias, the Census shall be utilized as well.
        11. The age groups of the citizenry shall be calculated by comparing birth records to the current year.
        12. If the Parliament of St. Hilda is to request that the NSB gather information on any subject not enumerated above through Clause 1, Subsection 13, it must also stipulate how such information is to be gathered.

        §3 - Publication
        1. Any and all information gathered by the NSB is to be available to any member of Parliament or other governmental function upon request.
        2. The NSB is to release a physical copy of all data collected every year, upon the conclusion of the last Parliamentary session or immediately following the Census, once all data from it is compiled and analyzed.
        3. The NSB is to keep and maintain an openly accessible electronic copy of all data collected, so that the Public may become informed upon the state of the Nation.
        4. Neither the NSB or any employee of it may divulge the personal identity of any citizen or resident of St. Hilda.
        5. The NSB may not delay the publication of any data without reason, with the Parliament of St. Hilda deciding, by simple majority vote, if such reason be valid.



The Census form is the US Census with a few other questions tacked on.

A bill to make provisions for the marriage of same-sex and opposite-sex couples in St Hilda and the rights of religions to perform marriage.

BE IT THEREFORE ENACTED, as follows:



§1 - Definition of Marriage
  1. Marriage shall hereafter be defined as a voluntary union between two people over the legal age of marriage.
  2. The legality of marriage shall be determined without regard to the gender of its two participants.
  3. The legal age of marriage shall be set at sixteen with the consent of the legal guardians of both involved, or eighteen without the requirement for consent.
  4. Marriages shall not be valid between any two people that share a parent.
  5. Marriages shall not be legal between any two people that share a grandparent.
  6. Marriages shall not be legal between a parent and their child.
  7. Marriages shall not be legal between a grandparent and their grandchild.
  8. Marriages shall not be legal between an aunt or uncle and their niece or nephew.
  9. Marriages shall not be legal if entered between more than two persons.
  10. A marriage may not be entered by a person if they are already married to another person.

§2 - Recognition of Marriage
  • Marriages shall be recognised only if performed in a registry office, recognised religious congregation or a place that has been given the right to perform marriage.
  • Religious venues affiliated with the Church of Sweden shall be given the right to perform marriage.
  • Any other religious venues shall be given the right to perform marriage if it is given said right by the government.
  • A place that is not a registry office or religious venue may be given the right to solemise marriage through local government order.
  • A registry office may not discriminate in who it marries so long as the marriage is legally valid.
  • Religious venues have the right to discriminate in who they marry under religious freedom.
  • Other places may not discriminate in who they marry so long as the marriage is legally valid.
  • Marriages may only be legally valid if both parties consent and the marriage is witnessed by two other individuals.

§3 - Implementation
  • This act shall be implemented immediately upon its passage.
  • This act may be cited as the Marriage Act 2019.
