Overview: This bill aims to protect America from an electromagnetic pulse attack.
Section 1: The electrical grid of the United States is not safe from an electromagnetic pulse from high in the atmosphere. A single nuclear device detonated at just the right height could knock out vital sectors such as communications, healthcare, police work, and fire services. Such an attack would largely disable the Emergency Alert System, leaving much of the country in the dark about the current situation and threats to their area. State and local governments could lose the ability to coordinate with federal authorities regarding critical issues in a potential state of war. Key war industries could be knocked out in some areas for years, severely damaging America's ability to resist. The governments of China and Russia regard this act of sabotage as a key part of their wartime plans. With North Korea also in possession of nuclear devices and Iran possibly having the ability to build one, it is more important than ever to protect our nation from this kind of attack.
Section 2: The United States Department of Energy is hereby charged with creating regulations on electrical utilities in order to safeguard continued access to their services after an electromagnetic pulse attack.
Section 3: The Department of Energy's regulation shall be developed with input from the United States Department of Defense, any company providing electrical power that would be affected, and technological consultants with expertise in electrical engineering and electromagnetic principles.
Section 4: The Department of Energy is hereby provided with a sum of seven billion dollars annually to aid electrical utilities with the necessary funding and materials for the upgrades ordered by the Department of Energy.
Section 5A: The regulation must be complete by July 3, 2019. The Department of Energy can apply for a delay from Congress if Congress determines it has reasonable cause to do so.
Section 5B: The target date for the completion of all upgrades is set to be July 3, 2024.
Section 5C: The Department of Energy is authorized from July 3, 2019 to appoint inspectors to send to electrical utility companies to determine compliance.
Section 6: The Department of Energy is hereby authorized from July 3, 2024 to levy fines equivalent to one and one half percent of profit for the last full fiscal year on an electrical utility company if said company has failed to do the upgrades and had the ability to do so.
This bill is then honorably presented to the United States Senate for consideration in order to provide for America's defense to improve the United States Law and is backed by Troy Wilson on July 3, 2017.
