Joint Resolution
To authorize the use of force of United States Armed Forces against the Islamic State of Iraq and the Levant, aka Islamic State of Iraq and Syria, aka Daesh, and its associated forces.

Whereas the terrorist group known as the Islamic State of Iraq and the Levant (henceforth referred to as ISIL) has systematically targeted and killed thousands of men, women, and children of varying nationalities, ethnicities, beliefs, and background throughout Iraq and Syria, as well as through terrorist attacks in Tunisia, Egypt, Libya, Lebanon, and France;

Whereas ISIL has targeted American nationals, both abroad and within our domestic borders, and has acted reprehensibly and in direct contravention of all rules regarding conflict, the treatment of prisoners of war, the treatment of civilians, international human rights treatises, etc.;

Whereas, although nothing in this joint resolution limits the authorities of the President under article 2 of the Constitution of the United States, Justice Robert H. Jackson wrote in Youngstown Sheet & Tube Co. v. Sawyer, 343 U.S. 579 (1952) that “[w]hen the President acts pursuant to an express or implied authorization of Congress, his authority is at its maximum, for it includes all that he possesses in his own right plus all that Congress can delegate”; and

Whereas the threat of ISIL and its associated forces threatens not only the lives of Americans, but also countless Europeans, Iraqis, Syrians, and other peoples within the Middle East and North Africa: Now, therefore, be it

Resolved by the Senate and House of Representatives of the United States of America in Congress assembled,

Section 1. Short Title.

This joint resolution may be cited as the “Authorization for Use of Military Force Against the Islamic State of Iraq and the Levant and its Associated Forces”.

Section 2. Authorization for use of United States Armed Forces.

(a) In general.—The President is authorized to use all necessary and appropriate force in order to defend the national security of the United States against the continuing threat posed by the Islamic State of Iraq and the Levant, its associated forces, organizations, and persons, and any successor organizations.

(b) War Powers Resolution requirements.—

(1) SPECIFIC STATUTORY AUTHORIZATION.—Consistent with section 8(a)(1) of the War Powers Resolution (50 U.S.C. 1457(a)(1)), Congress declares that this section is intended to constitute specific statutory authorization within the meaning of section 5(b) of the War Powers Resolution.

(2) APPLICABILITY OF OTHER REQUIREMENTS.—Nothing in this joint resolution supercedes any requirement of the War Powers Resolution (50 U.S.C. 1541 et seq.).

Section. 3. Reports to Congress.

(a) Reports.—Not less frequently than once every 60 days, the President shall submit a report to Congress on matters relevant to this joint resolution, including actions taken pursuant to the exercise of authority granted under section 2.

(b) Single consolidated report.—To the extent that the submission of any report described in subsection (a) coincides with the submission of any other report on matters relevant to this joint resolution otherwise required to be submitted to Congress pursuant to the reporting requirements of the War Powers Resolution, all such reports may be submitted as a single consolidated report to Congress.[/box]

Official Name: Act Working to Halt Incidences of nonconsensual Penetration
Nickname:WHIP Act


Overview: Allows for flogging on first-degree rapists in federal jurisdictions.

Definitions: Defines "Flogging" as a punishment administered by lashings against the back using a single-strand whip without knotting or implanted objects delivered via a wrist and forearm action.

Defines "First-Degree Rape" according to the Sexual Assault Categorization Act.

Section 1: Rape is a scourge on this nation, and a truly heinous crime. Rape rates on many campuses are extremely high, and the national rape rate is rising rapidly. Something must be done to stop this trend.

Section 2: Grants judges the authority to authorize flogging as sentencing for the crime of first-degree rape in Federal jurisdictions in addition to or in replacement for prison sentencing, or other such punishments.

Section 3: Bars the sentencing of flogging if five licensed medical doctors not under the employment or in any relation to or collusion with the perpetrator give testimony that the sentence is unacceptable due to a physical condition of the perpetrator.


Rape today remains a devastating epidemic in this country. Even despite our best efforts rape is now streaking upwards again across this country. We recognize the heinous nature of this act, but take no action beyond that. Such is unacceptable. If we are to counter this epidemic we must counter it from all sides. We must make known beyond all doubt that we do not take these unspeakable violations lightly.

Too often those who have raped before rape again. Prisons fail as a deterrent. Recidivism plagues this country. Repeat offenders reign and first-time offenders are not deterred. New action is required in the interests of justice for the victims and preventing more victims from being created.

Whipping has been a punishment for crime in America for over two hundred years. Even then we do not look to return the lash universally. This limitation is almost excessive. It is limited only to rapists, and limited within that to first-degree rapists only, and only in federal jurisdictions. It is nonetheless a powerful statement and action.

Some will wildly assert that this runs against the Eighth Amendment without evidence. This is plainly false. For over eighty percent of our nation's history this has been used as punishment. There has never been a serious Constitutional challenge. The very founders of this nation endorsed the practice. George Washington and John Adams, our first two Presidents, promoted the use of whipping as punishment. Corporal punishment was endorsed as well by great leaders such as Abraham Lincoln and Theodore Roosevelt. The process is a Constitutional one, endorsed or used by many of our most notable Presidents from the Continental Congress to the 20th Century.

It is my hope that this Senate will show compassion to the victims of these terrible crimes enough to act. By passing this bill we will make a resounding statement that rape is absolutely unacceptable. We will show our deep empathy for the plight of the victims. And we will help to curb this terrible epidemic.
