How does YN handle diplomatic immunity and asylum?

Postby Sucrati » Thu Mar 15, 2018 6:30 pm

Simply put, what are your nation's rules, laws, etc on diplomatic immunity and asylum?

"We do not allow diplomats, ambassadors, or any foreign dignitary the ability to be granted diplomatic immunity. Once inside the borders of our nation, anyone, citizen or not, is subject to all laws of the nation. We do however, grant political, economic, and special asylum to foreigners, officials or civilians. That saying, we expect anyone seeking asylum to abide by our laws. We cannot claim that people must abide by our laws if we don't enforce them on everyone as no one is above the law."

We have a unique way of dealing with diplomats. With infractions (ie speeding, running a red light, unauthorized selling of drugs), usually we just assess them a small fine, like with our citizens. If the diplomats don't pay, we usually let it go as long as an individual doesn't rack up an excessive amount of fines. With misdemeanors (ie assault, almost any property crime, robbery, theft), the diplomats are asked to do community service like anyone else convicted of a misdemeanor. They usually are given a lot of flexibility in completing their community service. With a felony (murder, rape, aggravated assault, kidnapping), the diplomat is given the option of leaving the country and being tried in their home country, or serving their sentence here (our rebilitation centers are preferable to jails of other countries). In short, we want diplomats to feel safe but still act peacefully and lawfully.

As far as asylum goes, well, we have an open border policy. Anyone who wants citizenship gets it, unless they are a proven terrorist. Now, if someone qualifies for refugee status, they can receive assistance beyond what normal new arrivals get. For example, a refugee is usually given help finding a job, a basic income higher than that of those unemployed, help finding a home, etc.

Our nation follows diplomatic immunity laid out in international treaties (Vienna Convention, New York Convention for UN staff). Service staff can be issued traffic tickets and be subpoenaed, arrested, have their houses reasonably searched, while higher level staff have more protections, such as administrative/technical staff and diplomatic agents (they are only allowed to be issued traffic tickets).

However, as our embassy staff are part of All-Union Public Service (the federal bureaucracy), they follow regulations laid out for ethical and legal conduct.

We are also willing to address financial issues if diplomatic staff run debts or damage property. The same goes for civil issues. And for any serious crime or an act committed against the national security of the UBNA the accused offender will be arrested and given fair treatment while in jail. Ambassadors and other diplomatic staff are subject to being declared personae non gratae.

If the host nation does grant diplomatic immunity in line with international treaties or North American practices for our diplomatic staff, then we will not have diplomatic staff at all of that other country in the UBNA. We'll give you diplomatic immunity if you give us diplomatic immunity.

We have very few formal diplomatic ties. We only exchange ambassadors with nations that we trust. We don't expect any special treatment for our citizens overseas* and we don't give special treatment to anybody on our soil. All diplomatic staff are expected to behave themselves. If they do not, they will be politely asked to leave. if they do not leave voluntarily, they will be placed on the next flight out, to wherever, in the cargo hold if necessary.

* In case of emergency, Fatatatutti Intelligence Department No. 6 (FI6) does have "extraction specialists" (also known as the Houdini Squad) to rescue any of our citizens who get in trouble overseas.

There is nothing in our constitution that provides for diplomatic immunity by default, however should such a case arise it would be up to whomever was Empress at the time whether to acquit or pardon a diplomat who stood accused of a crime. (She has this power in all cases, not just in the case of a diplomat.)

Elvectica has a large and ever growing embassy programme. All ambassadors from foreign territories and nationstates are granted diplomatic immunity, while embassy staff are not. They are, however subject to heavier fines, and a possible exemption from diplomatic summits and discussions if said ambassador is a repeat offender, or has violated regulations to an extreme degree. Every sentient being in Elvectica is under the Common Sentient Rights and Freedoms Acts under the Constitution.

Diplomatic immunity extends as far as class 1 offenses. Diplomatic immunity does not exist beyond that. Asylum is granted commonly to certain peoples and/or for certain causes.

In the very rare event that the Princess invites foreign heads of state or their representatives for a visit, she will be with them all the time. So there is no chance for them to break any of her laws, because Natalya will definitely not take kindly!

Diplomats cannot be prosecuted for doing their official work. However, crimes like murder or theft are NOT part of a diplomat's official work, and immunity does not apply.

Our island is small. It is a member of a large group of countries (the Communist bloc), and all international contacts are made through this block, there are ambassadors of all powers on the mainland. And we have no ambassadors or embassies on the island. Asylum and citizenship are granted only to those who support our ideology, and take an oath to our values. Before that, they are in quarantine for several months on the mainland. There, the secret services of the Communist bloc are studying their background to avoid the infiltration of subversive elements on the island.

Diplomatic immunity is not recognized within the borders of the Reich, however, the Obersterfuhrurin does recognize mutual respect and dignity among her diplomatic equals. This means that as long as you show respect and don't anger the Obersterfuhrur, no diplomat will have anything to worry about. The Obersterfuhrurin does want every diplomat that comes to the Reich to know that this is her land, her people, and her customs, and that they are at the mercy of her will. She's all too willing to go to war over an insult or threat.
