Clause 2 was passed in the bill under different wording than the LP demanded. It still maintains the implications. With 2/3 vote, the Senate can overthrow you.

Ministry of Defense Act

Preamble


Whereas we are now an independent an sovereign state, to ensure a continuation of our independence and sovereignty we must hold the means to defend ourselves.
Whereas a Ministry of Defense has been defined by L102 - The Council of Ministries Act - it has not been fully expanded upon.

Body


1. Declares the Ministry of Defense the governmental sub-entity, headed by the Minister of Defense, who in turn is appointed by the Ruling Party/coalition.
1.1 Defines the Intent of the Ministry of Defense to create a free Corburnian defense organization.
1.2 Additionally defines MoD as abbreviation for both the Ministry and the Minister of Defense, to be used where appropriate.
1.3 Sets the MoD as only needing to head the calls of the government which appointed him, for the sake of organization, but implores him to answer to the senate, should need arise.
1.4 Defines the office of Minister of Defense to organize/create/manage the defense institutions of the Corburnian nation.
1.4.1 Adds that the Minister of Defense also is the "Commander of the Armed Forces", which is the second highest executive military position, after the PM, who is "Commander in Chief"

2. Places Multiple limitations on the Governments control of the Armed Forces.
2.1 Restricts the Armed forces from performing Combat operations.
2.1.1 Exempts the Armed forces from such limitations under circumstances of there being a due cause for the standard functions of state being dissolved.



Enactment Clause


This bill, due to being a merely organizational bill, shall be placed into effect up to one month after it passing the law.
It might have a weak effect of raising the bureaucratic expenditure of the government.

That is the exact last version I posted, and therefore the version people voted on.
Also, I'd like to note a second planted loophole - it does not define who decides those circumstances.

Perhaps this indicates that we need legislation - maybe even an OOC rule - which states that, once legislation is proposed, it can't be edited in any way without a proper amendment bill being passed. I'm not even saying that anyone's godmodding or being misleading, just that the Senate thread has been fairly disordered, which can lead very easily to confusion.

Though I'll add that I may have defined the laws as purposefully misleading - L108 and L112 that is.

BEFORE WE DO THIS:

Jonathan can't be in two places at once. Is he on the Senate Floor, getting ready to face the wrath of several angry politicians, or hiding out somewhere away from any forces?

A102 states amendments as a form of legislation, which would basically include repeals. I think amendments should be directly voted on, though.

Take the WA: if it hasn't been passed, it should be discussed in, perhaps, this OOC thread instead of the IC Senate thread, and be amended there. Once finalised, it should be submitted to the Senate. Less bills, less hassle, less bureaucracy.

So that means no debating IC, I think we should just create a second IC Thread just for the Senate for debating acts and such, and just use the chamber for posting the acts and votes. If there is an amendment before the act is passed it shouldn't have to follow the proper format, that would only be for once the act is passed.
