An expedition starts roughly 14 OOC hours after mine [ICly it should be a bit less than the journey from the Cape to Spain + the duration of the RP posts there] , from a location more north than mine, and somehow comes past it and founds a colony.

Bullshit. The Southernmost point in Africa is near the town of Agulhas, not on the cape peninsula.

The Cape is where they settle.

You can settle east of the cape, west of the cape, sure. But the cape is mine. EDIT: Technically, the settlement would be in the southern part of the cape, so theoretically you could settle its north. It just wouldn't end well,probably, for one of us which is not me/EDIT
That is unless you want to spark a war (which any settlement down there may lead to, long term, unless we find some kind of solution), in which case, feel free.
